The House met pursuant to adjournment.

Prayer by Rev. Dr. Halley.

The minutes of yesterday were read and approved.

In pursuance of the ninth joint-rule, Mr. Speaker announced the order of business, "third reading of bills."

By unanimous consent, on motion of Mr. Chapman,

Resolved, That the bill to repeal the Laws of 1867, in relation to the police force of the city of Utica, be referred to the sub-committee of the whole.

By unanimous consent,

Mr. Johnson, from the committee on the affairs of cities, to which was referred the bill entitled "An act to incorporate and establish a milk exchange in the city of New York," reported in favor of the passage of the same; which report was agreed to, and said bill committed to the committee of the whole.

By unanimous consent,

Mr. Jones, from the committee on the affairs of cities, to which was referred the bill entitled "An act to extend Flushing avenue, and to lay out, open and improve Flushing avenue and Newtown Turnpike road, from Broadway to the city line, and to close and to extend other adjoining streets in the city of Brooklyn," reported in favor of the passage of the same; which report was agreed to, and said bill committed to the committee of the whole.

By unanimous consent,

Mr. Parshall offered for the consideration of the House a resolution, in the words following:

Resolved, That the bill to incorporate the Clyde Savings Bank, be considered in the first committee of the whole not full.

Mr. Speaker put the question whether the House would agree to said resolution, and it was determined in the affirmative, two-thirds of all the members present voting in favor thereof.

By unanimous consent, on motion of Mr. Raber,

Resolved, That the bill entitled "An act to extend, widen and improve Flushing avenue, in the city of Brooklyn," be recommitted to the committee on the affairs of cities, with power to report complete at any time. By unanimous consent,

Mr. Underwood introduced a bill entitled "An act to amend chapter 32 of the Laws of 1868, entitled 'An act to amend an act entitled An act to authorize the villages of Sandy Hill and Fort Edward, in the county of Washington, to issue bonds to aid in the construction of a railroad from the village of Glen's Falls to intersect the Saratoga and Whitehall railroad, in the village of Fort Edward,' passed May 23, 1867, passed March 18, 1868," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

The bill entitled "An act to amend an act incorporating the Walkill Valley Railroad Company, by authorizing said corporation to extend its road to Kingston, Ulster county, and to authorize certain towns in Ulster [ASSEMBLY JOURNAL.] 110

county to issue bonds to aid in the construction of said road," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.

The bill entitled "An act to provide for widening the Coney Island plankroad, in the county of Kings, and for the subsequent management thereof," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof.

Ordered, That the Clerk deliver said bill to the Senate, and request

their concurrence therein.

By unanimous consent, on motion of Mr. Riley,

Resolved, That the bill entitled "An act in relation to the opening, extending and widening of Thompson and other streets, in the city of New York," be recommitted to the committee on the affairs of cities, with power to report complete at any time.

Mr. Murphy moved to lay the present order of business on the table. Mr. Speaker put the question whether the House would agree to said. motion, and it was determined in the negative, two-thirds of all the members present not voting in favor thereof.

The bill entitled "An act to provide for the payment of certain fines and penalties collected in the city and town of Newburgh, in the county of Orange, to the commissioners of the alms house of said city and town," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.
