SEC. 2. Extension of time for completion of works granted under this act shall automatically extend the time for making proof of application of water to beneficial use.

SEC. 3. Since this act is to provide for the present emergency, it shall remain in force and effect only until January 20, 1927.

SEC. 4. An emergency existing therefor, this act shall take effect and be in force from and after its passage and approval.

AN ACT

AUTHORIZING THE DEPARTMENT OF PUBLIC INVESTMENTS TO SELL ANY AND ALL INVESTMENTS MADE BY SUCH DEPARTMENT FROM MONEYS BELONGING TO THE PUBLIC BUILDING ENDOWMENT FUND OF THE STATE TREASURY AND REPLACE SUCH PROCEEDS IN THE PUBLIC BUILDING ENDOWMENT FUND: AUTHORIZING THE STATE TREASURER TO PAY AND RETIRE CAPITOL BUILDING BONDS OF THE STATE OF IDAHO FROM ANY MONEYS IN HIS POSSESSION BELONGING TO THE PUBLIC BUILDING ENDOWMENT FUND OF THE STATE TREASURY.

Be It Enacted by the Legislature of the State of Idaho:

SECTION 1. The Department of Public Investments is hereby authorized to immediately sell any and all investments made by such department from moneys belonging to the Public Building Endowment Fund of the State Treasury and place the proceeds from such sale or sales in the Public Building Endowment Fund of the State Treasury.

SEC. 2. The State Treasurer is hereby authorized to pay and retire Capitol Building Bonds of the State of Idaho, from any moneys in his possession_belonging to the Public Building Endowment Fund of the State Treasury whenever any of said bonds may become callable under the provisions and terms of such bonds.

CHAPTER 30

AN ACT

CREATING THE WARM SPRINGS CREEK GAME PRESERVE IN BLAINE COUNTY, AND PROVIDING PENALTIES FOR THE PURSUING, CAPTURING AND KILLING OF GAME BIRDS AND GAME AND FUR BEARING ANIMALS WITHIN THE BOUNDARIES OF SAID GAME PRESERVE.

Be It Enacted by the Legislature of the State of Idaho:

SECTION 1. There is hereby created within the boundaries of Blaine County, within the State of Idaho, a game preserve to be known as the Warm Springs Creek Game Preserve, the boundaries of which are described as follows: All of the water shed or drainage area of Warm Springs Creek, in Blaine County, in Townships Three (3), and four (4) North of Ranges, fifteen (15), sixteen (16), and seventeen (17) East of Boise Meridian, and including all of Sections twelve (12), and thirteen (13) in Township four (4) North of Range seventeen (17) East of Boise Meridian.

SEC. 2. It shall be unlawful for any person or persons, at any time of the year to hunt, trap, capture, pursue, chase, kill, or destroy any game animal or animals, furbearing animal or animals, or game bird or birds, of whatsoever kind or description within the said Warm Springs Creek Game Preserve.

SEC. 3. Nothing in this act shall be construed to limit or prohibit the destruction of predatory animals as provided by law or be construed to in any way limit or prohibit the grazing of livestock upon the said Warm Springs Creek Game Preserve.

SEC. 4. Any person or persons violating any of the provisions of this act shall be deemed guilty of a misdemeanor, and upon conviction thereof, be fined not less than $25.00 nor more than $100.00, or be imprisoned in the county jail for not more than six months, or by both such fine and imprisonment. All such fines to be paid into the Fish and Game Fund of the State of Idaho.

CHAPTER 31

AN ACT

TO AMEND SECTION 2650 OF THE IDAHO COMPILED STATUTES, AS AMENDED BY SECTION 1 OF CHAPTER 112 OF THE IDAHO SESSION LAWS FOR 1921, AS AMENDED BY SECTION 1 OF CHAPTER 81 OF THE IDAHO SESSION LAWS FOR 1923, BY PROVIDING THAT THE TERM OF OFFICE OF THE FISH AND GAME WARDEN SHALL COMMENCE ON THE FIFTEENTH DAY OF APRIL NEXT FOLLOWING A GENERAL ELECTION.

Be It Enacted by the Legislature of the State of Idaho:

SECTION 1. That Section 2650 of the Idaho Compiled Statutes, as amended by Section 1 of Chapter 112 of the Idaho Session Laws for 1921, as amended by Section 1 of Chapter 81 of the Idaho Session Laws for 1923, be and is hereby amended to read as follows:

Section 2650. A fish and game department is hereby established to be under the immediate direction of the Governor of the State and the fish and game warden appointed as herein provided. The fish and game warden shall be appointed by the Governor with the approval of the Senate; his term of office shall be for two (2) years, commencing always with the fifteenth day of April next following a general election. The state fish and game warden shall be an elector of the State of Idaho. The Governor shall have the power, and it is hereby made his duty to remove the said fish and game warden for neglect of his duties, breach of trust, incompetence or malfeasance in office, upon reasonable cause shown.

AN ACT

REGULATING THE PRACTICE OF EMBALMING; AMENDING SECTION 334 OF THE COMPILED STATUTES AS AMENDED BY THE IDAHO SESSION LAWS OF 1921, CHAPTER 198, BY SUBDIVIDING THE SAME INTO SECTIONS 334 AND 334-A TO 334-M, INCLUSIVE, AND PARTICULARLY AMENDING THAT PORTION THEREOF RELATING TO EMBALMERS AND DESIGNATED SECTION 334-G; AMENDING SECTION

2199 OF THE IDAHO COMPILED STATUTES AND SUBDIVIDING THE SAME INTO SECTIONS 2199-A, 2199-B, AND 2199-C.

Be It Enacted by the Legislature of the State of Idaho:

SECTION 1. Section 334 of the Idaho Compiled Statutes as amended by the Idaho Session Laws of 1921, Chapter 198, is hereby amended by subdividing the same into Sections 334 and 334-A to 334-M, inclusive, and by amending that portion thereof designated as Section 334-G, as follows:

Section 334. REGISTRATION OF OCCUPATIONS: EXAMINERS: None of the above enumerated functions and duties shall be exercised by the department of law enforcement, except upon the action and report in writing of persons designated from time to time by the commissioner of law enforcement to take such action and to make such report, for the respective professions, trades and occupations as follows:

334-A. FOR THE MEDICAL PRACTITIONERS: Six persons, all of whom shall be graduates of reputable medical colleges or universities and reputable physicians licensed to practice medicine and surgery in this state, a majority of whom shall not be representative of any school of medicine and among whom three schools of medicine shall be represented.

334-B. FOR THE DENTISTS: Five persons, each of whom shall be a licensed practitioner of dentistry in this state. 334-C. FOR THE OSTEOPATHS: Five persons, each of whom shall be a licensed practitioner of osteopathy.

334-D. FOR THE OPTOMETRISTS: Three persons, each of whom shall be a licensed optometrist in this state.

334-E. FOR THE PHARMACISTS: Three persons, each of whom shall be a licensed pharmacist actively engaged in the practice of pharmacy in this state.

334-F. FOR THE REGISTERED NURSES: Three persons, one of whom shall be a physician licensed to practice in this state, who shall have been graduated for at least a period of five years from a reputable school, and two of whom shall be registered nurses in this state and shall have graduated for at least a period of five years from a reputable training school for nurses and all of whom shall be residents of this state and eagaged in professional work.

334-G. FOR THE EMBALMERS: Three persons

who shall be licensed embalmers of the state.

334-H. FOR THE VETERINARIANS: Three persons, each of whom shall be a licensed veterinarian and a graduate of a legally chartered or authorized veterinary college or

veterinary department of a university or agricultural college. 334-I. FOR THE ACCOUNTANTS: Three persons, each of whom shall be a certified public accountant.

334-J. FOR THE ARCHITECTS: Five persons, one of whom shall be a member of the faculty of the agricultural or engineering department of the state university, one a sanitarian, and the other three licensed architects residing in the State of Idaho, having been engaged in the practice of architecture for at least five years.

334-K. FOR THE SURVEYORS: Three licensed surveyors: Provided, that the same persons designated to act in the capacity of the profession of civil engineering under Chapter 102 of the Compiled Statutes of Idaho may at the request of the Commissioner of Law Enforcement act also for the surveyors.

334-L. EXAMINER'S REPORT: The action or report in writing of a majority of the persons designated for any given trade, occupation or profession, shall be sufficient authority upon which the Commissioner of Law Enforcement may act.

334-M. EXAMINERS: RECOMMENDATION OF PROFESSIONAL SOCIETIES: In making the designation of persons to act for the several professions, trades and occupations the commissioner shall give due consideration to recommendation by members of the respective professions, trades and occupations and by organizations therein.

SEC. 2. Section 2199 of the Idaho Compiled Statutes is amended by subdividing the same into sections 2199-A, 2199-B, and 2199-C, and by changing the wording thereof as follows:

Section 2199-A. TIME OF EXAMINATIONS. The examinations provided for in this Chapter shall be held at such times and places as the Department of Law Enforcement may direct.

Section 2199-B.

REQUIREMENTS FOR ELIGIBILITY TO TAKE EXAMINATIONS. An Applicant for license to practice embalming shall:

(a) Have attained the age of 21 years;

(b) Be of good moral character;

(c) Have completed a four years' course in a duly accredited high school, or a course of education equivalent thereto;

(d) Have had not less that three years' practical experience under a licensed embalmer in this state, or in lieu thereof, shall have had a practical experience of not less than two years under a licensed embalmer in this state and
