Provide Medical Assistance in Cases of Accidents upon Railways.

HEREAS no Action is now maintainable against a Railway Preamble.
Company by a Surgeon called in by the Servant of a Rail-

way Company to render Assistance to a Passenger who has been accidentally injured on a Railway, and it is oftentimes right 5 and expedient that the Railway Company in such Case should be answerable for the Services of the Surgeon so called in: Be it therefore enacted by the Queen's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in the present Parliament assembled, and by the Authority of 10 the same, That in case an Accident occur upon a Railway which Servants of occasions such Injury to a Passenger thereby as to render Medical Railway Company to Advice necessary, it shall be the Duty of the Servants of the Railway call in SurCompany by whose Train such Passenger shall be travelling, or (in geon in case case the Accident occur to a Passenger travelling by the Train of 15 a Railway Company passing along or over the Line of any other Railway Company) of the Railway Company upon whose Line of Railway such Accident shall occur, to obtain, as soon as possible after the Occurrence of the Accident, the Assistance of a Surgeon to attend such Passenger; and in case of Neglect of such 20 Duty by the Servants of the Railway Company, the Company whose 436. II. III. And be it enacted, That in case a Railway Company shall incur any such Expense in respect of an Accident, for the Consequences of which some other Railway Company shall be legally 15 liable, the Company incurring such Expense shall have a legal Right to recover over against such other Railway Company the Expense so incurred.

IV. And be it enacted, That in case a Railway Company shall incur any such Expense in respect of an Accident occasioned by the 20 Neglect, Default, or Misconduct of the Passenger injured, the Company shall have a legal Right to recover such Expense from such Passenger, or his or her legal personal Representatives: Provided always, that if in such last-mentioned Case the Passenger injured shall be a Pauper, or Person receiving Parochial Relief, and unable 25 to repay the Amount of such Expense, the Railway Company shall have a legal Right to recover the same from the Overseers of the Parish in which such Accident shall have happened.

V. And be it enacted, That it shall be and is hereby declared to be the Duty of the Directors of Railway Companies to cause due 30 Notice of the Provisions contained in this Act to be affixed in some public Place at every Station along their Line of Railway.

VI. And be it enacted, That the following Words and Expressions are intended to have the Meanings hereby assigned to them respectively, so far as such Meanings are not excluded by the Context or 35 by the Nature of the Subject Matter; that is to say, Words denoting the Singular Number are to be understood to apply also to a Plurality of Persons or Things, and Words denoting the Masculine Gender are to be understood to apply also to Persons of the Feminine Gender; and the Word "Passenger" shall include a Person at a 40

Railway Station, and whether in a Railway Carriage or not; and the Word "Servant" shall apply to any Person in the Employment of a Railway Company; and the Word " Surgeon" shall include a Physician, and every other duly qualified Medical Practitioner; and 5 the Word "Parent" shall include Father and Mother, and Grandfather and Grandmother, and Step-father and Step-mother; and the Word "Child" shall include Son and Daughter, and Grandson and Grand-daughter, and Step-son and Step-daughter.
