A. I did send such a message, as I wished no more money to be drawn of Mr Hunter than I could pay him when I returned.

Q. 51. From whence did you send such message, and by whom?

A. I sent such message either from Team or Shafto.-I do not recollect which, or by whom.

Q. 52. On what day did you send it, as near as you can recollect?

A. I have no recollection of the day on which I sent it.

The court now adjourns till to-morrow morning at half past nine o'clock.

Lieutenant Morrison's cross examination continued.

Q. 53. By the Prisoner. How much money was due to you upon the balance of account ending on the 24th August last? A. The balance due to me on the 24th August was £5 17s. 91d.

Q. 54. State to the court the amount of the balance of account due to you on the 19th September last.

A. The balance due to me on the 19th September was £23 4s. 6 d.

Q. 55. State to the court the amount of the balance of account which was due from me to you on the 23d September last, for money actually advanced by you, or by Mr Hunter on your account, for pay and bounties?

A. The sum paid for pay and bounties for the party, to the 23d September, was £39 8s. 42d. which was the balance of account in my favor.

Q. 56. Had the sums with which I am charged by you to make up that balance been actually paid by you, or by Mr Hunter on your account, on the 23d September last?

A. It was.

Q. 57. Whether, during your absence from Hexham in the month of September last, your serjeant had obtained any, and how much money from Mr Hunter on your account, for carrying on the service?

A. He had obtained £19, and which sum I repaid him on the 24th September.

Q. 58. Have you his receipt for it; and, if so, produce it

to the court?

A. I have not; no receipt was given by me to Mr Hunter for the money. The memorandums, which were given by my

serjeant to Mr Hunter for the money, were given up by Mr Hunter upon his being repaid the sums in advance.

Q. 59. To whom were the memorandums given up by Mr Hunter?

A. The memorandums were partly given up to the serjeant, The memorandum for the £19 was given up to me, when I paid the money on the 24th September.

Q. 60. What has become of such memorandums?

A. I do not know; I did not keep them after the account was settled.

Q. 61. Whether some, and what part of the money, thus obtained by the serjeant from Mr Hunter in your absence, was not obtained expressly on my account?

A. Amongst the memorandums given up to me on the 24th September was one purporting to his, (Mr Hunter,) having advanced the serjeant £10 on account of Captain Dale.

Q. 62. Did you learn from the serjeant, on or about the 23d September, that he had obtained the sum of £10 on my account, in consequence of your having restricted him from get ting from Mr Hunter any more money, either for pay or bounties on your account?

A. I did.

Q. 63. Is this letter and account your hand writing?

A. It is.

Q. 64. Whether the £10 which the serjeant had obtained from Mr Hunter, on my account, had not been expended in paying part of the bounties included in this account?

A. It was expended in pay and bounties included in that

account.

Q. 65. Did you or not, on the 25th September last, draw a bill upon Mr James Elder, for the balance of this account, adding to the amount of the bill, one week's pay for your party; and what was the amount of the bill so drawn?

A. I did draw such a bill.-The amount of it was £42 18s. including the week's pay to the party.

Q. 66. Was that bill duly honored?

A. It was.

Q. 67. Whether, after sending me your account up to the 24th August last, you sent me any further account whatever, until you sent me the account of the 24th September last, now before the court?

A. I do not recollect sending Captain Dale any regular account; but, in my applications by letter for money between those periods, I generally named the sum I was in advance, as nearly as I could.

Q. 68. Whether you have any reason to suppose, by letter from me or otherwise, with the exception of my letters of the 30th August, and 19th September last, that any of these applications were received by me?

A. I have no means of knowing.

Q. 69. How long did you remain at Hexham under my command, after the settlement of the account of the 24th September last?

A. To the 18th December, when the command devolved upon Captain Thain.

Q. 70. Whether your party did not regularly receive their pay, during the whole of the time mentioned in the present charge?

A. They did regularly receive their pay, but it was advanced from my pocket, or on my account.

Q. 71. By the court.-You stated in your examination on Tuesday, that the £40 advanced by Captain Dale, for the payment of bounties and subsistence of the party, lasted till the 20th August, with the exception of 19s. odd pence. How do you reconcile this with your statement yesterday of £2 being paid on the 17th out of your own pocket?

A. The account was sent on the 15th August, and the recruit not attested until the 17th, to whom the £2 was paid, consequently it could not be included in that account.

Q. 72. In the several statements you sent to Captain Dale, subsequent to the 20th August, was the money misapplied by Serjeant Walton included in the balance against Captain Dale?

A. It was not.

Q. 73. Lieutenant Morrison having informed Captain Dale by letter, that if he did not send him some money he could not continue to pay the party. How long was it after writing that letter before Lieutenant Morrison received the necessary supply?

A. I received it in sixteen days.

Q. 74. Supposing Captain Dale to have answered your letters of the 9th September, and those of uncertain date, between that period and the 20th of September, the day after he could possibly have received them, how could you have received those letters, absent as you were from Hexham during all that time?

A. Had an answer to any of those letters arrived, I left positive orders with my servant to forward all letters from Alnwick to me by an orderly.

Q. 75. As you thought yourself authorized to draw on the 25th September, for a larger sum than Captain Dale had desired, why did you not exercise the same discretion before that time? A. As Captain Dale and myself were always on the best of terms, I wished to do nothing unpleasant to him, and expecting every day that he would attend to my applications.

Q. 76. During the sixteen days elapsed between the writing of the letter, dated 9th September, and the supply of cash you received from Captain Dale, in consequence of that letter, was there any occurrence detrimental to the service on which you were employed?

A. I know of none.

Q. 77. As you have stated that all letters, arriving for you in your absence from Hexham, were ordered by you to be forwarded by an orderly man. How came it that you never received Captain Dale's letter of the 19th, till the 23d September?

A. I do not know; I cannot account for it.

Q. 78. Whether you did, or not, a few days after the settling of the account of the 24th September, draw another bill upon Captain Dale for £7. 11s. without any previous authority from

him?

A. I did.

Q. 79. Did you ever make a complaint to the commanding officer of the regiment, or in any other way, of the delays you state to have taken place on the part of Captain Dale?

A. I never did.

Q. 80. You state that Captain Dale told you at Newcastle that your account was perfectly correct. Are you able to state positively the date of the account so alluded to?

A. The account, so alluded to, is from the 25th June to the 24th August, 1809.

Q. 81. Did you yourself, or Captain Dale, first open the account with Mr Hunter, which enabled you from time to time to procure different sums for the payment of your party?
