ed rates of pay. The Personnel Director shall determine the values to be placed upon such maintenance, taking into consideration the costs of the maintenance provided and the convenience of the Government served thereby. Maintenance shall not be considered to include the costs of travel incurred in connection with official duties.

(b) The minimum rate of each pay range shall be the normal rate for initial employment in the positions and classes assigned thereto. The Personnel Director however, may, with the approval and consent of the Personnel Board, authorize initial employment in the class at a higher rate in the pay range if such action is warranted by recruitment difficulties or by special or unusual qualifications of the individual employed.

(c) Advancement of employees within the pay ranges established for their positions shall be based upon quality of work and length of service in a manner to be determined by the personnel rules.

Section 13. Initial Application of Pay Plan. On the effective date of this Act the pay rates of employees to whom this Act applies shall be adjusted to the rates provided in this Act in the following manner:

(a) Employees paid at rates below the minimum rate established for their class of positions by this Act shall have their pay rates increased to the minimum rate for the class.

(b) Employees paid at rates falling within a pay range but below the maximum rate established for their class of positions by this Act shall be increased to the rate in the pay range next above their pay rates.

(c) Employees paid at rates at or above the maximum rate established by this Act for their class of positions shall be neither increased nor decreased in pay unless a general reduction in pay rates of officers and employees of the Government is placed into effect.

(d) Officers and employees working under contract and whose salary exceeds the maximum rate established by this Act for their class of positions shall be terminated upon completion of such existing contracts, and may be reemployeed only in accordance with the pay rates established by this Act for their respective positions.

(e) Increases in pay rates provided for in this Section shall be retroactive to August 1, 1950.

Section 14. Separability of Provisions. If any provision of this Act is declared to be invalid such decision shall not affect the validity of the remaining provisions.

Section 15. Appropriation Authorized. There are hereby authorized to be appropriated such sums as may be necessary to carry out the provisions of this Act.

Section 16. Effective Date. This Act shall become effective upon approval by the Governor to operate upon passage by the Guam Congress and approval by the Governor of the Division on Classification of Pay

ranges.

[Public Law 5 - First Guam Legislature, First Special Session]

AN ACT

Relating to the name of the Legislature of Guam and designating the sessions thereof.

Be it enacted by the Guam Congress:

Section 1. The legislature created by the Organic Act of Guam shall be known and designated as the "Guam Legislature".

Section 2. The regular session of the Guam Legislature convening on the second Monday in January in the Year 1951 shall be designated the "First Guam Legislature, 1951 (First) Regular Session"; the regular session convening on the second Monday in January in the year 1952 shall be designated as "First Guam Legislature, 1952 (Second) Regular Session".

Section 3. Succeeding Legislatures shall be designated in the same manner except that each newly elected Legislature shall be known and designated by successive number; that is the legislature elected in 1952 shall be known and designated as the "Second Guam Legislature" and each legislature elected thereafter shall likewise be known and designated by the addition of one number for each succeeding legislature.

Section 4. Special sessions of any legislature shall be known and designated as First, Second, Third, et seq, special session following the designation of the number of the legislature; that is the first special session of the First Guam Legislature would be designated "First Guam Legislature, First Special Session".

Section 5. This is an urgency measure and shall take effect upon its approval by the Governor.

[Public Law 1 - First Guam Legislature]

AN ACT

Relating to an enacting clause for laws and a resolving clause for resolutions.

Be it enacted by the Guam Congress:

Section 1. Enacting clause for laws. The enacting clause of all laws shall hereafter read, "Be it enacted by the People of the territory of Guam".

Section 2. Resolving clause for resolutions. The resolving clause of all resolutions shall read, "Be it resolved by the Legislature of the territory of Guam".

Section 3. Public Law No. 13, Ninth Guam Congress, adopted prior to the Organic Act of Guam is hereby declared repealed in its entirety. Section 4. This act is an urgency measure and shall take effect upon its approval by the Governor.

[Public Law 2 - First Guam Legislature]

AN ACT

Relating to the designation of the Special Session of the Guam Legislature which met from December 13, 1950 through January 4, 1951 inclusive.

Be it enacted by the People of the Territory of Guam:

Section 1. The special session of the Guam Legislature which met from December 13, 1950 through January 4, 1951 inclusive and was at said time known as the Eleventh Guam Congress is hereby designated as "FIRST GUAM LEGISLATURE, First Special Session".

Section 2. Public Law No. 1, Public Law No. 2, Public Law No. 3, and Public Law No. 4, passed at the special session referred to in Section one of this act are hereby re-titled to conform herewith.

Section 3. This is an urgency measure and shall take effect upon its approval by the Governor.

[Public Law 3 - First Guam Legislature]

AN ACT

Making an appropriation for the contingent expenses of the Guam Legislature, including expenses of Committees, to take 'effect immediately.

Be it enacted by the People of the Territory of Guam:

Section 1. The sum of Forty-eight thousand ($48,000.00) dollars, to be allocated as follows:

or so much thereof as may be necessary, is hereby appropriated for the contingent expenses of the Guam Legislature for the 1951 Regular session thereof, including expenses of committees.

Section 2. This Act makes an appropriation for the usual expenses of the Legislature an urgency measure, and shall take effect immediately upon its approval by the Governor.

[Public Law 4 - First Guam Legislature]

AN ACT

To authorize and direct the Board of Education to study and report upon ways and means to make higher education available to the young men and women of Guam.

Be it enacted by the People of the Territory of Guam:

Section 1. The Board of Education is hereby authorized and directed to study various ways and means of making higher education available to the young men and women of Guam. Such study shall embrace: vocational courses, scholarships for collegiate training in existing institutions outside Guam, establishment of a junior college, and other alternative educational and training programs, the relative costs, and the needs of the community for each. The Board is directed to report its recommendations to the Governor for transmission to the Congress by January 1, 1952.

Section 2. Services of government employees may be available, with the approval of the Governor, to assist the Board in this study.

Section 3. Effective date. This is an urgency measure and shall become effective upon the date of its approval by the Governor. Approved April 9, 1951.

[Public Law 5 - First Guam Legislature]

AN ACT

To repeal Chapter IA, Part I, Title I, of the Code of Civil Procedure, relating to the Superior Court of Guam, and for other purposes.

Be it enacted by the People of the Territory of Guam:

Section 1. Chapter 1A, of Part 1, Title 1, of the Code of Civil Procedure of Guam is hereby repealed in its entirety.

Section 2. The original jurisdiction of the Island Court of Guam to try, hear, and determine civil actions and proceedings wherein the Government of Guam is a party plaintiff, party defendant, or party in interest, which was revoked by implication on the effective date of Executive Order No. 24-47, dated 3 October, 1947, is hereby reinstated to the same extent and purposes as if Executive Order Number 24-47 had never been promulgated.

Section 3. All records, books, papers, causes, actions and proceedings lodged, deposited or pending in the Superior Court of Guam wherein the Government of Guam is a party plaintiff, party defendant or party in interest, are transferred to the Island Court which has jurisdiction over them as if they had been in the first instance lodged, deposited, filed, or commenced therein.

Section 4. All records, books, papers, causes, actions, and proceedings lodged, deposited or pending in the Superior Court of Guam wherein the United States of America is a party plaintiff, party defendant, or party in interest, are transferred to the District Court of Guam which has, by virtue of the passage of Public Law 630 of the United States Congress, jurisdiction over them as if they had been in the first instance lodged, deposited, filed or commenced therein.

Section 5. This act is an urgency measure and shall take effect upon its approval by the Governor.

[Public Law 6 - First Guam Legislature]

AN ACT

Making appropriations to carry out the provisions of the Compensation Law for the fiscal year ending June 30, 1951.

Be it enacted by the People of the Territory of Guam:

Section 1. Pursuant to the authority of Section 15 of the Compensation Law (Public Law No. 4, Eleventh Guam Congress, approved January 11, 1951) there are hereby appropriated out of any monies in the Treasury of Guam, not otherwise appropriated, seven hundred and sixty thousand dollars ($760,000.00) or so much thereof as may be found necessary after final determination of the classification of positions or classes of positions to which the Compensation Law applies, for the purpose of compensating employees of the Government of Guam in accordance with the provisions of said Compensation Law for the fiscal year ending June 30, 1951.

Section 2. Any compensation to which employees may be entitled for employment during the period from August 1, 1950 to the effective date of this act, may be paid to such employees in the form of a lump sum or otherwise; provided, however, that each such employee shall have the right to select payment for such compensation in the form of a lump sum.

Section 3. This is an urgency measure and shall become effective upon approval by the Governor.

AN ACT

Repealing Section 178 of Chapter VII of Title VII of Part I of the Penal Code of Guam relating to engaging in trade by public officials.

Be it enacted by the People of the Territory of Guam:

Section 1. Section 178 of Chapter VII of Title VII of Part I of the Penal Code of Guam is hereby repealed in its entirety.

Section 2. This is an urgency measure and shall take effect upon its approval by the Governor.
