[Public Law 1 - First Guam Legislature, First Special Session]

AN ACT

Providing for a Board on Utility rates to determine and recommend schedules of water rates and related charges; modifying Chapter 12 of the Civil Rules and Regulations with the Force and Effect of Law in Guam.

Be it enacted by the Guam Congress:

Section 1. For the purpose of bringing the water rates and all related service, meter and other charges in effect in Guam into conformity with a rate structure that is uniform and impartial with respect to all users similarly situated or falling within categories of standardized designation, and for the purpose of improving the water service to the public of Guam, a board to be known as the Board on Utility Rates in Guam is hereby established.

Section 2. The Board shall be composed of three members to be appointed by the Governor with the advice and consent of the Guam Congress. The Governor shall select the chairman. One member shall be familiar with the problems of operation, maintenance and distribution of water through a public system; one member shall be familiar with the procedures of billing, accounting, and record keeping as followed by the office of the Treasurer of Guam; and one member shall be familiar with the consumption of water by the public of Guam. The members of this Board shall serve for a term of two years and without remuneration.

Section 3. The provisions of this act and the cognizance of the Board shall extend to all water sold, provided, or distributed by the Government of Guam to non-governmental consumers of every kind and category.

Section 4. The functions of the Board shall be: To formulate, establish and publish, and from time to time to review and where necessary revise, subject to the approval of the Governor, fair and reasonable schedules, uniform as to classes, of water rates and of all related service, meter and other applicable charges for all water sold, provided or distributed by the Government of Guam. Such schedules may provide for separate residential, commercial, industrial or other standardized categories of rates. The Board shall annually, and may in its discretion more often, upon complaint or upon its own motion, review and recommend revision of such schedules of rates and related charges as may at any time be in effect. The Board shall fix or confirm and publish, subject to the approval of the Governor, a comprehensive schedule of water rates and related charges not later than ninety days after the enactment of this act.

Section 5. The Department of Public Works and the Department of Records and Accounts shall furnish the Board all available information concerning all elements of costs of producing, acquiring, distributing and selling water as well as of the operation, maintenance, repair extension,

amortization and administration of the water system together with any other data or information pertinent to the Board's determination of any schedule of rates and charges.

Section 6. The Board is authorized to hold under such reasonable rules as it may adopt such open or closed hearings as it may deem necessary or desirable in order to afford interested individuals, businesses, and corporations an opportunity to appear and present evidence having a bearing upon any of the business of the Board; and with the unanimous consent of its members the Board may subpoena witnesses, books and records.

Section 7. Every approved schedule of water rates, related charges or modification thereof, shall become effective on the first day of the month following the date of publication thereof.

Section 8. The office of the Board, unless otherwise directed by the Governor, shall be located at the Department of Public Works. The Department of Public Works is authorized to provide the Board, insofar as is practical, with office facilities and clerical assistance.

Section 9. The Board shall maintain on file, open to public inspection during its regular hours of business, all approved schedules of water rates and related charges.

Section 10. Nothing in this act shall be construed as relieving any person, business or corporation of any liability for water rates, taxes or charges which under the provisions of Chapter 12 of the Civil Rules and Regulations with the Force and Effect of Law in Guam, as amended by administrative action of the Governor, shall have accrued prior to the effective date of any new schedule adopted as herein provided.

Section 11. The Board is empowered, under such rules and regulations as may be approved by the Governor, to validate and authorize the continuance of the issuance and use of water chit tickets, and to determine what credit if any shall be allowed to purchasers thereof against any water bills heretofore or hereafter lawfully issued.

Section 12. This act shall become effective upon the date of its approval by the Governor.

AN ACT

To amend the Tariff Schedule and Customs Regulations of Guam by repealing those provisions pertaining to the levy, assessment and collection of customs duties and for other purposes.

Be it enacted by the Guam Congress:

Section 1. Thirty days after the approval of this Act, those provisions of the Tariff Schedule and Customs Regulations of Guam, as modified or amended, pertaining to the levy, assessment and collection of customs duties are hereby repealed and from that date no customs duties shall be levied, assessed or collected. Provided, however, that nothing in this Act shall operate to repeal, remit, void, discharge or release any liability

for customs duties levied, assessed, due or payable before the effective date of this Act.

Section 2. All other provisions of the Tariff Schedule and Customs Regulations not inconsistent with Section 1 herein are not in any way disturbed, modified, amended or repealed by this Act.

Section 3. The Governor of Guam is authorized to transfer and delegate or suspend entirely any of the functions now performed by the Bureau of Customs of the Government of Guam in order to effectuate this Act.

AN ACT

Making supplemental appropriations for the operation of the Government of Guam for the fiscal year ending June 30, 1951, and for other purposes.

Be it enacted by the Guam Congress:

Section 1. The following sums are appropriated out of any money in the Treasury of Guam, not otherwise appropriated, for the operation of the Government of Guam for the fiscal year ending June 30, 1951: FOR THE EXECUTIVE BRANCH

I. For the Office of the Election Commissioner Section 2. The Governor of Guam may transfer not to exceed twenty per cent (20%) of any of the foregoing items of this appropriation to any other appropriation or appropriations, but no appropriation shall be increased more than twenty per centum as a result of such transfer; provided, that quarterly a statement of any such transfer shall be transmitted to the Guam Congress.

Section 3. The Governor of Guam is authorized to construct and acquire, by contract or otherwise, for the Guam Memorial Hospital, appropriate and necessary permanent buildings and structures, including real property, rights of way and easements in connection therewith; and necessary equipment required for the operation of said hospital.

Section 4. There is hereby appropriated the sum of one hundred and fifty thousand dollars ($150,000.00) from any otherwise unappropriated funds in the Treasury of Guam for the preliminary work, studies and preparation of plans and specifications in connection with the construction of the Guam Memorial Hospital as authorized by Section 3 of this Act.

Section 5. The Guam Bus Line is hereby established as a separate

instrumentality of the Government of Guam. All property, facilities, equipment, supplies, records and files presently pertaining to and used in connection with the operation and administration of the Guam Bus Line are hereby transferred and assigned to said instrumentality. All personnel presently used in the administration and operation of the Guam Bus Line are also hereby transferred and assigned to said instrumentality.

Section 6. The instrumentality known as the Guam Bus Line established by Section 5 of this Act is hereby placed under the cognizance and jurisdiction of the Director of Public Works of Guam or such other officer of the Government of Guam as the Governor of Guam may determine.

Section 7. (a) For the purpose of securing self-supporting operation of the Guam Bus Line there is hereby established the "Guam Bus Line Fund," which shall be maintained separate and apart from any other funds of the Government of Guam, and independent records and accounts shall be maintained in connection therewith.

(b) The sum of ninety thousand dollars ($90,000.00) transferred prior to June 30, 1948, from the General Fund of the Treasury of Guam to the Guam Bus Line for the purpose of setting up and initiating the operation of said Guam Bus Line shall constitute the Guam Bus Line Fund established by this Section.

(c) All monies received by the Guam Bus Line from whatever source derived shall be deposited in said Guam Bus Line Fund. All operating and other expenses of the said Bus Line and any other obligations, including payment of any claims arising from its operation, shall be paid from said Fund.

(d) The Director of Public Works or such other officer of the Government who has cognizance and jurisdiction of said Guam Bus Line shall monthly render to the Governor a statement reflecting the financial condition of the Guam Bus Line Fund and a financial statement of operations of said Guam Bus Line for the period covered. The Treasurer of Guam shall periodically audit the accounts and records of said Guam Bus Line Fund and render a report thereon to the Governor.

(e) The Governor of Guam is authorized to direct, from time to time, as he may deem proper, the transfer to the General Fund of the Treasury of Guam any monies of said Guam Bus Line Fund not necessary to the operation of the Guam Bus Line. The first ninety thousand dollars ($90,000.00) so transferred to the General Fund of the Treasury shall be deemed a return of the initial operating capital advanced to said Fund.

Section 8. The Commercial Port of Guam is hereby established as a separate instrumentality of the Government of Guam. All property, facilities, equipment, supplies, records and files presently pertaining to and used in connection with the operation and administration of the Commercial Port of Guam are hereby transferred and assigned to said instrumentality. All personnel presently used in the administration and operation of the Commercial Port are also hereby transferred and assigned to said instrumentality.

Section 9. The instrumentality known as the Commercial Port of Guam established by Section 8 of this Act is hereby placed under the
