With the permission of the West Publishing Co. and by direction of the Court, I have made use of the syllabi prepared by the editorial staff of that company for use in the Southeastern Reporter.

A new feature in this volume will be found in the head notes of each page, where the reference to the page on which the opinion in the case commences is given for convenience in citing such opinion.

RULES OF COURT

The following Rule of the Supreme Court has been pro mulgated as of Nov. 15, 1921:

Rule 30:

After the return for appeal in a criminal action shall have been filed with the Clerk of this Court, the Court in open session may dismiss the appeal where it is made to appear that the grounds thereof are manifestly without merit. The Solicitor moving for such dismissal shall present a petition therefor to the Chief Justice, or the presiding Associate Justice, who, if satisfied of the reasonable grounds of the motion, shall fix a day for the hearing of the motion; a copy of the petition and of the order of the said Justice shall forthwith be served upon appellant's counsel not less than five (5) days before said date.

The Court has announced a policy of strict enforcement of Rule 8, and the portion of Rule 13 relating to the dress of attorneys.
