CHAP. XI.

Of Liens.

As to this subject in general, see ante, vol. 3. 537 to 558. In order to Vol. III. Ch.XI. create a general lien in cases where the usage of trade would not give it, a public notice must be given, and brought home to the knowledge of the party transacting business with the person who wishes to create the lien, or there must be an express agreement between the particular parties. In concerns of any magnitude, the latter would be preferable; and as in general a lien cannot be sold, (ante, vol. 3. 551.) it would be advisable to insert an express stipulation, that after a named time the party holding the lien shall be at liberty to sell, and to charge warehouseroom, &c.

Whereas a doubt has arisen whether dyers, dressers, bleachers, whisters, Notice by printers, or calenders have a right to detain goods delivered to them, not only till payment be made for the work and labor performed upon ticular goods detained, but also for work and labor of the same kind, performed upon goods already delivered out of the possession of such dyer, &c.; we the under-mentioned persons, being either dyers, dressers, bleachers, &c., hereby give public notice that we will not henceforward take into our possession any goods to be dyed, dressed, bleached, &c., unless under express condition that the goods so delivered to us or either of us, for the purpose of being bleached, &c., shall not only be subject to the debt due for the work and labor performed upon them, but also for the general balance due from the persons employing us or either of us, for work and labor of the same kind performed upon goods which we may have previously delivered out of our possession: and we hereby request all persons intending to employ us or either of us to take notice of the same. N. B. All yarn and goods bleached will be considered as subject to a lien, not only for the bleaching of those particular goods, but for the general balance of accounts due from the owners, and will be held accordingly; and if not redeemed in two months from the time of being bleached, will be sold by public auction, and the proceeds applied in or towards the payment of such bleaching or balance. And all yarn and goods delivered for the purpose of being bleached, will also be subject to the same lien, and will be held; and if not redeemed, disposed of as above mentioned.
