You will, I hope, excuse me for venturing to set you right, for it is by no means unimportant for the Bar and Legal Profession generally to know that the chance of a seat on the bench is open to those locally proving their fitness for the post, and that such nominations are far from being so rare as you had supposed." THE COMPOUND HOUSEHOLDER REDIVIVUS. MR. GOSCHEN has resolved to revive the compound householder. He proposes to amend his Payment of Rates Bill so as not merely to allow, 0 17 but to encourage, contracts between parishes and owners for payment of rates by the owner, on terms that will compensate him for the risk and trouble of collection; the tenant to be rated and to be entitled to his franchise, upon the principle established by the Common Pleas, and which supplied a solution of the supposed difficulty, that payment by the landlord is, at least for registration purposes, payment by the tenant. As we have persistently asserted from the beginning of this absurd controversy, there being no such provision as for personal payment of rates, there was no need to devise troublesome schemes for getting rid of that which did not exist. The law was amply sufficient as it stood. Even now, the better course would be, merely to repeal what was called the compound householder clauses in the Representation of the People Act, and then the law would be that the landlord and tenant would both appear upon the rate, and if the landlord chose to agree with the parish to pay the rate, such payment by him would be in contemplation of law payment by the tenant, who would be entitled to his vote, precisely as if he had paid the rate directly out of his own pocket. We would go one step further, and make the payment of rates on all tenements under 10l. per annum compulsory upon the owner instead of the tenant. A BILL has been prepared and brought into the House of Commons by Mr. GOLDNEY, Mr. T. CHAMBERS, and Mr. PEASE, to amend the law relating to the office of county coroner, and for other purposes relating thereto. It proposes to deprive the freeholders of the right of selection in these cases, and to vest the appointment in the Lord Chancellor or principal Secretary of State. The payment by fees is to be 324 abolished, and the salary is to be equivalent to the average receipts from fees during the five years ended on the 31st Dec. last. If, upon the question of remuneration, the coroners and justices of the peace cannot agree, the matter is to be referred to the Home Secretary. The Bill also proposes that county justices and municipal corporations shall be empowered to grant superannuation allowances to coroners who have become incapacitated for the performance of their duties by reason of age or infirmity. Such a scheme has been prepared by the executive committee appointed at the meeting of deputations from provincial law societies, held at Leeds on the 25th Sept. 1868, and is now before us. It really carries out in detail the plan put forward 332 by Mr. JEVONS. The subjects of study are to include Jurisprudence, the History of Law, the Roman Law, Constitutional Law, Modern Foreign Systems of Law, Common Law, Equity, and Bankruptcy, the Law of Real Pro481 perty, Criminal Law, Principles of Legislation, and International Law. The degree of Associate of Laws is proposed as a necessary qualification for a solicitor, and that of Bachelor of Laws 483 for a barrister. The scheme does not deal with the sources from which the funds for the sup485 port of the proposed University are to be derived, 486 as it is considered that the educational proposals are independent of any question that may arise on that point. 481 481 481 482 482 483 MR. F. BARROW writes to us with reference to a statement made last week on a recent 493 appointment to the Indian bench. We said that the nomination of the ADvocate-GenerAL at Bombay, as the successor of Sir JOSEPH ARNOULD, late Puisne Judge of the high court of that place, was "almost the only instance of a promotion to a Judgeship in India being conferred upon a member of the local Bar." 495 Mr. BARROW says that this is incorrect. "At Calcutta," he writes, "such nominations have been very frequent. HUGHES and Mr. MUNDELLA have introduced a Bill embodying the recommendations of Mr. HARRISON, contained in the report of the Trades Union Commission. The second clause empowers any number of persons engaged in any work or employment to make "any agreement as to wages or hours of work, and with respect to the persons by whom, or the mode in which it is to be or is not to be done, and with respect to any terms or conditions whatever, under which any work or employment shall or shall not be done or carried on." It will be seen that this legalises combinations, not merely for bargaining for wages, which is perfectly legitimate, and for hours of work, which is equally the right of the workman, but it authorises dictation as to the persons by whom, and the mode by which, any work is to be done. This is trespassing beyond the limits of the rightful exercise of power. Dictation as to persons means this, that any body of men may combine to ruin any other man, or men, or body of men; for that would be the consequence of a combination of workmen to impose upon their employer a condition that he should discharge a foreman they did not like, or some other party of men who refused to be bound by their rules or who were otherwise obnoxious to them; or even for whimsical reasons, as that no workman in the factory should exceed a certain height, or weight, or age, or excel in capacity of mind or body. Combination for such objects should not be legalised, because the objects are not such as the law should sanction. It is one of those exercises of power that are held to be against public policy; indeed, the authors of the bill will doubtless be found voting for restraints upon the powers of landowners in respect of game, to be inserted in leases, on the express ground that such powers are injurious to the common weal. So would be the powers asked for trades unions to dictate the persons by whom work is to be done and the modes of working-these being questions for the employer, not for them. Individually, they might object to work with this man or that man, and betake themselves to another work |
