ceived by him under the authority of this Act, with the date of 25 Vic. c. 27. such receipt, as well as the particular source from which such amount was derived, and the said Justice shall quarterly make up from the said book a return of the said amounts, and after deducting from the total amount received by him such expenses as are hereafter authorized, shall furnish the Commissioner of Roads with one copy of such return, and shall pay over to them the balance which shall be due, and shall then immediately forward another copy of such return with a certificate endorsed thereon, that the amount then stated to be due has been duly paid to the Commissioners as aforesaid into the office of the Receiver-General in Nassau, to be there filed and registered of record.

Cattle.

IX. That the resident Justice, and other two Justices who shall Remuneration frame the rules and regulations as provided for under the sixth of Inspector of section of this Act, shall also fix and determine by rule the amount of remuneration which the inspector of cattle shall receive for inspecting any animal, or the carcass of any unbranded animal, as well as for any other duty which he may be required to be performed by virtue of any rule to be made by the said Justices as aforesaid; and it shall be the duty of the said resident Justice at the end of every year, out of the monies to be received by him under the authority of this Act, to pay to the inspector of cattle the amount which may have become due to him, and also out of such monies to pay, liquidate, and discharge any expenses which may be incurred in carrying into execution the provisions of this Act, as well as any rule made under the authority hereof, and also to deduct out of such monies for his own proper use and benefit an amount equal to and at the rate of five per centum on the gross amount to be received by him, as aforesaid.

X. That the words cattle and animal, as used in this Act, shall Interpretation be construed to mean and apply to any bull, cow, ox, steer, heifer, of terms. sheep, pig or goat, deer or fawn.

XI. XII. That all fines, penalties, and forfeitures imposed under Mode of recothe authority of this Act, or of any rule made under this Act, very of fines, may be sued for and recovered in a summary manner before the penalties, and resident Justice or any two other Justices, and payment thereof enforced by law and sale of the offender's goods and chattels ; and if no goods or chattels can be found whereon such fine as aforesaid can be levied, then, and in such case, it shall be lawful for such Justice or Justices to commit the offender to prison, for any term not exceeding three months, there to be kept at hard labour, as the said Justice or Justices shall so think fit.

XIII. That this Act shall commence and take effect on the first day of June, now next ensuing, and to continue in force for three years.

HEREAS the Act 22 Vic. c. 12, providing for the impounding of cattle running at large, and for other purposes, will expire at the close of the present session, and it is expedient to continue the said Act; May it, &c. :

28 Vic. c. 6. An Act to revive and continue the Act of the 21st year of Her Majesty's Reign, c. 18, for more effectually providing for the Detection and Punishment of Persons cutting Timber, or other wood or bark off of Lands within these Islands, without the licence or authority of the Owners of such Lands, and for other purposes. (Assented to February 24th, 1865.)

HEREAS the Act of the 21st year of Her Majesty's reign, ch. 18, for more effectually providing for the detection and punishment of persons cutting timber, or other wood or bark, off of lands within these Islands without the licence or authority of the owners of such lands, and for other purposes, expired at the close of the last session of Assembly, and it is expedient to revive and continue the same; May it, &c. :

I. That the said recited Act shall be, and the same is hereby revived, and shall be, and the same is hereby continued in force from and after the passing hereof, for and during the term of ten years, and from thence to the end of the then next session of Assembly.

II. All persons who have, since the expiration of the said Act of Assembly, done or performed any act, matter, or thing, under or by virtue of the said Act, as if the same was in force, shall be, and they and each and every of them are hereby indemnified c. 18, expired. from any action or proceeding at law, or other liability whatsoever, in respect of any such act, matter, or thing, by them so done or performed.

28 Vic. c. 21. An Act to continue the Act for affording Protection to the Owners of Cattle depasturing, or which may hereafter be depastured on certain Crown Lands at the Island of Inagua, known as the Prairies. (Assented to March 28th, 1865.)

HEREAS it is expedient to continue the provision hereto- PREAMble. fore made for the punishment of persons defacing or altering

I. That if any person shall erase, deface, obliterate or in any Penalty for alway alter any brand or other mark on any cattle, or put any false tering or oblimark thereon, with a fraudulent or malicious intent, every such terating Cattle offender shall, on conviction thereof before any Justice of the Peace, be liable, in the discretion of the convicting Justice, to be fined in any sum not exceeding 201., and in default of payment to be imprisoned in any lawful prison, with or without hard labour, for any term not exceeding six months, and if any person so convicted shall afterwards be convicted, in manner aforesaid of a like offence, he shall be liable, on every such subsequent conviction to be imprisoned as aforesaid, with or without hard labour, for any term not less than six and not exceeding twelve months.

II. The word "Cattle," as used in the Act, shall comprise the Explanation of several animals mentioned in the 9th sect. 28 Vic. c. 37. "cattle."

PREAMBLE.

MARRIAGES.

29 Vic. c. 37. An Act to remove Doubts as to the Validity of

certain Marriages solemnized by Persons acting as Marriage Officers under the Act of Assembly, 5 Vic. c. 9. (Assented to 11th May, 1866.)

HEREAS in and by the Act of Assembly 5 Vic. c. 9, it is enacted that it shall and may be lawful for the Governor or officer administering the Government of the Colony, for the time being, when and as often as it shall seem expedient and necessary so to do, to appoint by writing, under his hand and seal at arms, one or more fit and proper person or persons to be called the marriage officer, to solemnize marriages within such part or parts of the Colony as the Governor from time to time shall direct; and it shall be lawful for the Governor or Officer administering the Government, for the time being, as aforesaid, at any time and from time to time to revoke and cancel any such appointment or appointments, to alter, vary, enlarge, or contract the district or districts in which any person so appointed shall have power or jurisdiction to celebrate marriages, for any cause which to him shall seem meet; and every such appointment shall specify the part or district within which the person thereby appointed shall have power and jurisdiction to celebrate marriages.

And whereas appointments of marriage officers have not always been made in strict accordance with the provisions of the Act, nor have the districts within which such officers were to act been always defined, and marriages have at times been celebrated by such officers out of the district for which they were appointed to

act, whereby doubts have arisen as to the validity of various 29 Vic. c. 37. marriages had and solemnized by such officers, and it is expedient that such doubts should be removed, and that all marriages solemnized by persons appointed under, although not in strict conformity with, the provisions of the said Act, and which, but for the informalities before referred to, would be good and valid marriages, shall be declared to be good and valid, notwithstanding any informality, as aforesaid; May it, &c. :

I. That every marriage had and solemnized since the date of Legalizes certhe passing of the said Act by a person appointed, by the Governor tain marriages. or officer administering the Government of the Colony for the time being, to act as a marriage officer, whatever the mode of appointing such officer may have been, and wherever within the Colony such marriages may have been celebrated, shall be as good, valid, and effectual as if the person celebrating the same had been appointed a marriage officer with all the formalities required by the said Act, and had celebrated such marriage within the immediate district for which he was appointed to act.

27 Vic. c. 37. An Act to provide for the Purchase of a Public Burial Ground, and for other purposes. (Assented to 21st May, 1864.)

HEREAS, in consequence of the very crowded state of the PREAMBLE. various burial grounds in the Island of New Providence,

it is necessary that immediate provision should be made for the

purchase of land to be used as a burial ground; May it, &c. :

I. That from and after the passing of this Act, it shall be lawful Appointment for the Governor to appoint a Board to be styled "Burial Ground of CommisCommissioners," to continue and have existence for three years, and to consist of not less than five persons; and from time to time as a vacancy, or vacancies in such Board may occur, to appoint another person or other persons to fill such vacancies; and in like manner, at the expiration of the said term of three years, to appoint another Board, and so on, from time to time, at the end of every three years; any three members of which Board shall be a quorum for the transaction of business.
