AN ACT

To amend an act entitled an act to provide for the appointment of trustees for the control of Associated Religious Societies, and to define their powers and duties, passed March 12, 1844.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That a majority of the board of trustees, elected under the provisions of an act to provide for the appointment of trustees for the control of associated religious societies, and to define their power and duties, passed March twelve, one thousand eight hundred and forty-four, shall constitute a quorum for the transaction of business; that so much of the fourth section of said act as conflicts with this act, be, and the same is hereby repealed. That the words, "the second section of," in the third section, and the words, "the second section of," in the second line of the fourth section, and in the fifth line of said fourth section, of the act to which this is an amendment, be, and the same are hereby stricken

out.

AN ACT

To amend the act entitled "An act to amend the act entitled An act for the preservation and repair of the National Road, and for the collection of tolls thereon, passed March 13, 1843,'" passed March 8, 1845.

SEC. 1. Be it enacted by the General Assembly of the State of National Road Ohio, That the National Road shall be placed by the Board to be placed of Public Works, under the superintendence of one resident under one su perintennent. engineer, to be appointed by said Board, who shall hold his office for the term of one year, and shall qualify and give bond before entering on the discharge of his duties, and shall

perform all the duties heretofore performed by two resident engineers upon said road, in the same manner as is provided in the act or acts hereby amended; and such resident engineer shall receive for his services the same compensation paid to other resident engineers in the employment of said Board.

SEC. 2. So much of the act hereby amended as divides act repealed. the National Road into two divisions, and all acts or parts of acts inconsistent with the provisions of this act, be, and the same are hereby repealed.

AN ACT

To regulate the speed of Railroad Locomotives and Cars within the corporate limits of any city, town or village.

SEC. 1. Be it enacted by the General Assembly of the State [of Ohio,] That the common council or corporate authorities of any incorporated city, town or village, in this State, wherever any railroad track is laid into, or through such city, town or village, shall have authority to ordain, enact and enforce an ordinance regulating the speed of all locomotives and railroad cars within such corporate limits; provided, such ordinance shall not require a less rate of speed than four miles per hour; and such corporate authorities may bring suit against any engineer, conductor or railroad company, violating such ordinance, and assess and collect a fine of not less than five dollars nor more than fifty dollars, for each offence, and costs of suit.

SEC. 2. This act shall take effect and be in force from . and after the first day of April next.

AN ACT

To extend the provisions of an act passed February 15, 1844, entitled "an act to amend an act entitled an act for opening and regulating roads and highways," passed March 14, 1831: and also of another act passed January 29th, 1847, entitled "an act to amend an act prescribing the duties of supervisors, and relating to roads and highways," passed March 20, 1837, to the county of Paulding.

SEC. 1. Be it enacted by the General Assembly of the State of
Ohio, That the several provisions of the above entitled acts
be extended to, and remain in full force in the counties of
Paulding, Henry, Fulton and Vanwert.

To amend an act entitled an act prescribing the duty of Supervisors, and relative to roads and highways, passed March 20, 1837.

SEC. 1. Be it enacted by the General Assembly of the State of Ohio, That the residence of a single man, for road purposes, shall be held to be at the place whereat he boards, in any road district in this State.

AN ACT

Further to amend the "act prescribing the duties of Supervisors, and relating to roads and highways," passed March 20th, 1837.

County Com- SEC. 1. Be it enacted by the General Assembly of the State of missioners or Ohio, That if any person, body politic or corporate, shall supervisors obstruct any public road or highway, authorized by any law. of this State, and suffer such obstruction to remain to the hindrance or inconvenience of persons making use of such public road or highway, or shall, by virtue of any authority whatever or otherwise, change the line, fill up, or dig out the bed of any such road or highway, or in any other manner render the same less convenient or useful than it had been previously thereto, such person, body corporate or politic, shall be subject to an action on the case, at the suit of the commissioners of any county, or supervisor in any district, in which such road or highway is situate, in whole or in part.

SEC. 2. SEC. 3. That any suit brought under the provisions of this act, and the act to which this is an amendment, shall be in the official capacity of any such commissioners or supervisors respectively, and not in their individual names; and the same shall not abate by the change of officers, but shall be prosecuted by their successors, the same as if no change had taken place, to final judgment, unless otherwise disposed of.

SEC. 4. That the measure of damages in any suit brought Measure of under the provisions of the first section of this act, shall be damages. a full compensation to the public for the loss of, or injury to such road or highway; and the damages recovered in any such suit, after paying the expenses of the same, shall be a trust fund in the hands of such commissioners or supervisors respectively, to be applied to the repair of such road or highway, or to be expended upon the public roads of such district. or county, as justice or equity may require.

SEC. 5. That all avenues, streets and alleys, in towns and Avenues, cities, which are or may be laid out agreably to law, shall declared pubbe, and the same are hereby declared public highways, for lic highways. every purpose whatever; provided, that the municipal authorities of any incorporated city or town, may make, ordain, and enforce such laws and ordinances concerning the sidewalks of the streets of such city or town, as shall be deemed necessary to prevent such side-walks from being used for the passage of horses, wagons or other carriages, or for hitching or standing horses, or other animals thereon.

SEC. 6. That the tenth section of the act entitled "an act Acts repealed. prescribing the duties of supervisors, and relating to roads and highways," passed March 20th, 1837, and all acts and parts of acts inconsistent herewith, be, and the same are hereby repealed; Provided, that the passage of this act shall not affect any suit pending on the first day of March, 1851, but the same shall be disposed of as if this act had not been passed; but in all causes of action for which suit shall not have been commenced before the said first day of March, the same shall be regulated under the provisions of this act. SEC. 7. This act to take effect and be in force from and after the first day of March, 1851.
