LXXXII. And be it further enacted, That an Allowance or Payment fhall be made for fuch Examination by the Agent or Person de livering fuch Accounts; and the Sum fo paid fhall be charged by the faid Agent or other Perfon in his Account for Diftribution; the said Allowance or Fee to be regulated after the following Proportions: If the Nett Proceeds for Diftribution amount to 2 Guineas.

LXXXIII. And be it further enacted, That, if upon the Examination of any Account as aforefaid fo exhibited, it fhall appear that the full Value of any Prize taken, or Bounty, has not been ftated in the Account made up by the Agent for Diftribution, or if upon fuch Examination any Sum or Sums fhall be difallowed as improperly charged against the Captors, then all further Sums fo appearing to be due to the Captors, and recovered by the Authority. of any competent Court, fhall be confidered as a Part of the Proceeds to be diftributed among the Captors; and if by any Delay in recovering the fame, fuch Sum or Sums cannot be included in the first Distribution, then the faid Sum or Sums fhall be paid to the Treasurer of Greenwich Hofpital or his Deputy, to be distributed to the Captors or their legal Reprefentatives by the Treasurer and Clerk of the Cheque of the faid Hofpital, in like manner and subject to the fame Regulations as far as the fame can be made applicable thereto, as in cafes of Diftribution by the Agents of the Captors.

LXXXIV. And be it further enacted, That an attefted Account fhall be annually rendered to the Treasurer of the Navy and Treafurer of the Royal Hofpital at Greenwich, by fuch Examiner of Prize Accounts of all Sums of Money received as Allowance or Payment for Examination as aforefaid, and that out of the fame fhall be paid all Charges incurred in carrying into Effect the Provifions of this Act with refpect to the examining of Prize Accounts, together with fuch Remuneration for the Examiner of the faid Accounts as fhall by the Treafurer of the Navy be thought reafonable; and whatever Balance fhall remain after fatisfying fuch Charges as aforefaid, the fame fhall be paid to the Treasurer of Greenwich Hofpital.

LXXXV. And be it further enacted, That there fhall be laid annually before both Houfes of Parliament within Fourteen Days after their First Meeting, by the Treasurer of the Navy, an Account of the Charges and Remunerations allowed and paid as aforefaid. Courts of Record in Great Britain, fhall be committed out of this Realm, the fame may be alleged to be committed, and may be laid, enquired of, tried and determined in any County in England, in the fame manner, to all Intents and Purposes, as if the fame had been actually done or committted within the Body of fuch County. LXXXVII. And be it further enacted, That all Penalties and Penalties, &c. Forfeitures imposed by this Act, wherefoever the fame fhall arife or become forfeited, may be recovered by Action of Debt, Bill, Plaint or Information, in any of His Majefty's Courts of Record in Great Britain, or Monition and Attachment thercon, in His Majesty's High Court of Admiralty, unlefs in cafes where any other Mode is by this Act particularly directed; and all Penalties and Forfeitures impofed by this Act, which fhall arife or become forfeited in any Part of His Majefty's Dominions abroad, may be recovered in any Court of Record of His Majefty in the Colony, Territory or Place where the same shall arise or have become forfeited, or in any of His Majesty's Vice Admiralty Courts having Jurifdiction there.

LXXXVIII. And be it further enacted, That in all cafes in Application of which any Agent or Perfon is by this Act made fubject to the For- Penalties. feiture of any Sum of Money equal to any Money remaining in his Hands, or to the Amount of any Balances or Shares, fuch Sum or Sums of Money fhall, on Recovery thereof, go and be applied to the Ufe of the Perfon or Perfons who fhall have been aggrieved by the Mifconduct of fuch Agent or Perfon, and all pecuniary Penalties and Forfeitures by this Act impofed, other than as aforefaid, and other than fuch as are by this A&t directed to be otherwise applied and difpofed of, fhall go and be applied to the Ufe of the Royal Hofpital for Seamen at Greenwich, and fhall be fued for in the Name of the Commiffioners and Governors thereof.

• LXXXIX. And Whereas by a certain Act of Parliament, made 31 G.2. c. 10. and paffed in the Thirty firft Year of the Reign of His late Majefty

King George the Second, intituled An Act for the Encouragement o Seamen employed in the Royal Navy; and for establishing a regular Method for the punctual, frequent and certain Payment of their Wages; and for enabling them more cafily and readily to remit the fame for the Support of their Wives and Families, and preventing Frauds and Abufes attending fuch Payments, after reciting that divers wicked • Practices had been carried on, by perfonating and falfely affuming the Names and Characters of Officers, Seamen and others entitled or supposed to be entitled to Wages, Pay or other Allowances of Money, or Prize Money, for ferving on board of Ships or Veffels of the Royal Navy, and by forging and counterfeiting Letters of Attorney, Bills, Tickets, Aflignments, laft Wills, and other Authorities and Powers from fuch Officers and Seamen, and by falfely taking out Probate of Wills and Letters of Admini⚫ftration to fuch Ŏfficers and Seamen; it is enacted, That, from and after the First Day of November which was in the Year of our Lord One thousand seven hundred and fifty eight, whofoever willingly and knowingly fhould perfonate, or falfely affume the Name or Character of, or procure any other Perfon to perfonate or falfely to affume the Name or Character of any Officer, Seamen or other Perfon entitled, or fuppofed to be entitled, to any Wages, Pay or other 'Allowances of Money, or Prize Money, for Service done on board of any Ship or Veffel of His Majefty, his Heirs or Succeffors, or

the Executor or Administrator, Wife, Relation or Creditor of any fuch Officer or Seaman, or other Perfon, in order to receive any Wages, Pay or other Allowances of Money, or Prize Money, due or fuppofed to be due or payable for or on account of the Services of any fuch Officer or Seaman, or other Perfon as aforefaid; or fhould forge or counterfeit, or procure to be forged or counterfeited, any Letter of Attorney, Bill, Ticket, Certificate, Affignment, laft Will, or any other Power or Authority whatsoever, in order to • receive any fuch Wages, Pay or other Allowance of Money or Prize Money, due or fuppofed to be due, to any fuch Officer or Seaman, or other Perfon as aforefaid, or should willingly and knowingly take a falfe Oath, or procure any other Perfon to take a falfe Oath, to • obtain the Probate of any Will or Wills, or to obtain Letters of • Administration, in order to receive the Payment of any Wages, Pay or other Allowances of Money, or Prize Money, due or that were fuppofed to be due, to any fuch Officer, Seaman or other Person as aforefaid, who had really ferved, or had been fuppofed to have • ferved, on board of any Ship or Veffel of His Majefty, his Heirs or Succeffors, every fuch Person so offending, being lawfully convicted of any fuch Offence or Offences, fhould be deemed guilty of Felony, and fhould fuffer Death as a Felon, without Benefit of Clergy: And Whereas by a certain Act of Parliament, made and paffed in the Ninth Year of the Reign of His prefent Majefty, intituled An A& for repealing fo much of an A&t, paffed in the Tenth Year of Her late Majesty Queen Anne, as relates to the Harbour Moorings of the Royal Navy, and for the more effectual Prefervation of fuch Harbour Moorings; and Punishment of Perfons guilty of stealing or embezzling His Majefly's Naval Stores; or of Forgery or Perjury, in relation to Seamen's Wages, it is, among other things, enacted, • That if any Perfon fhould, from and after the Twenty fourth Day of June, which was in the Year of our Lord One thousand seven • hundred and fixty nine, utter or publish as true, any false, forged or counterfeited Letter of Attorney, Bill, Ticket, Certificate or Affignment, laft Will, or any other Power or Authority whatsoever, in order to receive any Wages, Pay or other Allowances of • Money or Prize Money, due or fuppofed to be due to any Officer or Seaman, or other Perfon who fhould have really ferved, or should have been fuppofed to have ferved, or fhould hereafter ferve, or fhould be fuppofed to have ferved, on board of any Ship or Veffel of His Majefty, his Heirs or Succeffors, with Intent to defraud any Perfon, knowing the fame to be falfe, forged or counterfeited, every fuch Perfon, being thereof lawfully convicted, fhould be deemed guilty of Felony, and fhould fuffer Death as a Felon, without Benefit of Clergy: And Whereas Doubts have arifen, whether the • Punishment inflicted by the faid Two laft recited Acts of Parliament on Perfons guilty of the several Offences therein mentioned, extends to fuch Offences, when committed with an Intention to defraud any Corporation;' Be it therefore enacted, That, from and after the paffing of this Act, whofoever willingly and knowingly fhall perfonate or falfely affume the Name or Character of, or procure other to perfonate or falfely to affume the Name or Character of any Officer, Seaman or other Perfon entitled, or fuppofed to be entitled, to any Wages, Pay or other Allowances of Money, or Prize Money for Service done on board of any Ship or Veffel of His

Majefty, his Heirs or Succeffors, or the Executor or Adminiftrator, Wife, Relation or Creditor, of any fuch Officer or Seaman or other Perfon, in order to receive any Wages, Pay or other Allowances of Money, or Prize Money, due or fuppofed to be due or payable, for or on account of the Services of any fuch Officer or Seaman, or other Perfon as aforefaid, or fhall forge or counterfeit, or procure to be forged or counterfeited, any Letter of Attorney, Bill, Ticket, Certificate, Order, Affignment, laft Will, or any other Power or Authority whatsoever, in order to receive any fuch Wages, Pay or other Allowances of Money, or Prize Money, which fhall be due or fuppofed to be due, to any fuch Officer or Seaman, or other Perfon as aforefaid, or fhall willingly and knowingly take a falfe Oath, or procure any other Perfon to take a falfe Oath, to obtain the Probate of any Will or Wills, or to obtain Letters of Adminiftration, in order to receive the Payment of any Wages, Pay or other Allowances of Money or Prize Money, which fhall be due, or be fuppofed to be due to any fuch Officer, Seaman, or other Perfon as aforefaid, who fhall have really ferved, or fhall be fuppofed to have served on board of any Ship or Veffel of His Majefty, his Heirs or Succeffors; or if any Perfon fhall, from and after the paffing of this Act, utter or publifh as true any falfe, forged or counterfeited Letter of Attorney, Bill, Ticket, Certificate, Örder or Afignment, laft Will, or any other Power or Authority whatsoever, in order to receive any Wages, Pay or other Allowances of Money, or Prize Money, due or fuppofed to be due to any Officer or, Seaman, or other Person who fhall have really ferved, or fhall be fuppofed to have ferved, or fhall hereafter ferve, or be fupposed to have served on board of any Ship or Veffel of His Majefty, his Heirs or Suc ceffors, with Intent to defraud any Corporation whatsoever, knowing the fame to be falfe, forged or counterfeited, every fuch Perfon, being thereof lawfully convicted, fhall be deemed guilty of Felony, and fhall fuffer Death as a Felon, without Benefit of Clergy.

XC. Provided always, and be it further enacted, That no Action Limitation of fhall be brought against any Perfon or Perfons whomfoever, for any Actions. Matter or Thing whatsoever, done or committed under or by virtue or in the Execution of this Act, unless such Action fhall be brought within Three Years next after doing or committing of fuch Matter or Thing, fave as to Matters or Things arifing out of Captures in any former War: Provided alfo, that if any Action or Suit fhall be hereafter commenced or profecuted against any Perfon or Perfons for any Matter or Thing done under or by virtue or in the Execution of this Act, fuch Perfon or Perfons may plead the General General Iffue. Iffue, and give this Act and the Special Matter in Evidence; and if the Plaintiff or Plaintiffs fhall become nonfuited, or fuffer Difcontinuance, or forbear further Profecution, or if Judgment fhall be given for the Defendant or Defendants, fuch Defendant or Defendants fhall recover Treble Cofts, for which he, fhe or they shall have Treble Cofts. the like Remedy as where Cofts by Law are given to Defendants.
