"There are now two general treatises on this extensive and intricate
much to say, that they excel all the text-books of the day in the com-
bination of learning and research with clear method and scientific pre-
cision. Mr. Phillipps's work, however, labours under this disadvantage,
that it is confined to an examination of the general principles of evi-
dence, and does not treat of the rules applicable to particular subjects
and actions, otherwise than as they illustrate those general principles.
Mr. Starkie, on the other hand, reserving the first part of his work
chiefly for the discussion of general principles, devotes two closely
printed volumes to a digest, alphabetically arranged, of the rules of
evidence and the proof applicable to particular subjects and actions. It
is in this that the great practical superiority and utility of Mr. Starkie's

There is the often-noticed subject of the examination upon the removal of a pauper, (though that can scarcely be correctly called a transaction between individuals), the law upon which has at last been brought to such a state, that nothing short of its total repeal can afford an adequate remedy for the evil it causes. But we refrain, and will proceed at once to the subject we have mainly in view, and, as introductory to which, we have been somewhat uncon

THEY who are acquainted with the laws of this country cannot have failed to observe what fruitful sources of litigation legislative provisions have been, which require persons to observe particular forms in doing certain acts. We speak of our own laws, because with them our readers are familiar; and to allude to the laws of other countries, would require more explanation than our space allows. To take, then, an in-sciously led to make the foregoing remarks; it is the stance near at home. No doubt, Lord Hale, if the opinion which attributes to him the framing of the Statute of Frauds be correct, and Lord Nottingham, if it be true that it originated with him, and Lord Keeper Guildford, who is also said to have had a great share in the penning of it, when they procured that celebrated statute to be passed, thought it a measure excellently calculated to prevent fraud, and to protect honest men. And yet, if our memory serves us aright, it has been said by more than one judge, (and if it had not, we need not hesitate to say it), that it is a question, whether the statute has not been the cause of more frauds than it was ever intended to prevent. It is unnecessary to quote particular instances. We will but allude to the cases respecting guarantees from the time of Wain v. Warlters to the present; and who can doubt, that, in most, if not all, of those cases, the statute was made use of to evade the performance of a just obligation? And this, we fear, must ever be the case. Fraud is too powerful to be restrained within any bounds that the law can set to it. Before the statute the danger was, that a person might be obliged to perform a contract which he had never made; since, it has been, that he may escape from performing one which he has made. The quantity of fraud is the same; it has only been made to change sides. We might mention other instances, illustrative of the effect of requiring the observance of certain forms in transVOL. VIII.

law respecting the attestation of warrants of attorney and cognovits. This, as our readers well know, has, within a few years, been declared by statute; but we shall, nevertheless, examine what it was previously, because we have found, that a rule of law is both better understood and better remembered when it is traced from its origin, and its various changes are noted. Formerly the law was, that a warrant of attorney need not be by deed, and did not require an attesting witness. (5 Taunt. 264). To this an exception had been made in 15 Car. 2, by a rule of the Courts of Queen's Bench and Common Pleas, that, where the defendant was in custody by arrest, "No bailiff or sheriff's officer shall presume to exact or take from him any warrant to acknowledge a judgment, but in the presence of an attorney for the defendant, who shall subscribe his name thereto." It having been deemed sufficient, upon this rule, for the plaintiff's attorney to be present and subscribe the warrant as attorney for the defendant, another rule was made in the Queen's Bench, (4 Geo. 2), that "No warrant of attorney executed by any person in custody of a sheriff or other officer, for the confessing of judgment, shall be valid or of any force, unless there be present some attorney on the behalf of such person in custody, to be expressly named by him, and attending at his request, to inform him of the nature and effect of such warrant of attorney, before the same is executed;
