Reports of Cases Determined in the Supreme Court of the Territory of Utah

Judge Henry Perry Henderson

The Hon. Henry Perry Henderson formerly a Justice of the Supreme Court of Utah and later an honored and distinguished member of the bar of the state, died in Salt Lake City on the third day of June, 1909. The State Bar Association appointed a committee consisting Hon. P. L. Williams, Hon. C. S. Varian, and Hon. E. B. Critchlow, to prepare appropriate resolutions and present the same to the Supreme Court of Utah. On the twenty-fourth day of June, 1909, the Supreme Court met in special session for the purpose of receiving the committee, and the following resolutions were presented:

"Whereas, Henry Perry Henderson, lately a member of the State Bar Association of Utah, has been called by death from a life of great honor and usefulness in this community; and

Whereas, The said Bar Association would perpetuate in an enduring record a just estimate of his life and character;

Therefore be it Resolved, That his judicial services, extending through a period of four years, under peculiar and exacting conditions, were of significant and lasting value to the profession and the people; and

Resolved, That in his professional life he was constant in his endeavor to maintain that standard of ethics which regards law as a minister of justice, and never regards as success results achieved through unprofessional or unworthy means; and

Resolved, That as a lawyer he enjoyed the fullest confidence of the people and his brethren, who mourn his death as a personal grief, and that in the larger field of citizenship, in his daily intercourse with his fellows, he made a strong and lasting impression. His convictions of private and public duty were formed along the lines of right thinking, and during his life his influence was given to the support of law and morality, and for the uplift of society, and

Resolved, That these resolutions be presented to the Supreme Court of the State of Utah for permanent record, and that a copy thereof be transmitted to the widow."

Hon. P. L. Williams, Hon. C. S. Zane, and Hon. A. R. Heywood addressed the court each speaking of the worthy life and high character of the deceased.

The court accepted and adopted the said resolutions and ordered that they be spread upon the minutes of the court, that a copy of the same be transmitted to the family of the deceased, and that they be published in volume thirty-five of the Utah Reports.

Chief Justice D. N. Straup on behalf of the court in adopting the resolutions, spoke in a eulogistic manner of the life and works of the deceased, paying high tribute to him as a lawyer, a citizen, and a man.

The court thereupon adjourned.
