An Act

Making further appropriation for the payment of damages on the Canals and Railroads.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the sum of twenty thousand dollars be, and the same is hereby appropriated for the payment of damages on the lines of canal and railroad, in cases which have been, or may hereafter be decided under the authority of law, and that the said sum be paid out of any money in the Treasury not otherwise appropriated.

An Act

To authorize the printing and distribution of the Pamphlet Laws in the German language.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the Secretary of the Commonwealth is hereby authorized and required to contract, (annually,) for the printing and delivery in the German language, of a number of copies of the laws of the present and future sessions of the legislature, sufficient to supply such persons as now are, or hereafter may be by law entitled to receive the copies of the laws in the English language, and who may signify their desire to have the same, by entering their names in a book, to be kept for that purpose, with the treasurer of the proper county, on or before the second Saturday in March, A. D., one thousand eight hundred and thirty-seven, and on or before the second Saturday in December annually hereafter: Provided, That the price of paper and printing shall not exceed two cents per sheet, including translation, for each copy, and that the price of folding, stitching, covering and delivering, shall not exceed four cents a copy: And provided further, That the expenses to be incurred by the provisions of this act, shall be paid on warrant, to be drawn by the Governor, on the State Treasurer, in the usual manner.

SECTION 2. The laws published in pursuance of the foregoing section, to be distributed, delivered and accounted for in the manner prescribed by the resolutions of the second of March, one thousand eight hundred and twenty-seven, and the tenth of April, one thousand eight hundred and thirtyfive; and the Secretary of the Commonwealth is hereby required to have printed and bound, as aforesaid, five hundred copies of the pamphlet laws of the present session, in the German language, to provide the same for subscription, in anticipation thereof.

An Act

For the relief of William Ruff, late a Commissioner of the county of Philadelphia.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the commissioners of the county of Philadelphia be, and they are hereby empowered to draw their warrant on the treasurer of said county, in favor of William Ruff, late a commissioner of said county, for the amount of his daily pay from the nineteenth of October, eighteen hundred and thirty-five, to the thirty-first of December of the same

year.

An Act

For the relief of Peter Hammer and others, soldiers and widows of soldiers of the revolutionary war.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That the State Treasurer is hereby authorized and required to pay to Peter Hammer of Fayette county, John Foust of Columbia county, Mary Brookhouser of Crawford county, Elizabeth Ludwick of Philadelphia county, soldiers and widows of soldiers of the revolutionary war, or

SECTION 2. The State Treasurer be, and he is hereby authorized and required to pay to Conrad Herbst of Berks County, Benjamin Lesher of Armstrong county, Hannah Hetrich of Crawford county, a gratuity of forty dollars to each immediately, in full for their revolutionary services.

SECTION 3. The State Treasurer be, and he is hereby authorized and required to pay to Thomas Deeds of Montgomery county, a gratuity of forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on the first day of January, one thousand eight hundred and thirty-seven; the foregoing pensions and gratuities to be paid in conformity to the existing laws.

WHEREAS, By an act of assembly, passed the sixteenth day of June, one thousand eight hundred and thirty-six, entitled "An act for the relief of James Richy, and other soldiers and widows of soldiers of the revolutionary war, a pension was granted to Evan Russel of Centre county, but owing to an error having been committed in affixing Chester county to the name of said Russel, instead of Centre, he has been deprived of the relief intended by the passage of the above recited act; Therefore,

SECTION 4. The State Treasurer is hereby authorized and required to pay to Evan Russel of Centre county, or to his order, the gratuity and annuity provided for in said act, agreeably to the provisions thereof.

WH HEREAS, By an act of assembly, passed the fifteenth day of June, one thousand eight hundred and thirty-six, entitled "An act for the relief of Joseph Barrett and others, soldiers and widows of soldiers of the revolutionary war," a gratuity and annuity was granted to Joseph Burkher of Fayette county, which, upon examination of the petition in said case, proves to be a mistake, in consequence of which mistake, George Burkher, the petitioner, has been deprived of receiving that aid from the state intended by the passage of said act of relief; Therefore,

SECTION 5. The State Treasurer is hereby authorized to pay to George Burkher of Fayette county, or to his order, the said gratuity and annuity, in conformity to the act aforesaid, in the same way as though no mistake had been made in the manner aforesaid.

An Act

To authorize the Appraisers of Damages on the Pennsylvania Canal, "to settle and adjust the claim of damages of Jacob Hill and Company.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania, in General Assembly met, and it is hereby enacted by the authority of the same, That it shall be the duty of the Appraisers of damages on the Pennsylvania canal, to ascertain if any damage was done to and sustained by Jacob Hill, Eli Hill, and Levi Hill, co-partners in trade, under the firm of Jacob Hill and Company, in the carrying away and destruction of their salt on the river Kiskiminetas, below the Leechburg dam, by the freshet in the month of February, one thousand eight hundred and thirty-two, and if upon full investigation and inquiry, they shall be of opinion any damage was sustained, and that said loss was caused by the construction or the breaking of the dams in the said river, without default or negligence on the part of the owners, and that the commonwealth ought to be responsible for the same, then to report the amount of damages they shall find the said Jacob Hill and Company shall be entitled to, taking into consideration the advantage of the canal and public improvements on said river to the property of the said Jacob Hill and Company, which sum so reported, shall be paid out of the damage fund, as in other cases of damages sustained by reason of the construction of the Pennsylvania canal, and that the said Appraisers shall in this case have power to issue subpoenas to witnesses, and if necessary, to award attachments to compel their attendance.
