SEC. 3. The first meeting of the electors of said village, for the ding meet purpose of electing officers for said village, shall be on the second Monday of April, 1847, at such place in said village as shall be directed by the justice of the peace of the town of Fayette, residing within or nearest to the boundaries of said village; a notice of which place shall be given by such justice, by posting up written notices thereof in three public places within the boundaries of said village, at least ten days prior to the second Monday of April; which justice, in connection with three such other persons, qualified electors of said village, as he shall select, shall constitute the board of inspectors for such first election, each of whom, before entering upon such duties shall have administered to him by one of such inspectors, the oath prescribed for inspectors in cases of township elections, the said justice acting as the moderator.

SEC. 4. SEC. 10. The president and trustees of said village shall be a body corporate and politic, with perpetnal succession, to be known body corpoand designated by the name and title of the "president and trustees of the village of Hillsdale," and by that name they and their successors shall be known in law, and shall be, and are hereby made capable of suing and being sued, of pleading and being impleaded, of answering and being answered, and of defending and being defended, in all the courts of this state, and may have a common seal, and may alter and change the same at pleasure, and by the same name shall be, and are hereby made capable of holding, of any real or personal estate, for the use of said corporation.

SEC. 11. The inhabitants of said village shall be liable to the operation of any and all laws relating to township government, except so far as relates to the laying out and construction of streets and highways.

The president and trustees shall have full power and authority to make by-laws and ordinances relative to the duties, powets and fees of the marshal, street commissioners, treasurer, clerk and assessors; relative to the time and manner of working upon the streets, lanes and alleys of said village; relative to the manner of assessing, levying and collecting all highway and other taxes in said village, and applying the same, as well as the amount of taxes to be raised: Provided, That there shall not be raised in any one year,

And the said president and trustees shall have power to make by-laws and ordinances relative to all nuisances within the limits of said village, to construct drains, sewers and reservoirs, to license all showmen, and regulate the number. To make such regulations respecting fires, and for protecting the village from damage by fire as they shall deem proper and exped ent; relative to the calling of meetings of the electors of said village; relative to the restraining swine horses and other animals from running at large in said village; to suppress gaming tables kept for hire, gain or reward in said village; for preventing and suppressing all gambling, disorderly and bad houses, for the suppression of riots, for the apprehens on and punishment of all gamblers, vagrants, drunkards and idle persons; to prevent encumbering of the streets, alleys and public grounds; and they shall have power to make such other laws and ordinances, for the safety and good government of said village, as shall be necessary to carry into effect all the powers and authority reposed in them, as to them shall seem necessary, and to impose all fines, penalties and forfeitures, on all persons offending against the by-laws and ordinances made as aforesaid: Provided, always, such bylaws and ordinances shall not be repugnant to the constitution and laws of the United States, [or the state of Michigan.]

SEC. 16. In all prosecutions and other proceedings wherein said village shall be a party, no citizen shall be considered an incompetent witness or juror, by reason of his being such citizen.

SEC. 17. Whenever any action shall be commenced against said Process. corporation, process shall be served by leaving a copy of such process, attested, with the clerk of said corporation, or at his usual place of abode, whose business it shall be forthwith to inform the president thereof.

SEC. 18. The president and trustees shall have power to levy and collect a capitation or poll tax, (not exceeding one day's labor president & on the highways or streets,) of every male inhabitant of said village over twenty-one years of age, except paupers, lunatics and persons of color; and also such taxes on real and personal property, within the limits of said village, as may be necessary to defray the expenses thereof, and make such improvements as they shall deem necessary: Provided, That the amount raised in any one year, exclusive of the poll tax, shall not exceed the sum of three hundred dollars; and all such taxes so levied upon the real and personal property aforesaid, shall be graduated according to the assessment roll of the assessor, to be made out as the by-laws and ordinances of the president and trustees shall direct.

SEC. 19. The taxes assessed upon the real estate in said village, May sell shall be and remain a lien upon the property on which it is so as- taxes. sessed from the time of filing the assessment roll of the assessors in the clerk's office, until the same shall be paid; and the said president and trustees shall provide by their by-laws for the sale of any real or personal estate, for the collection of any tax assessed thereon, the notice to be given, the time, place and manner of such sale, and by whom it shall be made; and in case of sale and non-redemption, they shall by such by-laws provide by whom deeds of conveyance for the same shall be made and executed: Provided, That no sale of real estate shall be made under the authority of this act, or under the provisions of any such by-laws, unless the person authorized to sell the same shall give written notice of the time and place of said sale, with a particular description of each lot or parcel of land to be sold, by posting up such notices, signed by himself, in five or more public places in said village for at least thirty days before such sale, and by advertising the same in the manner, as nearly as may be, as is or may be required by law, in cases of sales of lands delinquent for township, county and state taxes: And

provided also, That any tax so levied may be paid at any time before a sale of property, and any land be redeemed after sale, at any time within one year from the time of making such sale, by any person claiming an interest therein, by paying to the treasurer of the village the amount of the tax so assessed thereon, (in case of payment before sale,) and in case of redemption after sale, the amount for which the land was bid off, with all costs and expenses and interest thereon.

Sec. 20 The deeds, which under the provisions of this act and sidered valid the by-laws made pursuant thereto, shall be made and executed to the purchaser of real estate so sold, and shall when legally given vest in them, their heirs and assigns for ever respectively, a valid title, fee simple, subject to any claim the state may have thereon; and such deed shall be prima facie evidence of the regularity of such sale, and of all proceedings prior thereto in relation to such tax; and any such deed executed by the person authorized as aforesaid, to make and execute the same, under his hand and seal, and proved or acknowledged as other deeds are directed by law to be, may be recorded in the office of the register of deeds of Hillsdale county, and the record thereof given in evidence as in other cases.

SEC. 21. The assessors shall proceed in making the assessments and giving notice thereof, in the manner the by-laws of the common council shall direct: Provided, That any person feeling aggrieved by the final decision of the assessors, may have the privilege to appeal to the president and trustees at any time within five days thereafter, who are invested with the power to do in the premises as they shall think just and right.

SEC. 22. It shall be the duty of the president and trustees to sident and make out a duplicate of taxes, charging each individual therein, an amount of tax in proportion to the amount of real and personal property assessed to him within said village; and also charging all lands in said village owned by non-residents with the rateable amount of tax, which duplicate shall be signed by the president and clerk, and delivered to the marshal, whose duty it shall be to collect the same within such time and in such manner as the bylaws shall direct.

SEC. 23. The president and trustees shall have power to appoint
