Sureties, the said Treasurer for the time being is hereby required, from time to time, to enter into a similar Recognizance with another good and sufficient Surety in the place and stead of the Surety so dying or becoming in insolvent circumstances, so that there may always exist a Recognizance with Two or more good and sufficient Sureties as aforesaid.

days excepted) from the lour of Nine o'clock in the Forenoon until Four o'Olock in the Afternoon.

Two Constables or LXV. For the purpose of assisting the Treasurer in carrying armoires to assist out the provisions of this Act, Be it Enacted, That the Officer the Treasurer at a Administering the Government shall have power and authority to

appoint any One or Two Constables of the Island, or any One or Two other persons to attend at the Treasury to perform under and subject to the directions of the Treasurer all duties which are required to be performed by Virtue of this Act; and it shall be lawful for the Officer Administering the Government to pay to every such Constable or other person so employed a sum not exceeding Twenty Pounds per annum in Quarterly payments, and every person employed under and by Virtue of the Authority herein, shall have and be entitled to all the protection and privilege of Treasury Officers.

LXVI. And be it enacted, That as to the interpretation of Terms used in this Act and for the purposes of this Act, the Term Master shall mean the person having or taking the charge or command of any Ship, Vessel, Boat, or Canoe ; whenever in this Act any Term importing the Singular Number occurs, the Plural Number shall be deemed included and intended, or where any Terms importing the Plural Number the Singular Number shall be deemed included, and where any Term shall be used which signifies the Male Gender the Female Gender shall be considered and taken to be included; and that where one matter or subject may be treated of, two or more subjects may be considered included : Provided that it shall be necessary to put such a construction in order to render the sense more clear, or to give more full and complete effect to any of the provisions of this Act, and there be nothing inconsistent or repugnant to the subject matter in the context or otherwise.

An Act for facilitating the Administration of
Justice in the Court of Chancery.

T H EREAS it would greatly contribute to the diminishing

VV of expense, and delay in suits in the Court of chancery, if the process pleadings and course of proceeding therein were in some respects altered, but this cannot be conveniently done otherwise than by rules or orders of the Judge of the said Court, from time to time, to be made, and doubts may arise as to the power of the said Judge to make such alterations as may be expedient witi out the authority of an Act of the Legislature of this Colony: Be it therefore enacted by the Officer Administering the Government of Montserrat, and the Council and Assembly of the same, and it is hereby enacted as follows :

I. It shall be lawful for the Vice Chancellor from time to Vice Chancellor to time to make such alterations as may seem expedient in the forms and mode of form of Writs and Commissions, and the mode of sealing, issu- proceeding. ing, executing, and returning the same, and also in the form of, and mode of filing bills, answers, depositions, affidavits, and other proceedings, and in the form and mode of obtaining discovery by answer in writing or otherwise, and in the form and mode of pleading, and in the form and mode of taking, or obtaining evidence, and generally in the form and mode of proceeding to obtain relief, and in the general practice of the Court with relation to each, and also in the form and mode of proceeding before the Master, and in the form and mode of drawing up, entering and enrolling orders and decrees, and of making and delivering copies of pleading, and other proceedings, and to make such regulations as to the allowance, taxation, and payment of Costs, and for altering, superintending, controuling, and regulating the business of the several offices of the Court, and otherwise for carrying into effect the said alterations as to him may seem meet.

II. All such rules, orders and regulations to be made under Rules when con

firmed by Chancelthis Act, shall before the same, shall take effect, be confirmed by lor to take effect as the Chancellor of this Island, and when so confirmed, shall for all general purposes be deemed and taken to be general rules, and orders of the Court of Chancery of Montserrat.
