There shall be allowed to the successful party if he is represented by a licensed attorney and taxed as costs in all actions in which no jury is empaneled and where the amount in controversy exclusive of interest and

costs amounts to fifty dollars, the same attorney fee as allowed in quarterly courts.

CHAPTER 122,

AN ACT to regulate the running of motor vehicles upon the public highways of this State, and fixing a penalty for the violation thereof.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That no person shall operate a motor vehicle Rate limited to on a public highway at a rate of speed greater than is reasonable and proper at the time and place having regard to the traffic and use of the highway and its condition, or so as to endanger the life or limb of any person, or in any event at a greater rate than 15 miles an hour, subject, however, to the other provisions of this section.

§ 2. Upon approaching a crossing of intersecting Rate limited to 6 public highways, or a bridge, or a sharp curve, or a steep descent, and also in traversing such crossing, bridge, curve or descent, a person operating a motor vehicle shall have it under control, and operate it at a rate of speed no greater than six miles an hour, and in no event greater than is reasonable and proper, having regard to the traffic then on such highway and the safety of the public.

3. Upon approaching a person walking in the roadway of a public highway, or a horse or other draft animals, being ridden or driven thereon, a person operating a motor vehicle shall give warning of its ap

proach by signaling with a horn, bell or other device not calculated to frighten such animal, and use every reasonable precaution to insure the safety of such person or animal, and, in the case of horses or other draft animals, to prevent frightening the same, and at once reduce the speed at, which such vehicle is being operated and hold same under control, and if such horses or other draft animals appear frightened, to not more than one-half the speed permitted by section two, and bring same to a stop if apparently necessary for the safety of such person or animal, having due regard to safety of passengers in such motor vehicles.

§ 4. A person operating a motor vehicle shall, at request or on signal by putting up the hand, from a person riding or driving a restive horse or horses, or other draft animals, bring such motor vehicle immediately to a stop if necessary, having due regard for safety of persons, vehicles and animals, and if traveling in the opposite direction, remain stationary so long as may be reasonable to allow such horse or animals to pass, and if traveling in the same direction, use reasonable caution in thereafter passing such horse or animal: Provided, That in case such horse or animal appears badly frightened or he is requested so to do, the person operating such motor vehicle shall, if apparently safer, cause the motor of such vehicle to cease running so long as shall be reasonably necessary to prevent accident and insure the safety of persons, vehicles and animals.

§ 5. Whenever a person operating a motor vehicle shall meet on a public highway any other person riding or driving a horse or horses or other draft animals, or any other vehicle, the person so operating such motor vehicle shall reasonably turn the same to the right of
