INTERCOURSE WITH FOREIGN NATIONS.

During the past year, several events of importance have occurred in the intercourse between the United States and Foreign Nations, among which may be classed the establishment of a mission to Naples which has eventuated in a Treaty of Indemnity for spoliations under Murat; the conclusion of a Treaty of Amity, Commerce, and Navigation, with Chile; the death of Mr. Shannon our Charge d'Affaires to Guatemala, who fell a victim to the climate of that country, on his way to his post; the return of Mr. Baylies, Charge d'Affaires to Buenos Ayres, alter having unsuccessfully attempted to secure our right to the Fisheries on the Banks of the Falklands; the recognition and reception of a Minister from Belgium, and the institution of a mission from this country, there. The changes which have taken place in the foreign missions of the United States, are the return of Mr Van Burco, late Envoy Extraordinary and Minister Plenipotentiary to Great Britain, and of Mr Rives, who held an appointment of the same rank to France. The place of the former has been supplied by the appointment of Col. Aaron Vail, Charge d'Affaires: that of the latter remains vacaut.

The pay of Ministers Plenipotentiary is 9000 dollars per annum sajary, besides 9000 dollars for an outfit. Secretaries of Legation receive 2000 dollars, and Charge d'Affaires, 4500 dollars per annum. To en title any harge d'Affaires, or Secretary of any Legation or Embassy to any foreign country, or Secretary of any Minister Plenipotentiary, to the above compensation, they must. respectively, be appointed by the President of the United States, by and with the advice and consent of the Senate; but in the recess of the Senate, the President is authorized to make such appointments, which must be submitted to the Senate at the next Session thereafter, for their advice and consent: and no compensation is allowed to any Charge d'Affaires, or any Secretary of Legation, Embassy, or Minister, who shall not be so appointed.

Consuls to Barbary are more of Diplomatic than Commercial Agents, not only as it regards their vocation, but also as it respects their compen-[ satron They receive regular anual salaries; and their pay does not in the least depend on fees of any kind. Ard no onsul of the United States, residing on the Barbary coast, can own, in whole or in pari, any ship or vessel, or be concerned, directly or indirectly, in the exportation from, or importation or into, any of the states on the coast of Barbary, of any goods, wares, or merchandise, under the penalty, upon conviction, for every offence of a sum uot exceeding one thousand dollars.

Consuls of the United States, generally so called, are, in effect, Agents for Commerce and Seamen; which later denomination, for particular reasons, is given to some of this class, of Public Officers. They receive no yearly salaries, (except at Paris and London, where they have an an nual salary of $2000,) and their compensation is derived from the fees which are allowed by law. The amount of these fees depends, of course, upon the state of foreign trade, which is perpetually fluctuating. Consuls of the United States, for commercial purposes, are regularly admitted and recognised, as to their official functions, in the ports of Europe; but in the colonies of the European nations agents for Com

merce and Seaman mostly exercise the duties of their stations under courtesy, without any formal recognition, and, in some instances, from the jealousy of colonial policy, they have not been permitted to exercise them at all. In their public capacity, Consuls and Agents for Commerce and Seamen, are principally occupied in verifying, in different forms, the legality of the trade of the United States with foreign nations, and in relieving and sending home American Seamen, who by accident or misfortune, are left destitute within the jurisdiction of their several consulates or agencies.

PRIVILEGES OF FOREIGN MINISTERS IN THE UNITED STATES.

During the past year, besides the reception by the United States, of Paron de Behr, as Minister Resident from Belgium, the following changes have taken place in the Foreign Missions to this country:-Chevalier An kailoo, Chargé d'Affaires from Sweden, in place of Baron Stackelberg; Don J. M. Tornell, E. E and M. P from Mexico, has returned home, and left Don Jose Montoya, Chargé d'Affaires; and M. Domingo Acosta, has been recognised as Chargé d'Affaires from Colombia, in addition to his previous appointment as Consul General.

By the art of 30th April, 1790, it is provided that if any writ or process shall at any time be sued forth or prosecuted by any person or persons, in any of the courts of th United States, or in any courts of a particular State, or by any judge or justice therein, respectively, whereby the person of any ambassador, or other public minister of any foreign prince or State, authorized and received as such by the President of the United States, or inv domestic, or domestic servant, of any such ambas sacor or other public minister, may be arrested or imprisoned, or his or their goods or chattels be distrained, seize i, or attached, such writ or proress shall b deemed and judged as utterly null and void, to all intents, constructions, and purposes, whetsoever.

In case any person or persons shall sue forth or prosecute any such writ or process, such person or persons, and all attorneys or solicitors prosecuting or soliciting in such case, and all officers executing any such writ or process, being thereof convicted, shall be deemed violators of the laws of nations and disturbers of the public repose, and imprisoned not exceeding three years, and fined at the discretion of the court. But no cuizen or inhabitant of the United States, who shall have contracted debts prior to his entering into the service of any ambassador or other public minister, which debts shall be still due and unpaid, shall have, take, or receive, any benefit of this act; nor shall any person be proceeded against by virtue of this act, for having arrested or sued any other domestic servant of any ambassador or other public minister, unless the name of such servant be first registered in the office of the Secretary of State, and by such Secretary transmitted to the Marshal of the District of Columbia, who shall, upon receipt thereof, affix the same in some public place in his office, whereto all persons may resort and take copies without fee or reward.

If any person shall violate any safe conduct or passport duly obtained, and issued under the authority of the United States, or shall assault, strike, wound, imprison, or in any other mauner infract the law of nations, by offering violence to the person of an ambassador or other public minister, such person so offending, on conviction, shall be imprisoned not exceeding three years, and fined at the discretion of the court.
