Provided always, and it is hereby expressly Declared and Enacted, That nothing in this Act contained shall be construed to restrain, diminish 10 or in any way affect (except so far as herein is expressly mentioned) any franchise, liberty, right, power, privilege or authority before or at the time of the passing of this Act held possessed or enjoyed by The QUEEN's most Excellent MAJESTY, or Her predecessors, or by any of Her Bailiffs or other officers, over, in or in respect of the said Honor 15 of Pontefract.

Provided also, and be it Enacted, That nothing in this Act contained shall be construed to repeal, alter or in any way affect (except so far as herein is expressly mentioned) the said Act of the third of the reign of Her present Majesty, or any power given in the said 20 Act of committing from the said Court Baron to any Common Gaol other than Rothwell Gaol, or in any way to affect the validity of the commitment, custody or imprisonment of any person or persons committed to or in custody in Rothwell Gaol before the said First day of February which will be in the year One thousand eight hundred and 25 Forty-six.

And be it Enacted, That this Act may be amended or repealed by during present any Act to be passed in this Session of Parliament.

And be it Enacted, That this Act shall be and be deemed and taken to be a Public Act, and shall be judicially taken notice of as such by all Judges and others.

For the Preservation of Salmon Fisheries in
England and Wales.

HEREAS provision has been made in various Acts of Parliament for preventing the destruction of Salmon and Fish of the Salmon kind in several lakes, rivers and streams in England and Wales, and in estuaries and arms of the sea near the mouths of the said rivers, at certain periods in the year; and such periods vary in the said several lakes, rivers, streams, estuaries and arms of the sea; and in some of the said Acts power is given to the Justices of the Peace acting for the several counties in England and Wales, at their several Quarter Sessions of the Peace, to fix certain 10 days, not exceeding One hundred and fifty Days in each year, for each river within their respective counties, to be fence days for the several rivers respectively as therein mentioned:

And whereas, in consequence of such variation, and of the said Justices not having been called upon to exercise such powers in some 15 of the counties in England and Wales, and of the said Justices, in the exercise of such aforesaid powers, having fixed different days in the year in counties adjoining each other, the Laws for the before-mentioned purpose are rendered ineffective; and therefore it is expedient that one period or fence time common to all the lakes, rivers, streams 20 and waters, and to estuaries and arms of the sea near to the mouths of the said rivers, and on any part of the sea-coast of England and Wales, should be fixed by authority of Parliament;

And whereas it is expedient to repeal the several Laws now in force in England and Wales for preventing the destruction of Salmon and Fish of the Salmon kind during such periods or fence days, and that for such purpose all enactments now in force relating thereto should be repealed;

BE it therefore Enacted, by The QUEEN's most Excellent MAJESTY, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, THAT from and after the passing of this Act, all Acts or parts of Acts now in force, so far as they or any of them relate to the fixing or varying such periods or fence days, and to the preventing the destruction of Salmon and Fish of the Salmon kind in the said lakes, rivers, streams, waters, estuaries and arms of the sea, and on the sea-coast, within such periods or fence days, and all Acts or parts of Acts continuing or perpetuating the 15 same or any part thereof, so far only as relates to such continuation or perpetuation, and all enactments whatsoever now in force relating thereto, or which are inconsistent with and contrary to the provisions of this Act, shall be and are hereby repealed and annulled accordingly, save and except so far as the said Acts or parts of Acts, or either of 20 them, repeal the whole or any part of any former Act or Acts, and also save and except as to any offences, penalties or matters committed, incurred or done, or which may be committed, incurred or done, against the provisions of the said Acts, or any of them, before the passing of this Act; all which offences shall be dealt with, considered 25 and punished, and all such penalties levied, and all such matters deemed good, valid and effectual, to all intents and purposes, as if this Act had not been passed: Provided also, That nothing herein contained shall extend or be construed to extend to interfere with the weekly or daily periods of fishing, which may be regulated by any or 30 either of the said Acts or parts of Acts.

AND whereas it is expedient to consolidate and amend the other laws now in force in England and Wales for preventing the destruction of Salmon and Fish of the Salmon kind in the said several lakes, rivers, streams, waters, estuaries and arms of the sea and 35 on the sea-coast, and for regulating the Fisheries therein, and that for such purpose some of the enactments now in force relating thereto should be repealed; BE it therefore Enacted, That from and after the passing of this Act, the several Acts hereinafter mentioned shall be and the same are hereby repealed accordingly, save and 40 except so far as the said Acts or either of them repeal the whole or any part of any former Act or Acts; (that is to say) an Act passed in the fifty-eighth year of the reign of King GEORGE the Third, intituled, "An Act for preventing the Destruction of the Breed of
