Art. 18. Every non-commiffioned officer and foldier fhail retire to his quarters, or tent, at the beating of the retreat; in default of which, he fhall be punished according to the nature of his offence, by order of the commanding officer.

Art. 19. No officer, non-commiffioned officer or foldier fhall fail of repairing, at the time fixed, to the place of parade or cife, or other rendezvous appointed by the commanding officer, if not prevented by fickness, or fome other evident neceffity; or fhall go from the faid place of rendezvous, or from his guard, without leave from his commanding officer, before he thall be regularly difmiffed or relieved, on penalty of being punished according to the nature of his offence, by the fentence of a regimental court-martial.

Art. 20. Whatsoever commiffioned officer shall be found drunk on his guard, party or duty, under arms, fhall be cashiered for it; any noncommiffioned officer or foldier, fo offending, fhall fuffer fuch punishment as fhall be or dered by the fentence of a regimental courtmartial.

Art. 21, Whatfoever centinel fhall be found fleeping upon his poft, or fhall leave it before he hall be regularly relieved, fhall fuffer fuch punishment as fhall be ordered by the fentence of a general court-martial,

Art. 22. Any perfon belonging to the Continental Army, who by difcharging of fire-arms, beating

of drums, or by any other means whatsoever, fhall occafion falfe alarms, in camp or quarters, fhall fuffer fuch punishment as fhall be ordered by the fentence of a general court-martial.

Art. 23. Any officer or foldier, who fhall, without urgent neceffity, or without leave of his fuperior officer, quit his platoon or divifion, fhall be punished according to the nature of his of fence, by the fentence of a regimental courtmartial.

Art. 24. No officer or foldier (hall do violence, or offer any infult, or abufe, to any person who fhall bring provifions, or other neceffaries, to the camp, or quarters of the continental army; any officer or foldier fo offending, fhall, upon complaint being made to the commanding officer, fuf fer fuch punishment as fhall be ordered by a regimental court-martial.

Art. 25. Whatfoever officer or foldier fhall fhamefully abandon any poft committed to his charge, or fhall fpeak words inducing others to do the like, in time of an engagement, fhall fuf, fer death immediately.

Art. 26. Any perfon belonging to the continental army, who shall make known the watch-word to any perfon who is not intitled to receive it, according to the rules and difcipline of war, or fhall presume to give a parole, or watch-word, different from what he received, fhall fuffer death, or fuch other punishment as shall be ordered by the fenence of a general court-martial.

Art. 27, Whofoever, belonging to the continental army, fhall relieve the enemy with money,

victuals,

victuals, or ammunition; or fhall knowingly harbour or protect an enemy, thall fuffer fuch punishment as by a general court-martial fhall be ordered.

Art. 28. Whofoever, belonging to the continental army, fhall be convicted of holding correfpondence with, or of giving intelligence to the enemy, either directly or indirectly, fhall fuffer fuch punishment as by a general court-martial fhall be ordered.

Art. 29. All public ftores taken in the enemy's camp or magazines, whether of artillery, ammunition, cloathing or provifions, fhall be fecured for the use of the United Colonies.

Art. 30. If any f any officer or foldier fhall leave his post or colours, in time of an engagement, to go in search of plunder, he fhall, upon being convicted thereof before a general court-martial, fuffer fuch punishment as by faid court-martial fhall be ordered.

: Art. 31. If any commander of any poft, intrenchment, or fortrefs, fhall be compelled by the officers or foldiers under his command to give it up to the enemy, or to abandon it, the commiffioned officer, non-commiffioned officers or foldiers who fhall be convicted of having fo offended, fhall fuffer death, or fuch other punishment as may be inflicted upon them by the fentence of a general court-martial.

Art. 32. All futtlers and retailers to a camp, and all perfons whatsoever, ferving with the continental army in the field, though not inlifted foldiers, are to be fubject to the articles, rules, and regulations of the continental army.

Art. 33. No general court-martial shall confift of a lefs number than thirteen, none of which Thall be under the degree of a commiffioned officer; and the prefident fhall be a field officer.: And the prefident of each and every courtmartial, whether general or regimental, fhall have power to administer an oath to every witnefs, in order to the trial of offenders. And the members of all courts-martial fhall be duly fworn by the prefident; and the next in rank on the court-martial shall administer the oath to the prefident.

Art. 34. The members, both of general and regimental courts-martial, fhall, when belonging to different corps, take the fame rank which they hold in the army; but when courts-martial shall be compofed of officers of one corps, they fhall take their ranks according to their commiffions by which they are mustered in the faid corps.

Art. 35. All the members of a court-martial, are to behave with calmnefs, decency, and inpartiality; and in giving of their votes, are to begin with the youngest or loweft in commiffion.

Art. 36. No field officer fhall be tried by any perfon under the degree of a captain; nor fhall any proceedings or trials be carried on, excepting between the hours of eight in the morning, and three in the afternoon, except in cafes which require an immediate example.

· Art. The commiffioned officers of every ·37. regiment may, by the appointment of their colonel or commanding officer, hold regimental

courts-martial for the enquiring into fuch dif putes or criminal matters as may come before them, and for the inflicting corporal punishments, for finall offences, and fhall give judgment, by the majority of voices; but no fentence shall be executed till the commanding officer (not being a member of the court-martial) fhall have confirmed the fame.

Art. 38. No regimental court-martial shall confift of less than five officers, excepting in cafes where that number cannot be conveniently affembled, when three may be fufficient; who are likewife to determine upon the fentence by the majority of voices; which fentence is to be confirmed by the commanding officer, not being a member of the court-martial.

Art. 39. Every officer, commanding in any fort, caftle, or barrack, or elsewhere, where the corps under his command confifts of detachments from different regiments, or of independent companies, may affemble courts-martial for the trial of offenders in the fame manner as if they were regimental, whose sentence is not to be executed till it thall be confirmed by the faid commanding officer.

Art. 40. No perfon whatfoever shall ufe menacing words, figns, or geftures in the prefence of a court-martial then fitting, or fhall caufe any diforder or riot, fo as to difturb their proceeding, on the penalty of being punished at the difcretion of the faid court-martial.

Art. 41. To the end that offenders may be brought to justice, whenever any officer or foldier fhall commit a crime deferving punishment,
