precinct to the register of such respective wards, on or before the day when the register opens his office for the registration of voters in such respective wards, and such census shall be made and returned in the same manner before each election of the members of the General Assembly, and copies thereof shall be furnished to the register as aforesaid.

10. If any person shall deem himself aggrieved by the refusal of any officer of registration to register his name as a qualified voter, or by the striking off his name from the list of qualified voters for any cause, he shall have the right to appeal by petition from such decision or action to the judge or judges of the Circuit Court of the county where he applied for registration, or to a judge of the Supreme Bench of Baltimore city in case the person applied for registration in Baltimore city, and if said judge or judges shall determine that the party so appealing is entitled to be registered or to be restored to the list as a qualified voter, he shall so certify to the officer of registration from whose decision the appeal was taken, and the said officer shall thereupon register the said person as a qualified voter, and in that case the cost of said appeal shall be paid by the mayor and city council of Baltimore, or by the county commissioners of the county in which the appeal was taken; and it shall be the duty of the State's attorneys of the several counties and of the counsel for the officers of registration of Baltimore city, as hereinafter provided, to appear on behalf of the officers of registration and against the appellant at the hearing of all appeals from the decision of officers of registration within their respective counties and Baltimore city, as the case may be.

11. Immediately after the expiration of the days in which said officers of registration shall have sat for such corrections of the registry lists, commencing on the first Monday in September, they shall proceed without delay to make or cause to be made two alphabetical lists, one of which lists shall comprise the names of those registered persons which said officers have stricken from the lists of qualified voters and from the books of registration, delivered to said. officers by said clerks of courts, and the other one of which lists shall comprise the names of the persons which said officers have registered at the registration just made, and also the names of those persons whom the judge of a court to whom an appeal from the decision of said officers of registration has been taken has decided to be entitled to be registered, and said officers of registration shall cause said lists to be published by handbills posted in such public places as they may elect in the several precincts of Baltimore city, and said election districts in the counties, and one-third of the handbills so posted in Baltimore city shall be printed in the German language.

12. For the purpose of revising said books of registration and said lists as made and published by said oflicers of registration, they shall for three successive days in the city of Baltimore and two

successive days in the several counties of the State, commencing on the first Monday in October, eighteen hundred and seventy-six, and on the same days respectively in every year thereafter, at some place in their respective precincts and districts convenient to the voters thereof, sit with open doors from nine o'elock A.M. until nine o'clock P.M. in Baltimore city, and from nine o'clock A.M. until six o'clock P.M. in the counties, and the respective officers of registration shall give at least three days' notice, by a notice signed by them respect- Publication of ively, of the time and place of sitting in said precincts and districts by publication in three newspapers published in Baltimore city, one of which shall be printed in the German language, and in one newspaper in each county in which a newspaper is published, and also by handbills posted at such public places as said officers shall select in said precincts and districts.

13. At the time and place published by said officers of regis- Id. s. 10. tration for receiving said books of registration and lists, as mentioned in the preceding section, the said officers shall proceed to strike from said books and said lists the names of all persons known Manner of revising. or made known to them as required in section four of this act, or who may not be residents of or entitled to vote in the precinct or election district in which they are respectively registered, who have died or who do not possess the requisite qualifications, or who will not possess said qualifications before the election next ensuing, or who are disqualified under the provisions of the second or third sections of the first article of the Constitution, and to register the name of every person who shall apply to them to be registered who shall satisfy said officers of registration that they possess or will possess the requisite qualifications before the election next ensuing, and who are not disqualified under the second and third sections of the first article of the Constitution, and also the name of every person whom a judge of a court, to which an appeal has been taken from the decision of said officers of registration has decided to be entitled to be registered as a qualified voter; provided that when any person applying as aforesaid for registration shall have been previously registered within this State, the officers of registration to whom such application is made, before registering such person, shall demand. and receive from him the certificate of his previous legal registration and cancel the same, and they shall then finally revise and complete said lists.

and the name of every voter shall be placed in the lists of the precinct in which he resides, and the residence of each person in the city of Baltimore shall be as far as known set opposite his name; and every person whose name appears in said corrected lists of qualified voters or in the revised registration books returned to the clerk of the Circuit Court of the respective counties or to the clerk of the Superior Court of Baltimore City, shall be entitled to vote at the polls in said district or precinct of the ward or county for which his name appears, at every election held thereafter, until after another registration of voters has been duly published, except those persons who shall become disqualified by change of residence; and said officers of registration shall cause to be published two alphabetical lists, one of which shall comprise the names of those persons stricken from the books of registration, and the other one of said lists shall comprise the names of the persons which said officers have registered, which list shall be published by handbills as herein before provided for in this act; and no person shall be registered after the expiration of the time for correcting the lists.

15. After the final completion of each revision of the said registry lists as herein before provided, said officers of registration. shall make or cause to be made, in books proper for the purpose, two fair copies of the lists of the qualified voters as made after the last sitting of said officers respectively; and the said officers of registration in the city of Baltimore shall, within ten days after such last sitting, deliver one of said lists to the sheriff of Baltimore city, and the other of said lists and the said books of registration of said precincts of said city to the clerk of the Superior Court of Baltimore City; and said officers of registration in said counties shall, within five days after the last sitting of said officers respectively, deliver one of said lists to the sheriff of his county, and the other of said lists and the said registry books to the clerk of the Circuit Courts of the counties; and the said books of registration shall be safely kept and preserved by said clerks as hereinbefore provided by this

act.

16. No person shall be entitled to be, or remain registered in any precinct or election district, unless he shall have been a resident of the State for one year, and of the city of Baltimore, or the county in which registration be claimed, for six months next preceding the next ensuing election, at which such registration would be evidence of the right of the person so registered to vote; and in case any county or city be so divided as to form portions of different electoral districts for the election of representatives in Congress, delegates, or other officers, then to entitle a person to be or remain registered in any particular section, or part of such county or city, he must have been a resident of that part or section of the electoral district in which he claims to be or is registered for six months next preceding the next election, at which such registration would be evidence of the right of the person so registered to vote; and the resi

dence necessary to entitle any person to vote or remain so registered to vote, and the evidence necessary to entitle any person to be or remain so registered, shall be an actual bonâ fide residence within the precinct or district within which such person may claim to reside and to be registered; and such actual bona fide residence shall be established upon the oath or affirmation of competent evidence to the satisfaction of the register to whom the application is made, and to the satisfaction of the judge or judges to whom any appeal is made under the provisions of this act; and the neglect or refusal of any person deeming himself aggrieved by the refusal of any officer of registration to register his name, or by the striking off of his name from the list of qualified voters, to appeal by petition from such action, as provided for in this act, shall be deemed and taken to be conclusive evidence that the said person was rightfully refused registration, or that the name of such person was rightfully stricken from the list of qualified voters of such precinct or election district. 17. Whilst discharging the duties imposed by the several sec- Id. s. 14. tions of this act, said officers of registration shall have and exercise the powers of a justice of the peace for the preservation of order Powers of registers. around the place of registration, and may compel the presence of witnesses for the purpose of obtaining any information necessary to an intelligent discharge of the duties of their office; they shall have power to issue summons, attachments, and commitments to any sheriff or constable, who shall serve such process as if issued by a judge of a court or a justice of the peace, and shali receive the same fees and in the same manner as allowed by law in State cases, but the officers of registration shall not charge any fee for the issuing of such process, or receive any fee or emoluments for this or any other service they may perform in the proper discharge of their duties, except provided in this article.

New or special election.

18. Immediately after the ordering of any new or special elec- 1. s. 15. tion as provided by the Constitution, except for senators or members of the House of Delegates, the clerk of the Circuit Court of the county in which such new or special election is to be held, or the clerk of the Superior Court for Baltimore City, if such election is to be held in said city, shall deliver to the officers of registration of said county or city the books of registration, and lists of qualified voters for said county or city, whereupon said officers of registration shall for three successive days if in Baltimore city, or for two successive Time and place days if in either of the counties, commencing not more than ten of sitting of registers. days after the ordering of such election, at some convenient place to the voters of the several election districts of said county, or of the several precincts of Baltimore city, sit with open doors from nine o'clock A.M. to six o'clock P.M. in the several counties, or from nine o'clock A.M. to nine o'clock P.M. in Baltimore city, for the purpose of registering all persons applying to them for that purpose, who may possess the necessary qualifications to vote at such election in the manner herein before prescribed, and shall proceed to strike from the

registry books and the list of qualified voters the names of all persons known or made known to them, who have died, removed from the precinct or district, or who may not be residents or entitled to vote in the precinct or district in which they are respectively registered or have otherwise become disqualified; and the said respective officers of registration shall give at least five days' previous notice of the time and place of sitting, by publication in at least one newspaper published in said county, or three newspapers, if in Baltimore city, one of which shall be in German.

19. Immediately after the expiration of the days on which said. officers of registration shall have corrected said lists, as provided in the preceding section, they shall proceed without delay to make, or cause to be made, two alphabetical lists, one of which shall comprise the names of those registered persons which said officers of registration have stricken from the list of qualified voters, and the books of registration delivered to said officers by said clerks of courts, and the other one of said lists shall comprise the names of those persons whom said officers have added to the registry, and also the names of those persons whom the judge of a court as aforesaid, to whom an appeal hath been taken from the decision of an officer of registration, has decided to be entitled to be registered; said officers of registration shall immediately cause said lists to be published by handbills, as herein before provided by this act, commencing at the expiration of six days from the end of the sitting last mentioned; the said officers of registration shall sit two consecutive days during the hours aforesaid, for the purpose of revising said lists and books of registration, notice of the time and place of which sitting shall be given by publication in newspapers as herein before provided; immediately on the expiration of said two days said officers of registration shall make out the lists, as provided in the twelfth section of this act, and said lists and the said books of registration shall be immediately returned in the manner stated in the said last-named section.

20. The board of police commissioners for Baltimore city, shall detail police officers sufficient to preserve order at the places where preserve order said oflicers of registration in Baltimore city, upon the written request of the registers of voters, are discharging the duties of their office.

21. Said clerks of the Circuit Courts of the several counties of this State, and of the Superior Court of Baltimore City, shall receive said copies of the lists of qualified voters, and said books of registration, and file said lists as other papers are filed, and carefully preserve such lists and books, and said clerks shall permit examination of the same in their presence, or in the presence of their deputies, and not otherwise; and they shall not alter, mutilate, or deface, or suffer others to alter, mutilate, or deface the said lists of voters, or books of registration; and said clerks, when notified by the sheriff that any one or more of the list of voters committed to his
