the Bar of Illinois may be heard. I think we ought to have a vote of this meeting after this splendid discussion.

The motion was seconded.

MR. FITTS: A point of order. We can't amend an amendment.

THE PRESIDENT: The chair is not going to be technical about that.

MR. HUGHES: I move to lay both amendments on the table.

ment.

JUDGE WRight: I am willing to accept the amend

THE PRESIDENT:

With the consent of the mover and

with the consent of the second that amendment is accepted. What is the pleasure of the Association as to the continuance of this discussion?

MR. BURTON: I move the previous question.

The motion was seconded.

THE PRESIDENT: The motion is shall the question be put. All in favor, say aye. Opposed by the same sign, and

the motion is unanimously carried.

The vote now recurs upon the amendment to the original motion, the original motion being to adopt this substitute which has been printed. The amendment is that we take a straw vote now of the members present and then submit the question for final determination to a mail referendum of all members of this Association with the right of each side to submit with the mail vote an argument not exceeding 1000 words on the subject of their position.

MR. ABBOTT: I would like to know from Judge Wright how we are going to determine who is to prepare the 1000 words for the proponents and a thousand words for those who are against it.

THE PRESIDENT:

The Judge has covered that as to

the proponents by saying, the Committee on Legal Education. He did not cover it as to those against the resolution.

The motion

MR. ABBOTT: I don't think the proposition is fair. Some of us are in favor of taking a vote now. means it is going to the referendum anyhow.

THE PRESIDENT: That is the motion.

MR. ABBOTT: I move we take a vote on it now and settle it.

THE PRESIDENT: Then the gentleman can cast his vote now. But I appeal to the audience if I fairly stated the amendment as offered and seconded.

(Answers of "Yes").

THE PRESIDENT:

But there is a motion that we take what might be termed a straw vote now, but that the final determination be made by referendum vote by mail of all members of the Association, with the arguments as I have stated.

MR. WEBSTER: May I ask your indulgence simply to call attention to a fact? All I care to say is that this proposition has been passed on to all of the members of this Association by mail, with the full report of the Committee on Legal Education of the Chicago Bar Association, which has gone to every member during last winter, and in addition to that there have been meetings in every judicial district of this state at which this discussion has been had, and they have all been notified that this vote would be taken at this meeting. Have we a quorum here?

THE PRESIDENT: We have. It is for this Association to say, and it will determine it now upon the vote on the amendment. A vote for this amendment means a referendum; a vote no means a determination of the question here. All in favor of the amendment

MR. BURTON:

My amendment is that we take a vote

here among ourselves, as to how we stand here to-day.

THE PRESIDENT: All in favor of the amendment, which carries with it the straw vote and referendum by mail, will say aye. All opposed, will say no.

(Calls for a rising vote).

THE PRESIDENT:

The chair is unable to decide. All
The chair will appoint

in favor of the amendment will rise.

Judge Wright and Mr. Webster as tellers.

MR. WEBSTER:

THE PRESIDENT:

will please rise.

I count 36.

All those opposed to the amendment

JUDGE WRIGHT: No need to count them.

THE PRESIDENT: The amendment is defeated, by the report of the tellers.

Now the motion recurs upon the adoption of the original resolution for the adoption of the substitute proposal; are you ready for the question on that?

(Calls for the question).

THE PRESIDENT: All in favor of the adoption of the original motion will say aye. Opposed, no. And the motion is carried and the resolution adopted. (Applause). Is there any other business to come before the Association? If not, the chair will declare in order a motion to adjourn sine die.

The motion was made, seconded and carried.
