NO. 2 OF 1896.

AN ORDINANCE TO AMEND AND CONSOLI-
DATE AS AMENDED THE ORDINANCES
RESPECTING SCHOOLS.

[Assented to October 30, 1896].

The Lieutenant-Governor, by and with the advice Preamble. and consent of the Legislative Assembly of the Territories, enacts as follows:

1. This Ordinance may be cited as The School Short itle. Ordinance 1896.

2. In this Ordinance, except the context otherwise Interpretation requires :

(a) The expression "Ratepayer" shall mean and in- Ratepayer. clude any person over the age of twenty-one years, whose name appears on the last revised assessment roll of the school district, who has paid all taxes due by him to the said district.

(b) The expression "Resident Ratepayer" shall Resident mean and include:

(1) In any school district where no assessment has been made, or for the purposes of the first school meeting, any person over the age of twenty-one years actually residing within the proposed school district and who has so resided therein and owned, or been the occupant of assessable property therein, for a period of at least three months immediately prior to the date of the first school meeting, or any person over the age of twenty-one years who has actually resided within the proposed district for at least three months immediately prior to the date of the first meeting, who is in receipt of taxable income therein.

(2) After the erection of a school district any person over the age of twenty-one years, actually resident within the school district, whose name appears on the last revised assessment roll of the school district, who has paid all taxes due by him to such district.

(e) The expression "Oath" includes a solemn affirmation or declaration whenever the context applies to any person and case by whom and in which a solemn affirmation or declaration may be made instead of an oath; and in like cases the expression "Sworn” includes the expression " Affirmed" or " Declared."

(d) The expression "Town School District" shall mean a school district situated wholly or in part within a town or city municipality.

Provided that any school district situated wholly or in part within the municipality of the town of Prince Albert shall not be considered a town district; Provided further, that any school district situated wholly or in part within the municipality of the town of Prince Albert shall be empowered to elect five trustees, and no more, such trustees to hold office as in the case of town school districts.

3. There may be established, subject to the provisions of this Ordinance and to the regulations of the Council of Public Instruction, the following classes of schools, namely:

(a) PUBLIC SCHOOLS, for pupils over five years of age, in which instruction shall be given in the elements of an English and commercial education;

(b) SEPARATE SCHOOLS, for pupils over five years of age, in which instruction shall be given in the elements of an English and commercial education;

(c) KINDERGARTEN SCHOOLS, for pupils between four and six years of age, in which instruction shall be given according to kindergarten methods;

(d) NIGHT SCHOOLS, for pupils over fourteen years Night Schools. of age, who are unable to attend school during the usual school hours;

(e) NORMAL SCHOOLS, for the training of candidates Normal for first, second, and third class teachers' certificates;

Schools.

(f) TEACHERS' INSTITUTES, for the reading of Teachers' ра- Institutes. pers and the general discussion of educational topics.

COUNCIL OF PUBLIC INSTRUCTION.

4. The members of the Executive Committee of the Constitution of Council of Territories, and four persons, two of whom shall be Public Protestants and two Roman Catholics, appointed by Instruction. the Lieutenant-Governor in Council, shall constitute a Council of Public Instruction, and one of the said Executive Committee, to be nominated by the Lieutenant-Governor in Council, shall be Chairman of the said Council of Public Instruction. The appointed members shall have no vote, and shall receive such remuneration as the Lieutenant-Governor in Council shall provide.

(1) The Executive Committee, or any sub-committee Quorum of thereof appointed for that purpose, shall constitute a quorum of the Council of Public Instruction, but no general regulations respecting :

(a) The management and discipline of schools;
