CHAPTER 1.

AN ACT to enable the Treasurer of the City of Janesville to apply to the Circuit Court for judgment for the sale of lands for taxes of 1860.

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. The treasurer of the city of Janesville Authority to is hereby authorized to apply to the circuit court of treasurer of city. Rock county, at the January term thereof, to wit: on the twelfth day of February, A. D. 1861, for judgment against the lands, lots and parcels of land, upon the report filed by the said treasurer, in the office of the clerk of the said court, on the 5th day of January, A. D. 1861, of the said lands, lots and parcels of land, upon which the city taxes of the city of Janesville were not paid for the year A. D. 1860; and it shall be the court of Rock duty of the circuit court of Rock county, on the said county. 12th day of February, or as soon thereafter as counsel can be heard, to hear and determine upon the said application, as provided by the charter of said city, the same as though the said application for judgment had been regularly made in all respects.

SECTION 2. Declaratory.

AN ACT to legalize the proceedings of the District Board of School
District No. 2, of the town of Lowell, Dodge county.

The People of the State of Wisconsin, represented in Senate
and Assembly, do enact as follows:

SECTION 1. All taxes voted or levied and all contracts made, liabilities incurred, and all proceedings had in school district No. 2, of the town of Lowell, Dodge county, for the purpose of renting a school room, purchasing a site, or building a school house in said district, are hereby made and declared legal and binding upon said district.

SECTION 2. This act shall take effect and be in force from and after its passage. Approved January 17, 1861.

Duty of clerk of

AN ACT to authorize drawing the Petit Jurors for the County of
Jefferson, for the year 1861.

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. It shall be the duty of the clerk of the circuit court of the county of Jefferson, at the same time he shall draw the grand jurors, to draw from the whole list selected by the board of supervisors of said

county at their last meeting, as petit jurors, the number required by law to serve as petit jurors, at the several jury terms of said court to be held in said county for the year 1861.

AN ACT to provide for the payment of certain outstanding indebtedness against the Swamp Land Fund.

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. The state treasurer is hereby author- Treasurer to pay° ized and required to pay out of the swamp land fund income, all accounts that have been or may be legally audited for the year one thousand eight hundred and sixty, payable out of the swamp land fund: provided, Proviso. that nothing herein contained shall be so construed as to require or compel the state treasurer to pay any such account which has been, either in part or in whole, illegally audited.

SECTION 2. There is hereby appropriated out of the Appropriation. swamp land fund income a sufficient amount of money to pay the accounts to which reference is had in section one of this act.

SECTION 3. This act shall take effect and be in force from and after its passage.

CHAPTER 5.

AN ACT to authorize "The River and Lake Shore City Railway Company" of Milwaukee, to issue and dispose of its Bonds to the amount of seven thousand dollars.

The People of the State of Wisconsin, represented in Senate and Assembly, do enact as follows:

SECTION 1. It shall be lawful for "The River and poration to issue Lake Shore City Railway Company" of Milwaukee, a corporation heretofore organized and established under and in pursuance of the provisions of chapter seventythree of the revised statutes, to issue and dispose of its corporate bonds, not exceeding seven thousand dollars in the aggregate, payable at a time to be fixed in said bonds, not more than five years from January 1st, 1861, and bearing interest at the rate of ten per cent. per annum, payable semi-annually, and to secure such bonds by a trust-deed or a mortgage upon the company's railway, including side track and switches, in the city of Milwaukee, and upon the cars and rolling stock of said company connected with or used on said railway provided, that the issuing of said bonds so secured shall be approved by the votes of stockholders of said company, owning and holding a majority in amount of the capital stock thereof, at a meeting called for that purpose, of which meeting at least six days' notice shall be given.

SECTION 2. The said company is hereby authorized to negotiate and dispose of such bonds or any part thereof to such persons or corporations on such terms and at such rates as may be agreed on, any law on the subject of usury to the contrary notwithstanding.

SECTION 3. This act shall take effect and be in force. from and after its publication, and all acts and parts of acts in conflict with the provisions of this act are hereby repealed so far as the same are applicable to the corporation named in this act.
