Mr. MELCHER introduced the following bill; which was read twice and referred to the Committee on Energy and Natural Resources

A BILL

For the relief of Mr. Conwell F. Robinson and Mr. Gerald R.

Robinson.

Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a)(1) the Secretary of the Interior shall grant a life 4 estate special use permit to Mr. Conwell F. Robinson and 5 Mr. Gerald R. Robinson to use the property in Glacier Na6 tional Park described in paragraph (2).

7 (2) The property referred to in paragraph (1) is Tract 8 398 which is property formerly owned by the Robinson 9 brothers. The property was originally homesteaded by mater10 nal grandparents of the Robinson brothers prior to the cre11 ation of Glacier National Park and was deeded to their

1 grandmother, Margaret McCarthy, by President Woodrow 2 Wilson on April 23, 1915. Tract 398 was taken from the 3 Robinson brothers by condemnation through an eminent 4 domain action brought by the United States Government in 5 1967.

(b)(1) The special use permit granted by this Act shall 7 be extended for a period coincident with the lives of Conwell 8 F. Robinson and Gerald R. Robinson.

9 (2) The special use permit granted by this Act shall 10 grant to Conwell F. Robinson and Gerald R. Robinson rea11 sonable use of the property.

12 (c) Any fee collected for the special use permit required 13 by this Act shall be fair and reasonable and in an amount 14 necessary to cover the administrative costs associated with 15 granting the permit, except that in no event shall the fee 16 collected exceed $100 per annum.

17 (d) The Secretary shall promulgate such regulations as 18 the Secretary deems are necessary to insure that the life 19 estate special use permit granted by this Act does not unrea20 sonably diminish the scenic, historic, and other values for 21 which the Glacier National Park was established.

A BILL

To authorize the Secretary of the Interior to exchange certain

Federal mining rights for certain lands in New Mexico.

Be it enacted by the Senate and House of Representa

2 tives of the United States of America in Congress assembled, SECTION 1. The Secretary of the Interior is authorized

4 to exchange certain lands as identified for disposal in the 5 Southern Rio Grande Plan Amendment, for certain mining 6 claims on lands withdrawn for the National Aeronautic and 7 Space Administration and New Mexico A&M College (now 8 New Mexico State University) under P.L.O. 3685 and 9 P.L.O. 2051. Once the United States determines the claims 10 are valid under existing law, the exchange authorized by the

1 preceeding sentence shall to be made on an equal value basis

2 as determined by an independent appraisal.

SEC. 2. (a) The Secretary of the Interior is authorized 4 and directed to make available for exchange the Federal in5 terests in the lands described in subsection (b) for the private 6 interests in the lands described in subsection (c). The ex7 change shall be made in a manner consistent with applicable 8 provisions of law and shall be on the basis of equal value. (b) The Federal interests to be made available for ex10 change under this section are those lands in sections 13, 14, 11 15, 22, 23, 24, 25, 26, and 35 of T 23 S, R 2 E, New 12 Mexico Principle Meridian.

13 (c) The private interests to be exchanged pursuant to 14 this section are those lands owned by New Mexico State Uni15 versity in sections 19, 29, 30, and 31 of T 22 S, R 4 E, and 16 section 6 of T 23 S, R 4 E, New Mexico Principle Meridian. 17 (d) Lands not acquired by New Mexico State University 18 pursuant to this section and which are encompassed by 19 P.L.O. 3685 and P.L.O. 2051 may be disposed of by sale to 20 or exchange with the State of New Mexico, New Mexico 21 State University, or other public and private entities: Provid22 ed however, That New Mexico State University is given a 23 right of first refusal on any proposed disposition.
