court, except as provided in section forty-five of chapter eighty-two of the revised statutes. They shall account quarterly under oath to the county treasurer for all fees received by them or payable to them by virtue of the office, except fees collected by them in naturalization proceedings under the act of congress of June twenty-ninth, nineteen hundred and six, as amended by the act of congress on June twenty-fifth, nineteen hundred and ten, specifying the items, and shall pay the whole amount of the same to the treasurers of their respective counties quarterly on the first days of January, April, July and October of each year.'

Chapter 22.

An Act to Amend Section Two. of Chapter One Hundred and Eighteen of the Revised Statutes, as Amended by Chapter One Hundred and Twenty-five of the Public Laws of Nineteen Hundred and Twenty-one, Relating to Fees of Trial Justice.

Be it enacted by the People of the State of Maine, as follows:

R. S., c. 118, sec. 2; P. L., 1921, c. 125; relating to fees of trial justices and justices of the peace, amended. Paragraph four of section two of chapter one hundred and eighteen, of the revised statutes, as amended by chapter one hundred and twenty-five of the public laws of nineteen hundred and twenty-one, is hereby further amended by striking out the words "eight cents" in the first line thereof and inserting in place thereof the words 'three dollars,' so that said paragraph, as amended, shall read as follows:

'Increase for trial of issue in civil actions. Trial of an issue, in a civil action, three dollars, and when more than one day is used in the trial, two dollars for each day, after the first, actually employed.'

Chapter 23.

An Act to Amend Section Fifty-eight of Chapter Eight of the Revised Statutes, as Amended by Chapter Five of the Public Laws of Nineteen Hundred and Nineteen, Relating to Forest Fire Signs.

Be it enacted by the People of the State of Maine, as follows:

R. S., c. 8, sec. 58; P. L., 1919, c. 5; relating to printing and distributing forestry laws, amended. Section fifty-eight of chapter eight of the revised statutes, as amended by chapter five of the public laws of nineteen hundred and nineteen, is hereby amended by striking out the word "selectmen" in the fifth line of said section and inserting in place thereof the words 'forest fire wardens'; and by striking out the words "one-half of

which when imposed and collected, shall be payable to the complainant," in the fourteenth line thereof, so that said section, as amended, shall read as follows:

'Sec. 58. Copies of laws to be distributed to forest fire wardens; payment of one-half of fines collected to complainant, eliminated. The forest commissioner, at the expense of the state, may cause copies of sections. twenty-eight to fifty-nine, both inclusive, of this chapter, or of such sections or parts of sections thereof as he may deem desirable, and all other laws of the state relating to forest fires, to be printed and freely distributed to the forest fire wardens of all the towns of the state, who shall post them up in school-houses, saw mills, logging camps and other places; and similar copies shall be furnished to owners of forest lands, who may apply for them, to be posted up at the expense of such owners. Any person tearing down, destroying or defacing any such notices, or any notices relative to protection against forest fires posted over the name and title of the forest commissioner, or the name of any association organized for the protection of the forests of the state from fire, shall on conviction thereof be punished by a fine of not less than twenty-five nor more than fifty dollars.'

Chapter 24.

An Act to Amend Sections Forty-three and Forty-six of Chapter Eighteen of the Revised Statutes, Relating to Optometry.

Be it enacted by the People of the State of Maine, as follows

Sec. I. R. S., c. 18, sec. 43; relating to examination, fees and registration of optometrists, amended. Section forty-three of chapter eighteen of the revised statutes is hereby amended by striking out the word "five" in the seventh line thereof and inserting in place thereof the word 'fifteen,' so that said section, as amended, shall read as follows:

'Sec. 43. Fee for examination increased. Every person before beginning the practice of optometry in this state shall pass an examination before the state board of registration and examination in optometry. Such examination shall be confined to such knowledge as is essential to the practice of optometry. Any person, having signified to said board his desire to be examined, shall appear before the board at such time and place as they may designate, and before such examination shall pay to said board the sum of fifteen dollars, and if he shall successfully pass said examination shall pay to said board a further sum of ten dollars, on the issuance to him of a certificate. All persons successfully passing such examination shall be registered in a record which shall be kept by the secretary of said

board, as licensed to practice optometry, and shall also receive a certificate of such registration to be signed by the president and secretary of said. board.'

Sec. 2. R. S., c. 18, sec. 46; relating to issuing certificates without examination, amended. Section forty-six of said chapter is hereby amended by striking out the word "five" in the second line thereof and inserting in place thereof the word 'twenty-five,' so that said section, as amended, shall read as follows:

'Sec. 46. Fee for certificate increased to $25. Upon application and the payment of the sum of twenty-five dollars said board shall issue, without the prescribed examination, to persons practicing optometry in those states which, in the opinion of the board, maintain a standard in the requirements of the practice of optometry equal to the standard of this state, a certificate to practice in this state, which certificate shall be filed in the same manner as that issued to residents of the state; provided, however, that such certificate shall be issued only to the residents of such states as allow similar privileges to residents of this state.'

Chapter 25.

An Act Increasing Clerk Hire in the Office of Register of Deeds in Penobscot County.

Be it enacted by the People of the State of Maine, as follows:

R. S., c. 117, sec. 45; P. L., 1921, c. 219; relating to clerk hire in county offices, amended. Paragraph eleven of section forty-five of chapter one hundred and seventeen of the revised statutes, as amended by section fortyfive of chapter two hundred and nineteen of the public laws of nineteen hundred and twenty-one, is hereby further amended by striking out the words "two thousand and eighty" in the second line of said paragraph, and inserting in place thereof the words 'thirty-one hundred and eighty,' so that said paragraph, as amended, shall read as follows:

'Penobscot county; increase in office of register of deeds. For clerks in the office of register of deeds, thirty-one hundred and eighty dollars, beginning as of January one, nineteen hundred and twenty-three; for clerks in the office of register of probate, fifteen hundred dollars; for clerks in the office of clerk of courts, twenty-two hundred and fifty dollars; for clerks in the office of county attorney, six hundred dollars.'

Chapter 26.

An Act to Increase the Salary of Clerks in the Office of Register of Probate for Hancock County.

Be it enacted by the People of the State of Maine, as follows:

R. S., c. 117, sec. 45; P. L., 1919, c. 214; 1921, c. 219; relating to clerk hire in county offices, amended. That so much of the paragraph in section forty-five of chapter one hundred and seventeen of the revised statutes as refers to salaries of clerks in the office of register of probate for Hancock county, as amended by chapter two hundred and fourteen of the public laws of nineteen hundred and nineteen, as amended by chapter two hundred and nineteen of the public laws of nineteen hundred and twenty-one is hereby further amended by striking out the words "six hundred and twenty-four dollars" in the second and third lines of said paragraph and inserting in place thereof the words 'seven hundred and eighty dollars,' so that said paragraph of said section, as amended, shall read as follows:

'Hancock county; increase in office of register of probate. For clerks in the office of register of deeds, fifteen hundred dollars; for clerks in the office of register of probate, seven hundred and eighty dollars; for clerks in the office of clerk of courts, seven hundred and eighty dollars.'

Chapter 27.

An Act to Amend Section Seventy-four of Chapter Forty-five of the Revised Statutes. as Amended by Chapter Seventy-one of the Public Laws of Nineteen Hundred and Seventeen, Relating to the Regulation of Smelt Fishing.

Be it enacted by the People of the State of Maine, as follows:

R. S., c. 45, sec. 74; P. L., 1917, c. 71; relating to regulation of smelt fishing, amended. Section seventy-four of chapter forty-five of the revised statutes, as amended by chapter seventy-one of the public laws of nineteen hundred and seventeen, is hereby further amended by adding to said section the following: 'nor to the dipping of smelts at the mouth of the Medomak river in the Town of Waldoboro between the fifteenth day of March and the fifteenth day of April, annually,' so that said section, as amended, shall read as follows:

'Sec. 74. Dipping of smelts at mouth of Medomak river in Waldoboro, exempted from provisions of law. No smelts shall be taken or fished for in tidal waters, nor in any brook, stream or river emptying into tide-waters within one thousand feet of tide-water, except by hook and line, between the first days of April and October, under a penalty of not less than ten, nor more than thirty dollars for each offense, and a further penalty of

twenty cents for each smelt so taken, and all weirs for the capture of smelts shall be open and so remain, and all nets used in the smelt and tomcod fishery shall be taken from the water on or before said first day of April, under a penalty of not less than twenty, nor more than fifty dollars, and a further fine of five dollars for each day that any such weir or net remains in violation of the law. But weirs with catch pounds covered with nets, the meshes of which are one inch square in the clear, or greater, or weirs with catch pounds covered with nets which are erected and used for the catching of herring, are not subject to this section. But no smelts caught in such weirs after the first day of April, shall be sold or offered for sale in this state, nor shall smelts caught in any manner between the first day of April and the first day of October following be offered for sale, sold or shipped from the state, under a penalty of twenty-five dollars for each offense; provided, however, that dip-nets may be used between the first day of April and the first day of May, and all smelts caught by dip-nets between said days may be lawfully offered for sale and sold in this state; provided, further, that this section does not apply to smelts taken in the Androscoggin river, above the Merrymeeting bay bridge, or in Narraguagus bay or river between the first days of October and November, nor to smelts taken in the Penobscot river and its tributaries between the first and thirtieth days of April, nor to smelts taken in Casco bay between the fifteenth day of September and the first day of October, nor to smelts taken in Franklin bay, between the first day of April and the first day of May, nor to smelts taken in Little Kennebec bay, so-called, or in Narraguagus bay or river, in the County of Washington, between the first day of April and the twentieth day of May, nor to smelts taken in Tunk stream and Parritt and Whitten stream, so-called, in the Town of Steuben, in Washington county, between the first day of April and the first day of May, nor to smelts taken in Passamaquoddy bay, St. Croix river and Cobscook bay and the coves and inlets tributary to these bays between the first day of September and the first day of October, nor to the dipping of smelts at the mouth of the Medomak river in the Town of Waldoboro between the fifteenth day of March and the fifteenth day of April, annually.'
