The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. All the acts and proceedings of the village of Fulton sale of ville had and done by its board of trustees, officers and agents bonds, leading up to and including the sale and award of the bonds of said village in the aggregate amount of seventeen thousand dollars for the purpose of constructing a sewer system therein, consisting of seventeen bonds of the denomination of one thousand dollars each, dated as of December fifteenth, nineteen hundred and nine, and payable respectively one bond each year in five to twenty-one years from the date thereof, are hereby legalized, ratified and confirmed, notwithstanding any defect or irregularity, or the omission of any lawful requirement, in such acts and proceedings, and said bonds when paid for and delivered shall be valid and binding obligations of said village.

§ 2. Chap. 24.

AN ACT to amend the town law, in relation to the compensation of town auditors.

Became a law March 5, 1910, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section one hundred and fifty-four of chapter sixtythree of the laws of nineteen hundred and nine, entitled "An act relating to towns, constituting chapter sixty-two of the consolidated laws," is hereby amended to read as follows:

154. Compensation of town auditors. Each of such town auditors shall be entitled to receive for his services three dollars for each day, not exceeding ten days in any one year, except in towns having a population of twelve thousand and upwards, in which towns each of such town auditors shall be entitled to receive for his services three dollars for each day, but not to exceed thirty days in any one year, and except that in towns having a population of twenty thousand and upwards, in which towns each of such town auditors shall be entitled to receive for his services three dollars for each day, but not to exceed sixty days in any one year,1 actually and necessarily devoted by him to the services of the town, in the duties of said office.

§ 2. This act shall take effect immediately.

AN ACT making an appropriation for reimbursement of sheriffs and deputy sheriffs.

Section 1. Eighteen thousand dollars ($18,000), or so much Appropriathereof as may be necessary, is hereby appropriated out of any expenses of moneys in the treasury not otherwise appropriated, for the com- quaranmissioner of agriculture to pay the sheriffs and deputy sheriffs of the different counties for expenses incurred prior to May fifteenth, nineteen hundred and nine,' by such sheriffs and deputy sheriffs, which have not been paid, in enforcing the provisions of quarantine notices duly issued by the commissioner of agriculture under the provisions of the agricultural law2 for the prevention and suppression of infectious or contagious diseases of domestic animals. But no part of the money hereby appropriated shall be used to pay or repay any such expenses so incurred or any part thereof which have been heretofore paid either by a county or by the state. § 2. This act shall take effect immediately.

§ 2. Within thirty days after this act takes effect, each of the members of said commission shall take the constitutional oath of office,2 to be administered by the city clerk of Buffalo. Five of the members of the commission shall constitute a quorum for the Powers and transaction of business. The said commission shall have full and exclusive power to make rules and by-laws for the orderly transaction of its business; to govern, manage and control, subject to the provisions of law3 relating to hospitals for the care and treatment of persons affected with incipient tuberculosis the said tuberculosis hospital of Buffalo and such other municipal hospitals as

may be hereafter established by said city for the exclusive care and treatment of persons affected with tuberculosis; to appoint and employ, and at pleasure remove, subject at all times to the civil service law and the rules and regulations of the municipal civil service commission of the city of Buffalo, such physicians, nurses, attendants, clerks and other employees, and at such compensation as shall be authorized and provided by ordinance duly enacted by the common council of said city, and to define the duties of such employees. Said commissioners shall visit and inspect such hospital or hospitals at least once every month, and shall from time to time appoint a committee of their number who shall visit and inspect said hospital as often as may be necessary. With the authority of the commission, any member thereof may Expendi expend such money as may be necessary to the efficient discharge of the duties of the commission and the conduct and government of the hospital, provided that in no case shall the disbursements in any fiscal year exceed the sums appropriated by the city for such year for the government and maintenance of said hospital, unless and until such excess of funds shall have been provided by the common council in the form and manner prescribed by the charter of said city. No contract creating a liability in excess of five hundred dollars shall be authorized or entered into by said commission without the authority of the common council expressed by resolution.

§ 3. The common council of the city of Buffalo shall every Annual year grant to the said commission for specifically stated purposes, such sum of money as to the common council shall appear reasonable and just for the government, maintenance or improvement of the said hospital or hospitals, and the money granted pursuant to this section shall be paid out of the general fund of the city.
