39. Relief to be given by Överseers in sudden and urgent necessity, and to be charged 5 parishes included in such Union in the form given in the Schedule to And be it Declared and Enacted, That every Overseer shall continue 25 to be bound to afford such and the same temporary or medical relief in cases of sudden and urgent necessity, or in cases of sudden and dangerous illness, as he is now by law bound to afford, anything in this to the Parish. Act contained to the contrary notwithstanding; and the cost of all such relief lawfully given by the Overseer of any parish comprised in 30 any such Union, if reported by him to the Clerk of the Guardians thereof within Fourteen Days after the same shall have been given, shall be repaid by such Guardians to him. 40. Proviso for Contributions for Repay ment of Loans already discharged by different Parishes in unequal proportions. 41. Removals to and from Unions to have like effect as to and from Parishes. Provided always, and be it Enacted, That when any sum of money has been lawfully borrowed by such Union for the building of a Work- 35 house or other purpose, all ordinary charges in respect of such borrowed money, whether for principal or interest, shall be charged on the parishes thereon, in the same proportion and manner as the same would have been chargeable if this Act had not been passed. And be it Enacted, That, subject to the provisions hereinbefore contained, all removals to or from a Union, and all warrants for such removals, and all acts, proceedings or documents relating to such removals or warrants, or connected therewith, shall, so far as the 40 5 10 the same are applicable, operate in the same manner and carry the same consequences as if such removal were a removal from or to a parish, and such acts, proceedings, warrants, orders and documents had reference to a removal from or to a parish; and the delivery of any person under a warrant of removal to a Union at the Workhouse of such Union, if there be any such, or to a Relieving Officer of a Union, if there be no such Workhouse, or, in either case, to the officer appointed by the Guardians to receive persons removed, shall be taken to be a delivery to the Guardians of the Union under the order. And be it Enacted, That every Board of Guardians constituted for a single parish under the provisions of the Act of the fifth year of the reign of his late Majesty King WILLIAM the Fourth, may act in the like manner as is herein before provided with regard to Guardians of Unions constituted under the said first-recited Act, in all matters 15 relating to the removal of the poor; and the said Commissioners may direct the Guardians of any such parish to appoint paid officers, and shall exercise the like powers with regard to the paid officers in such parishes as is hereinbefore provided in the case of Guardians of Unions for the removal of poor persons. 20 AND whereas the proceeds of divers charitable gifts, by way of bequest or otherwise, are distributable in certain parishes and places among persons settled in such places, and it is desirable to preserve the distribution thereof, as nearly as possible, in conformity with the mode of distribution required by the terms of the endowment; BE it 25 therefore Enacted, That, after the declaration of any Union for settlement, every poor person who shall have resided in any parish or place comprised in such Union in which any such gift as aforesaid is distributable for the space of Three Years, shall be entitled to share in the distribution of any such gift in like manner as if 30 he had been settled therein according to the laws in force prior to such declaration as aforesaid, until, by any order of the Court of Chancery, to be made on summary proceeding, by way of petition, or on an information, it shall be otherwise directed: Provided also, That, notwithstanding the provisions of this Act, no person in the receipt 35 of a share of any such charitable gift as a settled inhabitant of any place, shall be deprived thereof, or in any manner prevented from the receipt or enjoyment thereof, on the ground of any alteration of the laws of settlement herein contained. And be it Enacted, That the said Act of the fifth year of the reign 40 of King WILLIAM the Fourth, " for the Amendment and better Administration of the Laws relating to the Poor in England and Wales," and all Acts to amend and extend the same, and the present Act, 377. c 3 except 45. Forms in the may be used except so far as the provisions of any former Act are altered, amended or repealed by any subsequent Act, shall be construed as one Act; and all penalties and forfeitures imposed under this Act shall be recoverable as penalties and forfeitures under the said Act for the amendment of the laws relating to the Poor. And be it Enacted, That all proceedings under this Act it shall be sufficient in the law to use, with such changes only as the facts of in proceedings each case may require, the forms contained in the Schedules to this Act annexed, for the purposes in the Titles to such forms respectively specified. Act. this 46. Act limited to England. 47. Act may be amended this Session. And be it Enacted, That this Act shall extend only to England. And be it Enacted, That this Act may be amended or repealed by any Act to be passed in this present Session of Parliament. 5 10 |
