The cent-a-pound rate applies only to such publications mailed by a news agent as are published within the county in which the news agent is registered. All publications which are not published within the county where mailed by the news agent are chargeable with postage at the rates prescribed for mailings outside the county of publication, except copies of publications other than weeklies addressed for local delivery by letter carriers subject to the per copy rate.

The foregoing rates apply to copies for delivery in all parts of the United States, including Alaska and Hawaii; also Puerto Rico, the Virgin Islands, Canal Zone, Guam, Philippines, United States Samoa, the United States Naval Training Station, Guantanamo, Cuba; United States naval vessels in foreign waters, and other places where United States mail service is in operation, the advertising rates according to zones being chargeable on the advertising portions of publications subject to such rates.

(a) The letter-carrier rates also apply to copies of publications other than weeklies admitted to the second class of mail matter or readmitted on account of change in office of publication subsequent to June 28, 1932, when mailed at the office of entry for delivery by letter carriers at another post office where the publishers' headquarters or general business offices are located, unless the postage chargeable at the pound rates from the office of mailing is higher, in which case such higher rates apply.

(b) In the case of publications mailed to points outside of the county, if there are more than 32 individually addressed copies or packages of unaddressed copies to the pound, the rates are as follows:

(c) Where the total weight of any one edition or issue of a publication mailed to any one zone does not exceed 1 pound, the rate of postage is 1 cent for all the copies going to the same zone.

ADDITIONAL ENTRY

The 1-cent-per-pound rate and the "free-in-county" privilege do not apply to copies of publications mailed at additional entry points outside county of publication; such copies, including weeklies, are subject to the rates for matter addressed to points outside of county, except, however, that copies of publications other than weeklies addressed for local delivery by city or village letter carriers at additional entry offices take the letter-carrier rates.

FOREIGN COUNTRIES

The pound rates are applicable to copies for the following-named_foreign countries: Argentina, Bolivia, Brazil, Chile, Colombia, Costa Rica, Cuba, Dominican Republic, Ecuador, Fernando Po, and Spanish Guinea (including Annobon Island), Guatemala, Haiti, Republic of Honduras, Mexico, Morocco (Spanish zone), Nicaragua, Panama, Paraguay, Peru, Salvador (El), Spain (including Balearic Islands, Canary Islands, and the Spanish possessions in northern Africa (including Ceuta, Melilla, Tangier, Alhucemas, Chaferinas or Zafarani Islands, and Penon de Velez de la Gomera)); also Andorra and Rio de Oro (including Villa Cisneros, Cabo Juby, La Aguera and Cabo Blanco); Uruguay and Venezuela, the eighth zone rate applying to the advertising portion of publications subject to the zone rates.

For other foreign countries, except Canada and Newfoundland, the rate is 12 cents for each 2 ounces or fraction thereof, payable by stamps affixed.

CANADA AND NEWFOUNDLAND (INCLUDING LABRADOR)

On publications issued as frequently as six times a week the pound rates apply. On publications issued less frequently than six times a week the rate is 1 cent for each 4 ounces or fraction thereof, calculated on the weight of each package, payable by stamps affixed. (Copies addressed for delivery from the same post office may be placed in one package addressed to such post office and the stamp affixed to the outside wrapper.)

TRANSIENT SECOND-CLASS RATE

Copies of publications of the second class mailed by others than the publishers or registered news agents, and sample copies mailed by the publishers in excess of the quantity entitled by law to be sent at the pound rates, and copies mailed by the publishers to others than subscribers or to persons who are not properly includible in the legitimate list of subscribers required by the law, are subject to postage at the rate of 1 cent for each 2 ounces or fraction thereof, except when the postage at the rates prescribed for fourth-class matter is lower, in which case the latter rates shall apply, computed on each separately addressed copy or package of unaddressed copies, and not on the bulk weight.

SAMPLE COPIES

Copies mailed for bona fide sample-copy purposes and properly marked as such may be accepted for mailing, to the extent of 10 percent of the total weight of mailings to subscribers during the calendar year and not in excess of three times to the same person during the calendar year, at the publishers' second-class pound rates of postage.

Sample copies mailed in excess of the limits referred to are subject to postage at the transient second-class rate hereinabove set forth. No sample copies may be accepted free of postage.

COPIES MAILED ON BEHALF OF ADVERTISERS

When copies are circulated in pursuance of an agreement with advertisers, or when advertising is solicited and inserted in a publication upon the understanding that additional copies will be mailed, the copies are not acceptable at the secondclass pound rates as samples or as subscribers' copies, but all of such copies are subject to postage at the transient second-class rate.

STATEMENT OF THE OWNERSHIP, MANAGEMENT, CIRCULATION, ETC., REQUIRED BY THE ACT OF CONGRESS OF AUGUST 24, 1912, AS AMENDED BY THE ACTS OF MARCH 3, 1933, AND JULY 2, 1946

EXTRACTS FROM THE POSTAL LAWS AND REGULATIONS

SEC. 537. It shall be the duty of the editor, publisher, business manager, or owner of every newspaper, magazine, periodical, or other publication to file with the Postmaster General and the postmaster at the office at which said publication is entered, not later than the 1st day of October of each year, on blanks furnished by the Post Office Department, a sworn statement setting forth the names and

post-office addresses of the editor and managing editor, publisher, business manager, and owners, and, in addition, the stockholders, if the publication be owned by a corporation; and also the names of known bondholders, mortgagees, or other security holders; and also, in the case of daily and weekly, semiweekly, [and] triweekly newspapers, there shall be included in such statement the average number of copies of each issue of such publication sold or distributed to paid subscribers during the preceding 12 months: Provided, That the provisions of this paragraph shall not apply to religious, fraternal, temperance, and scientific, or other similar publications: Provided further, That it shall not be necessary to include in such statement the names of persons owning less than 1 per centum of the total amount of stock, bonds, mortgages, or other securities. A copy of such sworn statement shall be published in the second issue of such newspaper, magazine, or other publication printed next after the filing of such statement. Any such publication shall be denied the privileges of the mail if it shall fail to comply with the provisions of this paragraph within ten days after notice by registered letter of such failure. (U. 2. All editorial or other reading matter published in any such newspaper, magazine, or periodical for the publication of which money or other valuable consideration is paid, accepted, or promised shall be plainly marked "advertisement. Any editor or publisher printing editorial or other reading matter for which compensation is paid, accepted, or promised without so marking the same, shall upon conviction in any court having jurisdiction, be fined not less than fifty dollars ($50) nor more than five hundred dollars ($500). (U. S. C., 1940 edition, title 39, section 234; Public Law 482, approved July 2, 1946.)

3. The statement required by this section shall be made in duplicate, on Form 3526, and both copies delivered to the postmaster at the office of entry of the publication. The postmaster shall forward one copy to the Third Assistant Postmaster General, Division of Newspaper and Periodical Mail, and retain the other in the files of the post office. To enable publishers to file such statement promptly, postmasters shall furnish them copies of Form 3526 at least 10 days prior to the 1st day of October of each year.

4. Postmasters shall obtain for the files of their offices a copy of the issue of each publication at their respective offices, in which the required sworn statement is published.

5. Postmasters shall give prompt and careful attention to the making and filing by publishers of the statements required by this section, and promptly report to the Third Assistant Postmaster General the failure of any publisher to file such statement, or to publish it in the second issue of the publication printed next after it has been filed, but in no case shall a publication be denied the privileges of the mail except upon departmental instructions.

6. Where exemption is claimed from compliance with the provisions of this section, the postmaster shall request from the publisher a statement showing the ground on which such exemption is claimed and forward it to the Third Assistant Postmaster General, Division of Newspaper and Periodical Mail, together with a copy of the publication.

SEC. 535. Whoever shall knowingly submit or cause to be submitted to any postmaster or to the Post Office Department or any officer of the Postal Service, any false evidence relative to any publication for the purpose of securing the admission thereof at the second-class rate, for transportation in the mails, shall be fined not more than five hundred dollars. (Act of March 4, 1909, 18 U.S. C. 353.) Whoever, having taken an oath before a competent tribunal, officer, or person, in any case in which a law of the United States authorizes an oath to be administered, that he will testify, declare, depose, or certify truly, or that any written testimony, declaration, deposition, or certificate by him subscribed, is true, shall willfully and contrary to such oath state or subscribe any material matter which he does not believe to be true, is guilty of perjury, and shall be fined not more than two thousand dollars and imprisoned not more than five years. (Act of March 4, 1909, 18 U. S. C. 231).

INSTRUCTIONS TO POSTMASTERS

Each statement should be examined carefully when submitted to see that it has been properly executed and contains all the information required by the law, and, if complete, one copy should be promptly forwarded to the Third Assistant Postmaster General, Division of Newspaper and Periodical Mail, and the other
