Embezzling the King's Stores.

Having Naval Stores in his Possession.

6. Offences against Public Justice.

Against a Constable, for a negligent Escape. D. in his custody, under and by virtue of a warrant of one of his Majesty's justices of the peace, on suspicion of having feloniously ravished and carnally known one A. Misdemeanor at Common Law.

Breach of Prison.

Omit the word "feloniously," if the prisoner were in custody for any offence under felony, or for a debt. See stat. 16 Geo. 2, c. 31, s. 2.

Rescue.

Omit the word "feloniously," in all cases (excepting murder, see stat. 25 Geo. 2, c. 37, s. 9), where the party rescued is not convicted of the offence; and even in cases where he has been convicted, if the offence be under felony. See stat. 1 & 2 Geo. 4, c. 88, s. 1, 2. 4 Geo. 4, c. 54, s. 1.
