ARRANGEMENT OF CLAUSES.

Recital of the 13th, 14th, 15th, 16th, and 17th Sections of the Highways Act, 5 & 6 Will. 4. c. 50., and enacting that Power be given to Justices assembled at Special Sessions for the Highways to unite Parishes into Districts for the Purposes of this Act, and to appoint a Surveyor of Highways, provided that Ten Days Notice of Intention to propose such Union and Appointment of Surveyor shall be given; Sect. 1.

Session to be adjourned to a Special Session, and Notice given to Surveyors of Highways to show Cause against Union; 2.

Justices to send Notice of Appointment of Surveyor, and of the Union of Parishes, to the Clerk of the Peace of the County, and to the Surveyor of the Highways for each Parish; 3. Power to Justices to determine the Salary of the Surveyor, and the Proportion payable by each District, and the Amount of Salary, to be limited to a Sum calculated on the Sum of One Halfpenny per Annum per Perch of Cartway, and Turnpike Road having paid Surveyor not to be considered Portion of Cartway; 4. District Surveyor to give Security for Fidelity; 5.

Duties of Surveyor defined, i. e. the Application of Funds raised under Statute 5 & 6 Will. 4. c. 50., and the like Powers as a Surveyor under that Act, except the Power of levying Rates; provided that no District Surveyor under present Act shall expend Money levied any One of the Parishes, except for the Use of the Parish, unless with the Consent of the Vestry; 6.

The Surveyor under the Statute 5 & 6 Will. 4. c. 50. to make the Rate required under that Statute, and pay it over to the District Surveyor to be appointed under this Act as the Justices shall direct; District Surveyor to render Account, and no Parish Surveyor to be required to pay over Money without Notice from District Surveyor of his Intention to apply to Justices for an Order for this Purpose; 7.

Surveyor of each Parish to put in force the 74th Section of the Statute 5 & 6 Will. 4. as to impounding Cattle, and Application of Penalties and Charges, and to keep Footpaths in order; 8.

Power

Inhabitants of any Parish are to elect a Surveyor under Statute 5 & 6 Will. 4.; 9.

Power to Justices to remove District Surveyor in case of Neglect of Duty, and to appoint another; 10.

Act not to extend to Scotland or Ireland, or the County of Middlesex; 11.

Act not to be put in force unless there are Sixty Miles of Cartway in the District; 12.

Act to continue in force until Twenty-fifth March One thousand eight hundred and fifty-one, and to the End of the then next Session of Parliament; 13.

Act may be altered in present Session; 14.

Empower Justices of the Peace to unite Parishes into Districts, and to appoint a Surveyor of Highways to each District.

HEREAS an Act was passed in the Fifth and Sixth Years Preamble. of King William the Fourth, intituled "An Act to con- 5 & 6 W. 4.

"solidate and amend the Laws relating to Highways in c. 50.

"that Part of Great Britain called England," and it was thereby 5 enacted, that Application might be made to Justices assembled at Sessions to unite Parishes to form a District for the Purpose of having One District Surveyor appointed, and to nominate a fit Person to be returned to the Justices, with the Salary which the Inhabitants were willing to pay; and it was also thereby provided, 10 that on such Application the Justices might unite Two or more Parishes into a District or Districts, and appoint a fit Person as Surveyor; and it was also provided, that the Name of such Surveyor should be transmitted to the Clerk of the Peace, and enrolled, and the Parishes so united should form a District for the Purposes 15 of the said Act, for the Space of Three Years next following, until Notice shall have been given that such Union should cease as in the said Act is directed; and it was thereby provided, that such Surveyor should, except as to levying Rates, have the same Powers
