Confirming certain Provisional Orders of the General Board of Health, and for other Matters relative to the Public Health and the Improvement of Towns and populous Places.

HEREAS the General Board of Health have, in pursuance Preamble. of the Public Health Act, 1848, made, published, and deposited, according to the Provisions of the Act, certain Provisional Orders mentioned in the Schedule to this Act annexed, 5 and it is expedient that the said Orders should be confirmed: Be it therefore enacted by the Queen's most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, That the Provisional Orders of the General Confirmation 10 Board of Health referred to in the Schedule to this Act annexed Provisional shall be and the same are hereby confirmed, and shall from and after Orders of the passing of this Act be absolute, and be as binding and of the like the General Force and Effect as if the Provisions of the same had been expressly Health. enacted in this Act.

III. And whereas it is expedient that the Local Boards of Health 5 for the Execution of the Public Health Act, 1848, should be invested for lighting. with certain Powers not included in that Act: Be it therefore enacted, That the said Local Boards constituted under the said Public Health Act may, with the Consent of the General Board of Health, contract for any Period not exceeding Three Years at any one Time with any 10 Company or Person for the Supply of Gas or Oil, or other Means of lighting the Streets, Roads, and other open Places, Markets, and public Buildings within their respective Districts, and may provide such Lamps, Lamp Posts, and other Works as such Local Boards respectively may think necessary for lighting the same; and the 15 Expenses incurred by any such Local Board in so doing shall be defrayed out of the general or special District Rates (as the Nature of the Case may require) levied under the said Public Health Act.

IV. And be it enacted, That whenever the General Board of may provide Health shall certify, according to the Provisions of the said Public 20 Health Act in that Behalf, that any Burial Ground is in such a State as to be dangerous to the Health of Persons living in the Neighbourhood thereof, the Local Board of Health of the District in which such Burial Ground may be situated may, with the Consent of the said General Board, procure, lay out, and fit up some convenient 25 Place wherein Interments may take place on Conditions to be settled by the said General Board, and (so far as relates to the Interment of Members of the Church of England) approved by the Bishop of the Diocese in which such District may be situated; and the Expenses incurred by any such Local Board of Health under this Enactment 30 shall be defrayed out of the special or general District Rates (as the Nature of the Case may require) levied under the said Public Health Act.

And whereas it appears by the Report of the Superintending of Health in Inspector appointed to inquire into the sanitary Condition of the 35 City of Worcester that the Mayor, Aldermen, and Burgesses of that City are the Owners of a certain Plot of Ground in or near the Centre of the said City, that such Plot was formerly used as a Burial Ground, but that Burial therein has been discontinued for upwards of merly used Forty Years, that from the Year One thousand eight hundred and 40 six to the Year One thousand eight hundred and thirty-eight the said Plot was used as a Sheep Market, and that it now remains in a dirty Condition,

as a Burial Ground.

Condition, and is considered a Nuisance to the Neighbourhood: And whereas it appears by the said Report that the Mayor, Aldermen, and Burgesses of the said City are unable to build upon or let the said Plot of Ground for secular Purposes without the Authority of 5 Parliament: Be it therefore enacted, That the said Mayor, Aldermen, and Burgesses of the City of Worcester may build upon, let, or otherwise make use of the said Plot of Ground in such Manner and for such Purpose as they may think fit for promoting the Health, Convenience, or Improvement of the said City, and may defray the 10 Expense of so doing out of the general or special District Rates leviable under the said Public Health Act.

VII. And be it declared and enacted, That the Expression "Cor- Construction porate Borough" whenever used in the Public Health Act, 1848, Expressions 25 shall be construed to include any City, Borough, Port, Cinque Port, used in the or Town Corporate named in the Schedules annexed to an Act Public passed in the Sixth Year of the Reign of King William the Fourth, 1848. intituled "An Act to provide for the Regulation of Municipal Cor"porations in England and Wales," and to any City, Borough, Port, 30 Cinque Port, or Town Corporate incorporated by Charter granted or to be granted in pursuance of that or any subsequent Act; and the Word "Burgesses" wherever used in the said Public Health Act shall be construed to mean Citizens in the Case of a City.

VIII. And be it enacted, That this Act shall be deemed to be 35 incorporated with the Public Health Act, and shall be as if this Act and the said Public Health Act were One Act.

IX. And be it enacted, That in citing this Act in any other Act Short Title of Parliament, or in any Proceeding, Instrument, or Document what- of this Act. soever, it shall be sufficient to use the Words and Figures "The 40 Public Health Supplemental Act, 1849."
