VII. And be it further enacted, That all Affignments, Bargains, Sales, Orders, Contracts, Agreements, or Securities whatfoever, which shall be given or made by any Perfon entitled to any fuch Allowance, or by any Half Pay Officer of Royal Marines, relating to fuch Allowances, or to their Half Pay, fhall be abfolutely null and void, to all Intents and Purposes.

VIII. And be it further enacted, That all Letters and Packets fent by the Direction of the Treafurer of the Navy in carrying this A& free of Poftage. into Execution, fhall be free from the Duty of Poftage, and fhall be tranfmitted under Covers, with the Words "Pursuant to Act of Farliament Forty-ninth of George the Third," printed upon the fame; and fhall be tranfmitted by the Perfon appointed to fend Letters and Packets under the Authority of an Act, paffed in the Thirty-fifth Year of the Reign of His prefent Majetty, intituled, An Ad for cflablishing a more eafy and expeditious Method for the punctual and frequent Payment of the Wages and Pay of certain Officers belonging to His Majefly's Navy, under and fubject to the fame Rules, Regulations, and Penalties, as are preferibed by the faid A&t, with refpect to the Letters and Packets thereby authorized to be sent free of the Duty of Poftage.

IX. And be it further enacted, That all and every fuch Remittance Bill and Remittance Bills herein-before directed to be made out, and which fhall be paid by the Treafurer of the Navy or Paymaster of Marines in Manner as aforefaid, fhall be deemed and taken as good and fufficient Vouchers to the Treafurer of the Navy and Paymafter of Marines, for fo much Money as fhall have been fo directed to be paid on fuch Bill or Bills refpectively, and as fhall have been fo paid by either of them thereon, and fhall be allowed as fuch in paling their refpeétive Accounts.

X. And be it further enacted, That, from and after the paffing of this Act, if any Perfon fhall wilfully and knowingly perfonate, or falfely affume the Name or Character of, or procure any other Perfon to perfonate, or falfely to affume the Name or Character of any Person entitled, or fuppofed to be entitled, to any fuch Allowance aforesaid, or of any Officer of the Royal Marines on Half Pay as aforefaid, in order to receive fuch Allowance or Half Pay, or any Part thereof, every fuch Perfon fo offending, and being lawfully convicted thereof, fhall be deemed guilty of Felony, and may be tranfported for fuch Period, not exceeding Fourteen Years, as the Court fhail adjudge.

XI. And be it further enacted, That if any Perfon fhall knowingly and wilfully forge or counterfeit, or caufe or procure to be forged or counterfeited, or knowingly and wilfully act or affift in forging and counterfeiting, the Name or Hand-writing of any Perfon or Officer entitled to any fuch Allowance, or to fuch Half Pay, or of any Person or Perfons required by any Rules or Regulations made under and by virtue of this A&, to fign any Remittance Bill, Certificate, Voucher, or Receipt in relation to the Payment of any fuch Allowance or Half Pay, for and in order to the receiving or obtaining any Money on any fuch Allowance or Half Pay; or fhall utter as true any faife, forged, or counterfeited Remittance Bill, Certificate, Voucher, or Receipt, knowing the fame to be forged or counterfeited, with an Intention to defraud any Perfon whatfoever, every fuch Perfon fo offending, being thereof lawfully convicted, fhall be and he is hereby declared and adjudged to be guilty of Felony; and may be transported for fuch Period, not exceeding Fourteen Years, as the faid Court fhall adjudge.

XII. And be it further enacted, That all Orders, Certificates, Bills and CerVouchers, Remittance Bills, and Receipts, for or relating to any fuch tificates, &c. Allowance or Halt Pay as aforefaid, fhall be free from all Duties of exempted from Stamp Duties. Stamps, and be good, valid, and effectual, although the fame fhall not have been ftamped; any Thing in any A&t contained to the contrary notwith@tanding.

An Act to authorize the Principal Officers of the Customs in the British Colonies and Plantations in America and the West Indies to examine Witneffes on Oath. [12th May 1809.]

W HEREAS by an A&t paffed in the Twenty-fixth Year of the Reign of His prefent Majefty, intituled, An Ad for 26 G. 3. c. 40% regulating the Production of Manifefts, and for more effectually preventing § 28. fraudulent Practices in obtaining Bounties and Drawbacks, and in the clandeftine relanding of Goods, the Surveyor-General or Surveyors• General of the Cuftoms in the Port of London, upon Examinations and Inquiries relative to the Revenue of Cuftoms, and to the Conduct of the Officers employed therein, are authorized to examine 'all Perfons who may appear before them upon Oath; and the like Power is alfo given to the Collectors and Comptrollers of the 'Cuftoms at the Out- Ports of Great Britain, by an A&t paffed in 'the Forty-third Year of His Majefty's Reign, intituled, An A&t for 43 G. 3. c. 123. the further Regulation of the Collection of the Duties of Customs in § 2. Great Britain in certain Cafes: And Whereas it is expedient, that • upon the like Examinations and Inquiries to be made by or before the Collectors and Comptrollers of any of the Ports in the British • Colonies and Plantations in America and the West Indies, or by or before fuch other Perfon or Perfons as the Commiffioners of the • Customs in England for the Time being fhall deem fit and proper, to examine and inquire into Matters relative to the Revenue of 'Customs and other Duties, and refpecting the Conduct of the Prin'cipal Officers, and any Officers whatever employed under them, in the British Colonies and Plantations in America and the Weft Indies, • and shall or may from Time to Time appoint for the Purpose of 'making any fuch Examinations and Inquiries, the like Power to • examine all Perfons who may appear before them upon Oath, fhould be given to the faid Collectors and Comptrollers, and fuch other • Perfon or Perfons aforefaid refpectively;' Be it therefore enacted by the King's moft Excellent Majetty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, from and after the paffing of this Act, all and each and every Perfon and Perfons who fhall be examined as a Witnefs or Witneffes, on any Enquiry directed by the Commiffioners of the Cuftoms in Eng. land for the Time being, or any Four or more of them, to be made in America or the West Indies, relative to His Majefty's Revenue of Cuftoms or other Duties there, or to the Conduct of the Officers employed in the Collection thereof, by or before any Collector and Comptroller of the Cuftoms or either of them, at or belonging to any Port in the British Colonies and Plantations in America or the West Indies, or by or before fuch other Perfon or Perfons as fhall be appointed by the said Commiffioners, or any Four or more of them, for

the Purpose aforefaid, fhall and they are hereby respectively required to deliver his, her, or their Teftimony on Oath, to be adminutered by the faid Officer or Officers, or the faid other Perfon or Perfons so appointed as aforesaid, refpectively, who fhall examine him, her, or them, or before whom he, the, or they shall be examined as aforefaid, and fuch Officer and Officers, and Perion or Perions refpectively, are hereby authorized to administer fuch Oath accordingly.

II. And be it further enacted, That if any Perfon or Perfons whomfoever fhall be convicted of making a falfe Oath touching any of the Facts directed or required by this Act to be teftified on Oath, or of giving falfe Evidence on his, her, or their Examination on Oath as aforefaid, by or before any Collector and Comptroller of the Cuftoms, of, at, or belonging to any Port in the West Indies or America, or either of them, or fuch other Perfon or Perious appointed as afor faid, in conformity to the Directions of this Act, iuch Perfon or Perfons fo convicted as aforefaid fhall be deemed guilty of Perjury, and fhall be liable to the Pains and Penalties to which Perfons are liable for wilful and corrupt Perjury.

at any Port of Europe, in order to be exported to the
principal Ports in the British Colonies and Plantations in
North America.

Act of the Forty-fixth Year of the Reign of His prefent Majefty, tor allowing an Intercourse between the Colonies of His Majefty in North America and Malta and Gibraltar, should be extended to other Parts of Europe;' Be it therefore enacted by the King's most Excellent Majefty, by and with the Advice and Coufent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, from and after the paffing of this Act any Fruit, Wine, Oil, Sait, or Cork, the Produce of any Part of Europe South of Cafe Finiflerre, may be shipped and laden in any Port or Place whatever in fech Parts of Europe for Exportation direct to the feveral Ports hereafter mentioned; that is to fay, the Port of St. John's in the Province of New Brunswick, St. John's in the land of Newfoundland, Quebec in American Ports the Province of Canada, Sydney in the Ifland of Cape Breton, Halifax tioned, in British and Shelburn in the Province of Nova Scotia, and Charlotte Town in Prince Edward Ifland, all in North America, on board any British Ship or Veffel owned, navigated, and registered according to Law, which fhall have arrived at fuch Port or Piace in Europe with Articles of the Growth or Produce of the faid Colonies, or with Fith taken and cured by His Majesty's Subjects carrying on the Fisheries from any of the faid Colonies or Plantations, or from Great Britain or Ireland: Provided always, that upon the Arrival of fuch Ship or Veffel in any make Uath, &c. Port of Europe with any fuch Cargo as aforefaid, the Mafter or other Perfon having or taking the Charge or Command of fuch Ship or

Veffel fhall make Oath before the British Conful there refident, or if there fhall be no British Conful there refident, then before Two known British Merchants there refident, (which Oath he and they respectively is and are hereby authorized and required to adminifter), that the whole Cargo of fuch Ship or Veffel is entirely the Growth and Produce of the faid British Colonies, or the Produce of the British Fisheries in North America really and bona fide taken and cured by His Majesty's Subjects carrying on the faid Fisheries from fome or one of the faid Colonies or Plantations, or from Great Britain or Ireland; and before the faid fhip or Veffel fhall clear out from fuch Port or Place in Europe for any of the feveral enumerated Ports in the British Colonies in North America, the Malter or other Perfon having the Charge of fuch Ship or Veffel fhall, in like Manner, make Oath before fuch Perfon or Perfons as afort faid, (which Oath fuch Perfon or Perfons are hereby authorized to adminifter), that the feveral Articles the Produce of Europe, fhipped on board fuch Ship or Veffel, have been fo fhipped in return for the Cargo of Articles of Produce of the Britif North American Colonies, or of the Fisheries carried on from thence, previoully brought by fuch Ship or Veffel to fuch Port or Place in Europe as afore said.

II. And be it further enacted. That upon the Importation of the Articles on Tınfaid Articles, the Produce of Europe, into the feveral Ports before portation fubject enumerated, the same shall be subject and liable to the Payment of fuch to Duty. Duties as Goods of the like Denomination or Defcription are now subjeЯ and liable to, upon being legally imported into the faid feveral Ports.

III. And be it further enacted, That if any Goods, Wares, or Ne Goods but Merchandize of the Growth, Production, or Manufacture of Europe, fuch as before fuch as are herein-before enumerated, fhall be laden and shipped be exported, &c. except on board any fuch Ship or Veffel as aforefaid, in order to be exported on Pain of Forto any of the faid feveral other Ports before enumerated, or to any feiture, except other Port or Place whatever to His Majefty belonging, or which European Salt, fhall hereafter belong to or be in the Poffeffion of His Majefty, or British Goods His Heirs and Succeffors, in Afia, Africa, or America, all fuch for the British Goods, Wares, and Merchandize, together with the Ship or Veffel in Scotia, &c. and or on board which the fame shall be laden or shipped, and all her Guns, Wines of the Furniture, Ammunition, Tackle, and Apparel, fhall be forfeited: Madeiras. Provided always, that nothing herein contained fhall fubject to Forfeicure any Salt, the Produce of Europe, intended for the Use of the British Fitheries of Nova Scotia, Newfoundland, or Quebec, fhipped in any Part of Europe whatever; or any Goods fit and neceffary for the Fishery in any of the British Colonies or Plantations in America, being the Growth, Produce, or Manufacture of Great Britain or Ireland, or of the Iflan's of Guernsey and Jerfey, fhipped and laden in the faid Idlands refpectively, by any of the Inhabitants thereof; or any Wines of the Growth of the Madeiras or the Weflern Islands of Azores, fhipped and laden at thofe Places refpectively, the faid Goods, Wares, and Merchandize refpe&tively being fhipped and laden according to the Laws in force, on and immediately before the paffing of this A&t.

IV. the fame fhall and may be prosecuted, fued for, recovered, and divided in the fame Manner and Form, and by the fame Rules and Regulations, in all Refpects as far as the fame are applicable, as any other Forfeiture impofed by any Act or Acts made for the Security of the Revenue, or for the Regulation or Improvement thereof, or for the Regulation of Trade or Navigation, and which were in force on and immediately before the paffing of this Act, may be profecuted, fued for, recovered, and divided in any British Colony or Plantation in America.

CA P. XLVIII.

An Act to amend and render more effectual an A&t paffed in the laft Seffion of Parliament, for enabling His Majesty to eftablish a Permanent Local Militia Force in Scotland, under certain Restrictions for the Defence of the Realm.

[20th May 1809.] "48 G. 3. c. 150. recited; Deficiencies and Vacancies may be directed to be fupplied by Order of Secretary of State without His Majelty's Warrant. § 1. Volunteers allowed to enter whether any Ballot "directed or not, until Local Militia is complete. § 2. Vacancies "fhall be filled up notwithstanding the Number of fuch Militia and "Volunteers exceed Six times the Quota of the Regular Militia. $3. "But fuch Deficiencies fhall not be fupplied until the Number be "reduced below the Proportion required. § 4. Local Militia Men may enlift into the Regular Militia, [of their own County, See "49 G. 3. c. 129.] except during annual Training. 5. Penalty on Officer, &c. enlifting a Local Militia Man during fuch Period "of Training 2cl. § 6. How Vacancies by Promotion of Corporals "and Serjeants, and by enlifting, fhall be filled up. 7. Deputy "Lieutenants may make new Apportionments where requifite. § 8. "Lieutenancy fhall fix by Ballot the Order in which Divifions and "Parishes fhall fupply Deficiencies hy Promotion of Privates to be "Serjeants or Corporals. 9. Deputy Lieutenants shall regulate Inequalities of Numbers in Divifions or Parishes. § 10.

XI. Provided always, and be it further enacted, That from and after the First Day of January One thoufand eight hundred and ten, fo much of the faid Recited Act as enacts, that any Person who shall voluntarily enrol! himself to serve in the Local Militia under the said recited A&t of the laft Seffion of Parliament (except Members of Volunteer Corps transferring themselves) fhall be entitled to receive the Sum of Two Guineas, to be paid upon his Enrolment, over and above any Sum to which he may be entitled for Neceffaries, shall be and the fame is hereby repealed: Provided always, that it shall and may be lawful for the Heritors of any Parish, being Proprietors of Lands within the Parish to the Extent of at leaft One hundred Pounds Scots of valued Rent appearing in the Land Tax Books of the County within which fuch Parish is fituated, at any Meeting to be holden for that Purpose, to be called by any Two or more fuch Heritors, upon Notice to that Effect given from the Pulpit on any Sunday at least Five Days previous to fuch Meeting, to agree to give a Bounty to any Perfons voluntarily enrolling themfelves in the Local Militia for fuch Parish, provided that fuch Bounty or Sum of Money shall in no Case exceed the Sum of Two Guineas for each Perfon, to be paid upon
