CA P. XLIII.

An Act for regulating the Mode in which the Average Price of
Brown or Mufcovado Sugar, exclufive of the Duty thereon, is
to be afcertained under the Provifions of an Act paffed in the
Forty-fixth Year of His prefent Majefty. [12th May 1809.]

WHEREAS Doubts have arifen, as to the Rate of Duty paid

In afcertaining the Average

deducted from the Sale Price of fuch Sugar in order to afcertain the average Price thereof, exclufive of the Duty of Cuftoms, and according to which Average the Lords Commiffioners of His Majefty's Treafury are to be governed in carrying into Effect the • Powers vefted in them by an Act, paffed in the Forty-fix:h Year of His prefent Majefty's Reign, intituled, An Act for granting to His 46 G. 3. c. 42. Majefty, during the prefent War, and for Six Months after the Expiration thereof by the Ratification of a Definitive Treaty of Peace, additional Duties on certain Goods, Wares, and Merchandize, imported into and exported from or brought or carried Coafawife within Great Britain: And whereas it is neceffary to remove thofe Doubts;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aff-mbled, and by the Authority of the fame, That the Duties of Customs which fhould have been, and which fhall be deducted from the Price of Brown Mufcovado Sugar to be published in the London Gazette for the Purpose of enabling the Lords Commiffioners of the Treafury to exercise the Power and Authority vefted in them by the faid A&t. with respect to the Sufpenfion in the whole or in part of the additional Duties thereby granted, fhall be at and after the Rate of Thirty Shillings for every Hundred Weight of fuch Sugar; and that the Average Price thereof, to be so published in the London Gazette for the Purpose aforefaid, fhall be exclufive of the faid Duty of Thirty Shillings for every Hundred Weight of fuch Sugar; and that the Average Prices of fuch Sugar, to be fo publifhed for the Purpose aforefaid, fhall be made up and published in the London Gazette accordingly, at the feveral Periods directed by the faid recited Act, any Law, Cuftom, or Usage to the contrary notwithstanding. At may be altered this Seffion. § 2.

THEREAS it is expedient to permit Goods, Wares, and Merchandize, brought into Great Britain as Prize, and reftored by the Court of Admiralty, to be fold or transferred for the Purpose of Exportation, without Payment of the Home Confumption Duties;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Content of the Lords Spiritual and Temporal, and Commons, in this prefent Par

liament affumbled, and by the Authority of the fame, That any Goods, Wares, or Merchandize, which shall have bɛen taken as Prize fince the Commencement, or may be taken during the Continuance of Hoftilities, and which fhall have been, or may be brought into Great Britain by any of His Majelty's Ships of War, or by any Private or other Ship or Veffel having Commiffion from the Lord High Admiral of Great Britain, or the Commiffioners for executing the Office of Lord High Admiral of Great Britain for the Time being, or which have been, or may be feized by any Non-commiffioned Veffel or otherwife, as Droits of Admiralty, and which under any Decree of the Court of Admiralty fhall have been or fhall be restored to the Proprietor or Proprietors thereof, or to his or their Agent or Agents, fhall not be fubject or liable to the Payment of any Duty of Cuftoms or Excife on account of any Sale or Transfer thereof within this Kingdom, provided that fuch Goods, Wares, and Merchandize are not removed (except for the Purpofe of Exportation only) from the Warehouse or Warehouses wherein they fhall have been or may be depofited upon the first landing thereof; any Law, Cuftom, or Ulage to the contrary thereof in any wife notwithstanding.

Compaffionate Lift of the Navy, and of Half Pay to Officers
of the Royal Marines.
[12th May 1809.]

WHEREAS it would gs receiving any Sums of Money or

HEREAS it would greatly tend to the Comfort and Accom

Allowances in confequence of their Names being inferted in the Compaffionate Lift of the Navy, eftablished under and authorized by virtue of His Majefty's Order in Council of the Fifteenth Day of February One thoufand eight hundred and nine; and alfo of the Officers of the Royal Marines entitled to Half Pay, if fuch Allowances and Half Pay were paid to the Perfons refpe&ively entitled thereto, at or near to the Places of their Refpective Residences: May it therefore please Your Majefty that it may be enacted;' and be it enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That, from and after the Twenty-ninth Day of September One thousand eight hundred and nine, it fhall be lawful for the Lord High Admiral of Great Britain, or the Commiffioners for executing the Office of Lord High Admiral of Great Britain, for the Time being, or any Three or more of them, to order and direct that all fuch Allowances and Half Pay fhall be paid to the Perfons refpectively entitled thereto at or near to the Parishes or Places of their Refidence, in any Part of His Majefty's Dominions, or in Foreign Parts, by any Perfons appointed to pay the fame.

II. And be it further enacted, That it fhall be lawful for the faid Lord High Admiral, or Commiffioners of the Admiralty, or any ulations as they Three or more of them, for the Time being, to make fuch Orders, Rules, and Regulations, and from Time to Time to alter the fame in

III. And be it further enacted, That from and after the Twenty- Perfons entitled ninth Day of September Oue thoufand eight hundred and nine, if to fuch AllowanPerfon who fhall be entitled to receive any fuch Allowance (the Names of fuch Perfons, and the Sums they are refpectively entitled to, being previously and from Time to Time tranfmitted to the Commiffioners of the Navy ;) or if any Officer of the Royal Marines on Half Pay, fhall be refpectively defirous to receive fech Allowance or Half Pay from any Receiver-General of the Land Tax in Great Britain, Collector of the Cuftoms at any Port in Great Britain or Ireland, Collector of the Excife for any Collection in Great Britain or Ireland, or Clerk of the Checque at any Dock Yard in Great Britain, near to the Place of his Refidence, it fhall be in the Power of fuch Perfon fo entitled to any Allowance, to apply at the Time of iffuing fuch Allowances by Letter to the Commiffioners of the Navy, at their Office in Somerfet Place; and for any Officer of the Royal Marines on Half Pay, at the Time of iffuing fuch Half Pay to apply to the Paymaster of Marines at his Office in London, to have fuch Allowance or fuch Half Pay paid by the faid Receiver-General of the Land Tax, Collector of the Cuftoms, Collector of the Excife, or Clerk of the Checque, and fhall at the fame Time tranfmit fuch Vouchers and Documents as fhall be required by the faid Lord High Admiral cr Commiffioners of the Admiralty, for the Time being, or any Three of them.

IV. And be it further enacted, That the faid Commiffioners of the Navy, or the faid Paymaster of Marines, on being fatisfied of the of the Navy, &c. Justice of the faid Claim, fhall refpectively order and direct Two to direct Two Remittance Bills to be made out for the Allowance or Half Pay due Duplicate Reto fuch Perfon or Officer; which faid Bills fhall be Duplicates of each be made out, other, and fhall be joined together by oblique Lines, Flourishes, or payable to fuch Devices, and fhall be made payable to fuch Perfon, or to fuch Officer, Perfons by the by the Receiver-General of the Land Tax, Collector of the Cuftoms, Receiver-Gene Collector of the Excife, or Clerk of the Checque to whom the faid ral, &c. Remittance Bills shall be addressed; and fuch Remittance Bills, being numbered and dated, fhall be figned by a Commiffioner of the Navy, or the faid Paymaster of Marines, and shall be attefted by a Person to be respectively appointed by the Treasurer of the Navy or Paymaster to collect and manage the aforefaid Documents and Vouchers, to prepare fuch Remittance Bills, and keep Accounts thereof; and fuch Remittance Bills, being written or printed, fhall be according to the Tenor and Form following, or to the like Effect:

By virtue of the A& 49 George the Third. N. B. The forging of this Remittance Bill, or procuring 'any other Perfon to forge the fame, in order to receive any Part of the Monies hereby payable, is made Felony by the A&t Fortyninth George the Third.'

One Duplicate And fo foon as the faid Bills are made out and figned, the respective Perfons to be appointed by the faid Treasurer or Paymaster fhall cut or caufe them to be cut afunder, through the oblique Lines, Flourishes, named therein, or Devices; and fhall caufe one Duplicate to be tranfmitted to the Perfon or Officer named therein, to whom the Money fhall be made payable, and the other Duplicate to be tranfmitted to the Receiver General of the Land Tax, Collector of the Customs, Collector of the Excife, or Clerk of the Checque, to whom the fame shall be addressed; and if the Duplicate of fuch Bill fhall be produced by the Perfon or Officer to whom the fame fhail be made payable, to fuch ReceiverGeneral of the Land Tax, Collector of the Cuftoms, Collector of the Excife, or Clerk of the Checque, to whom the fame fhall be addreffed, within Six Calendar Months from the Date thereof, he shall carefully examine the fame with the Duplicate tranfmitted to him as aforefaid; and being fatisfied of the Authenticity thereof, and of the Identity of the Perfon or Officer producing the fame to him, he shall immediately pay the Sum mentioned therein to fuch Perfon or Officer, without Fee or Reward, or Deduction on any Pretence whatever, taking a Receipt for fuch Payment on the Back of the Bill; which Bill, and the Duplicate thereof, being tranfmitted by the Perfon who fhall pay the fame to the Treasurer of the Navy, fhall be immediately repaid by the faid Treasurer to fuch Receiver General, Collector of the Customs, Collector of the Excife, or Clerk of the Caecque, or his Order; and the Payments thus made by the faid Treaturer of the Navy, on account of Marine Officers Half Pay, fhall be re-allowed him out of the Monies iffued to the faid Paymatter; but in case the Duplicate of any fuch Bill fhall not be fo produced, and Payment thereof demanded within Six Calendar Months from the Date thereof, then the faid Receiver-General of the Land Tax, Collector of the Cuftoms, Collector of the Excife, or Clerk of the Checque, fhall return the Duplicate thereof in his Hands to the faid Treasurer or Paymaster at their respective Offices in London, who fhall caufe the

V. Provided always, and be it further enacted. That if any Re- Receiver-Geneceiver-General of the Land Tax, Collector of the Cuitoms, Collector of the Excife, or Clerk of the Checque, to whom the Duplicate of any fuch Bill fhall be tendered for Payment, fhall not have in his Hands Date of its being Duplicate the Publick Monies fufficient to answer the fame, and fhall for that Reafon tendered, in cafe refuse or delay the immediate Payment thereof, fuch Receiver-General he has not Pubof the Land Tax, Collector of the Customs, Collector of the Excife, or Clerk of the Checque, fhall immediately indorfe on the faid Duplicate the Date of its being so tendered to him, and the Caufe of his Refufal or Delay to pay the fame, and fhall appoint thereon for the Payment of the fame fome future Day, within the Space of One Month at the fartheft from its being fo firft tendered to him as aforefaid; and fuch Duplicate, with the Indorsement thereon, fhall be immediately delivered back to the Perfon or Officer prefenting the fame; and if upon Complaint made to the refpective Commiffioners appointed or to be appointed to manage the faid feveral Duties of Land Tax, Cuftoms, or Excife, or to the Commiffioners of the Navy if the Perfon complained of be a Clerk of the Checque, it fhall appear that fuch Receiver General of the Land Tax, Collector of the Cuftoms, Collector of the Excife, or Clerk of the Checque, hath unneceffarily or wilfully refused or delayed the Payment of fuch Bill, or directly or indirectly, by himself or any Perfon under him, received or taken any Fee, Reward, Gratuity, Difcount, or Deduction whatsoever, on account of the Payment of the fame, it fhall and may be lawful to and for any Three or more of the said Commiffioners to convict and fine the Perfon under their Direction fo offending, in any Sum not exceeding Fifty Pounds, according to the Nature and Degree of the Offence; and fuch Fine fhall be levied and recovered in fuch and the fame Manner, to all Intents and Purposes, as any Penalty or Fine may be levied and recovered for any Offence against the Laws of Cuftoms or Excife; and the faid Fine, when recovered, fhall be paid to the Informer or Informers.

VI. And be it further enacted, That if fuch Perfon or Officer to On Certificate of whom the Remittance Bill fhall be made payable, fhall be respectively Infirmity being prevented and difabled by bodily Infirmity from appearing in Perfon produced, the before the faid Receiver-General of the Land Tax, Collector of the ral, &c. anthoCuftoms, Collector of the Excife, or Clerk of the Checque; and fuch rized to pay the bodily Infirmity being properly and fatisfactorily certified by the Contents of the Minister and a Churchwarden or Elder of the Parish where fuch Perfon Bill to the Order or Officer shall refide, or by the Phyfician, Surgeon, or Apothecary attending him, then and in fuch Cafe, the Sum contained in fuch Bill fhall be paid to the Order in Writing of fuch Perfon or Officer, upon producing and giving up to fuch Receiver-General of the Land Tax, Collector of the Cuftoms, Collector of the Excife, or Clerk of the Cnecque, fuch Certificate of bodily Infirmity as aforefaid, together with a Duplicate of the faid Bill, and a proper Receipt on the Back of the fame, figned by the Perfon or Officer in whofe Favour the Bill fhall have been drawn, and witneffed by the Perfon who fhall receive the Money,
