XV. And be it further enacted by the Authority aforefaid, That Recovery of all Fines, Penalties, and Forfeitures, for any Offences against this Act, Penalties. fo far as the fame relates to the faid Duty on Malt, fhall be fued for, levied, and recovered, or mitigated, by the fame Ways, Means, and Methods, as any Penalty or Forfeiture given by any of the Laws of Excife upon Beer, Ale, and other Liquors, can or may be fuɛd for, levied, recovered, or mitigated, or by any Law or Laws of Excife, or by Action of Debt, Bill, Plaint, or Information, in any of His Majefty's Courts of Record at Weflminfler, and that One Moiety of fuch Fines, Penalties, and Forfeitures, fhall be to the Ufe of His Majefty, His Heirs and Succeffors, and the other Moiety to him or them that fhall discover, inform, or fue for the fame.

XVI. And Whereas by an Act, paffed in the Thirty-eighth Year 38 Geo. 5. c. 60. of the Reign of His prefent Majefty, intituled, An Ad for making

perpetual, fubje& to Redemption and Purchafe in the Manner therein flated, the feveral Sums of Money now charged in Great Britain as a Land Tax, for one Year, from the Twenty-fifth Day of March One thousand feven hundred and ninety-eight, the feveral and respective Sums of Money granted to Your Majefty, by a Land Tax, for the Service of the Year One thoufand feven hundred and ninety-eight, which were or fhould be charged on any Manors, Meffuages, Lands, Tenements, or Hereditaments, in Great Britain, are, after the Twenty-fifth Day of March One thousand seven hundred and ninety nine, con'tinued and made perpetual, with a Provision that the feveral Sums of Money charged upon Eftates in ready Money, Debts, Goods, Wares, Merchandize, or Perfonal Eftates, or upon any Perfon or Perfons in refpect of any Publick Office or Employment of Profit in the faid Act mentioned, fhould, after the Twenty-fifth Day of • March One thousand seven hundred and ninety-nine, be ascertained, levied, collected, and paid according to the Directions of any A& or Acts to be paffed for that Purpofe;' Be it therefore enacted,. fifth Day of March One thousand eight hundred and nine, and fhall be afcertained, affeffed, and taxed in fuch Manner and Form as are hereinafter expreffed.

XVII. And be it further enacted, That the feveral and refpective Sums of Money which fhall have been or shall be charged by virtue of the faid recited Act made in the Thirty-eighth Year of His present Majefty's Reign on Perfonal Eftates as aforefaid, shall be and are hereby fet and impofed on the feveral and refpective Parishes, Conftablewicks, Divifions, Allotments, and Places, wherein the fame have been or fhall be so charged by virtue of the faid laft-mentioned Act; and that towards raifing the faid feveral and respective Sums of Money hereby charged on the respective Parishes, Conftablewicks, Divifions, Allotments, and Places in England, Wales, and Berwickupon-Tweed, in refpect of fuch Perfonal Ettate as aforesaid, all and every Perfon and Perfons, Bodies Politick and Corporate, Guilds, and Fraternities, within the fame Parishes, Conftablewicks, Divifions, Allotments, and Places refpe&tively, having any Eftate in ready Money, or in any Debts whatsoever owing to them within Great Britain or without, or having any Eftate in Goods, Wares, Merchandize, Chattels, or other Perfonal Eftate whatsoever, within Great Britain or without, belonging to or in truft for them, (except and out of the Premises deducted fuch Sums as he, she, or they do bona fide owe, and fuch Debts owing to them as shall be adjudged defperate by the refpective Commiffioners appointed by this Act, and alfo except the Stock upon Lands, and fuch Goods as are used for Household Stuff, and alfo except fuch Loans and Debts as are or fhall be owing from His Majefty to any Perfon or Perfons,) fhall be charged with as much Equality and Indifference as is poffible, by a Pound Rate, that is to fay, by an equal Pound Rate for every One hundred Pounds of fuch ready Money and Debts, and for every One hundred Pounds worth of fuch Goods, Wares, and Merchandize, Chattels, or other Perforal Eftate, and fo for any leffer or greater Sum or Value, for or towards the faid feveral and refpective Sums by this A&t set or impofed, or intended to be fet or impofed, for and upon all and every fuch Parishes, Conftablewicks, Divifions, Allotments, and Places hereby charged therewith as aforefaid; fo that by the faid Rates fo to be taxed or affeffed as aforefaid for or upon the faid ready Money, Debts, Goods, Wares, Merchandize, Chattels, or other Perfonal Eftate, according to the Purport and true Meaning of this prefent A&t, the full and entire Sums hereby fet or impofed, or intended to be fet and impofed, in England, Wales, and Berwick as aforefaid, upon the faid Perfonal Eftates, fhali be completely and effectually taxed, affeffed, levied, and collected, and fhall be paid into the Receipt of His Majefty's Exchequer by Four quarterly Payments, the firft Payment thereof to be made on or before the Twenty-fourth Day of June which shall be in the Year of our Lord One thousand eight hundred and nine.

XVIII. And be it further enacted, That for and towards raifing the feveral Sums of Money charged as laft aforefaid on Perfons in refpect of Publick Offices or Employments of Profit, all and every Perion and Perfons, and all and every Commiffioner and Commiffioners having, ufing, or exercifing any Publick Office or Employment of Profit in England, Wales, or Berwick as aforelaid, which is or fhali be rated or affed by virtue of an Act, paffed in the Thirty-eighth Year of the of His prefent Majefty, intituled, An A&t for granting an Aid

to His Majefty by a Land Tax to be raised in Great Britain, for the Service of the Year One thousand seven hundred and ninety-eight, and all and every their Clerks, Agents, Secondaries, Subftitutes, and other inferior Minifters whatsoever (fuch Military Officers who are or shall be in mufter by the Mufter-Mafter-General of His Majefty's Army, or in Pay in His Majefty's Army or Navy in refpect of fuch Offices only, excepted) fhall yield and pay unto His Majeffy any Sum not exceeding the Sum at which fuch Office or Employment was affeffed in the Year commencing from the Twenty-fifth Day of March One thousand feven hundred and winety-eight, by virtue of the faid A&t, paffed in the thirty-eighth Year of the Reign of His prefent Majefty, intituled, An Aa for granting an Aid to His Majefty by a Land Tax to be raised in Great Britain, for the Service of the Year One thousand seven hundred and ninety-eight; and that all and every Perfon and Perfons, Guilds, Fraternities, Bodies Politick and Corporate, having an Annuity, Penfion, Stipend, or other yearly Payment, either out of the Receipt of His Majesty's Exchequer in England, or out of any Branch of His Majefty's Revenue in Great Britain, or payable, or fecured to be paid by any Perfon or Perfons whatfoever in Great Britain (not being or iffuing out of any Lands, Tenements, or Hereditaments, or charged upon the fame, or included in any Affeffment made upon Lands, Tenements, or Hereditaments, mentioned in the faid Act, paffed in the Thirty-eighth Year of the Reign of His prefent Majefty, intituled, An Ad for granting an Aid to His Majefly by a Land Tax to be raised in Great Britain, for the Service of the Year One thousand feven hundred and ninety eight, and not being Annuities or yearly Payments which, by any Act or Acts of Parliament made or to be made, are or shall be efpecially exempted from the Payment of Taxes or Aids) fhall yield and pay unto His Majefty the Sum of Four Shillings for every Twenty Shillings by the Year for every fuck Annuity, Penfion, Stipend, or yearly Payment refpectively, and after that Rate for One whole Year; the faid feveral Rates and Sums of Money hereby granted to be affelfed, impofed, levied, and collected, in fuch Manner as herein-after is mentioned.

XIX. And be it further enacted, That for the better affeffing, ordering, levying, and collecting of the feveral Sums of Money to as laft aforefaid limited and appointed to be raised and paid in the aforefaid part of Great Britain called England, Wales, and Berwick-uponTweed, in refpect of Perfonal Eftates, and in refpect of Offices or Employments of Profit, and Annuities, Penfions, Stipends, and other yearly Payments, and for the more effectual putting this A&t in Exe- [See do cution, in reference to the fame, all and every the Perfon and Perfons 49 G. 3. c. 55.] who in and by an Act of Parliament made and paffed in the Fortyeighth Year of His Majefty's Reign, intituled, An A&t for appointing Commiffioners for carrying into Execution an Act of this Seffion of Par liament, for granting to His Majefly a Duty on Penfions and Offices in England, and an Act made in the Thirty-eighth Year of His prefent Majefly, for granting an Aid to His Majelly by a Land Tax to be raised in Great Britain, for the Service of the Year One thousand seven hundred and ninety-eight, were named and appointed Commiffioners for putting in Execution the fame Acts within the feveral Counties, Ridings, Cities, Boroughs, Cinque Ports, Towns, Divifions, and Places of England, Waies, and Town of Berwick-upon-Tweed, duly qualifying themielves according to the said A&t, paffed in the Thirty-eighth Year

of the Reign of His prefent Majefty, intituled, An A&t for granting an Aid to His Majefty by a Land Tax to be raised in Great Britain, for the Service of the Year One thoufand feven hundred and ninety-eight, in that Behalf, fhall, together with any other Perfons that may be appointed by any A&t to be made in this Seffion of Parliament, be Commiffioners for putting in Execution this prefent Act, and the Powers therein contained, within and for all and every the Parishes, Conftablewicks, Divifions, Allotments, and Places, fituate within the fame Counties, Ridings, Cities, Boroughs, Cinque Ports, Towns, Divifions, and Places refpectively.

XX. And be it further enacted, That the feveral Commiffioners lat aforefaid fhall meet together at the moft ufual and common Places of Meeting within their respective Hundreds, Lathes, Rapes, Wapentakes, Wards, and other Divifions refpectively, within England, Wales, and Berwick-upon-Tweed, within which they are appointed Commiffioners, on or before the First Day of May One thoufand eight hundred and nine, and fhall meet afterwards in like Manner as often as it fhall be neceffary, for putting fo much of this A&t in Execution as is hereby committed to their Care and Charge; and the faid Commiffioners, or fo many of them as fhall be prefent at fuch Meeting or Meetings, or the major Part of them, are hereby authorized and required to infpe&t and examine the Affeffments made by virtue of the faid recited Act, made in the Thirty-eighth Year aforefaid, for the Year ending on the Twenty-fifth Day of March One thousand eight hundred and nine, and afcertain the feveral and refpective Sums of Money charged by virtue of the faid laft-mentioned Act, in every Parish, Conftablewick, Divifion, Allotment, or Place, for or in refpect of any Estate in ready Money, Debts, Goods, Wares, Merchandize, Chattels, or other Perfonal Eftate, and alfo for or in refpect of any Offices or Employments of Profit, Annuities, Penfions, or Stipends, as aforefaid, by any Affeffment made for the faid Year ending on the faid Twenty-fifth Day of March One thousand eight hundred and nine, and feparate, divide, and fet down in Writing, the Amount of the feveral and refpective Sums charged upon Eftates, in ready Money, Debts, Goods, Wares, and Merchandize, Chattels, or other Perfonal Estate, and alfo the feveral and refpective Sums charged in refpect of any Offices or Employments of Profit, Annuities, Penfions, or Stipends, as aforefaid, from the Monies charged in fuch Parishes, Conftablewicks, Divifions, Allotments, or Places by virtue of the faid laft-mentioned A&, upon Lands, Tenements, or Hereditaments; and the faid Commiffioners are hereby required to deliver, or caufe to be delivered, a Schedule or Duplicate in Parchment under their Hands and Seals, fairly written, containing the whole Sum affeffed on each Parifh, Conftablewick, Divifion, Aliotment, or Place, where any Affeffment fhall have been made upon Perfonal Eftates, or in respect of Offices and Employments of Profit, Annuities, Penfions, or Stipends, and alfo the Chriftian Names, and Surnames, of the refpective Affeffors and Collectors under the Receiver-General of each County, Riding, City, Borough, Town and Place refpectively, where fuch Affeffments fhall have been made, or his Deputy, and fhall tranfmit, or cause to be tranfmitted, a like Schedule or Duplicate into the King's Remembrancer's Office of the Exchequer, and this the Commiffioners fhall caufe to be done on or before the Tenth Day of May One thoufand eight hundred and nine, for which Duplicates the

Receiver and Remembrancer, or their respective Deputies, fhall give Receipts for to the Perfon who brings the fame, a Receipt in Writing, gratis, under the Penalty of Ten Pounds, to be recovered to the King's Ufe, as other Penalties are by this A&t recoverable.

XXI. Provided always, and be it further enacted, That every Parish or Place in which any Affeffment fhall have been, or fhall be made, under and by virtue of the faid laft recited Act, on any Perfon or Per. fons in respect of any Offices or Employments of Profit, Annuities, Penfions, or Scipends, by any Affeffment for the Year ending on the Twenty-fifth Day of March One thoufand eight hundred and nine, fhall, from and after that Time, be wholly discharged from fo much of the Suma to be levied upon fuch Parish or Piace, according to the Proportions eftablished under the faid recited A&t.

XXII. And be it further enacted, That all and every the Powers, Rules, Penalties, Forfeitures, Claufes, Matters and Things, which in and by the faid Act, paffed in the Thirty-eighth Year of the Reign of His prefent Majesty, intituled, An Ad for granting an Aid to His Majefty by a Land Tax to be raised in Great Britain, for the Service of the Year One thousand feven hundred and ninety-eight, are provided and eftablished for afcertaining, raifing, levying, mitigating, adjudging, paying, and managing the Rates and Affeffments granted by the faid laftmentioned Act; and which by the fad other Act, paffed in the fame Thirty-eighth Year aforefaid, intituled, An Ad for making perpetual, Jubject to Redemption and Purchase in the Manner therein flated, the feveral Sums of Money now charged in Great Britain, as a Land Tax, for One Year. from the Twenty-fifth Day of March One thousand feven hundred and ninety-eight, are continued and made perpetual, in relation to the Rates and Affeffments charged on Lands, Tenements, and Hereditaments, until the Redemption and Purchase thereof, fhail be practifed, ufed, and put in Execution in and for the ascertaining, raifing, levying, mitigating, adjudging, paying, and managing the faid laft-mentioned Rates, Affeffments, and Sums of Money to be charged, affeffed, and levied by virtue of this Act, in refpect of Perfonal Etates, and in refpect of Offices or Employments of Profit, and Annuities, Penfions, Stipends and other yearly Payments, as fully and effectually to all Intents and Purposes, as if all and every the faid Powers, Rules, Penalties, and Forfeitures, Claufes, Matters, and Things, were particularly repeated and re-enacted in this A&t.
