XI. And be it further enacted, That when the faid Tables of Rates and Fares fhall be fettled by the faid Comm fioners, the fame fhall be printed, and the faid Commiffioners fhall caufe a Copy thereof to be delivered to each of the faid Watermen to be licensed as herein. after mentioned, and One Copy of fuch Rates painted on a Board fhall be affixed on the Door of the Market Houfe in Gosport aforefaid, One other fuch Copy on the Door of the Guildhall of Portsmouth aforefaid, and One other fuch Copy in the Town of Portfea, at or near the Gates of His Maj-fy's Dock Yard there; and when and as often as the fame. or either of them, fhall be defaced or destroyed, the faid Commiflioners fhall caufe the fame to be replaced by another or others; and when and as often as any Alteration or Alterations shall be made by the fain Commiffioners in the faid Tables of Rates or Fares, the fam fhall be in like Manner printed, delivered, painted, and affixed as aforefaid.

XII. And be it further enact d, That in cafe any fuch Waterman, or other Perfon employed by him, fhall demand or take more than the Rates or Prices fo to be affeffed and rated as aforefaid, except as herein-after mentioned, or fhall (not being prevented by fome ob. vious Difficulty or Danger, which fuch Waterman fhall make appear to the Satisfction of the Jultice or Juftices before whom any Complaint fhall be laid) refuse to carry any Paffenger for fuch Rates or Prices, every fuch Waterman fo offending fhall forfeit and pay for every fuch Offence any Sum not exceeding Forty Shillings, to be levied and recovered, paid and applied in Manner herein after mentioned Provided always nevertheiefs, that it fhall and may be lawful to and for the faid Watermen to demand Double the Rate of Fare fixed by the faid Tables between the Hours of Six of the Clock in the Evening, and Six of the Cleck in the Morning, between the Twentyninth Day of September and the Twenty fifth Day of March in each Year; and between the Hours of Ten of the Clock in the Evening, ard Five of the Clock in the Morning, between the Twenty-fifth Day of March and the Twenty-ninth Day of September in cach Year.

XIII. And be it further enacted, That if any Perfon or Perfons fhall refuse or negle&t to pay any Waterman or Watermen licensed as herein-after mentioned the Fare or Fares which he or they is, are, or thall be entitled to demand, it fhall and may be lawful to and for any Juftice of the Peace of the faid County of Southampton, if the Offence fhall be committed out of the Borough of Portsmouth, or of the Borough of Portsmouth if the Offence fhall be committed within it, or of the Borough of Portsmouth, or the County of Southampton, if the Offence fhall be committed upon the Water within the Harbour of Portsmouth, upon Complaint thereof, to grant a Warrant to bring before him the Perfon or Perfons against whom fuch Complaint fhall be made, and, upon Proof upon Oath of One Witness (which Oath fuch Juftice is hereby empowered to adminifter), to award reafonable Satisfaction to the Party aggrieved for his Damages and Cofts, and, upoa Refufal to pay or make fuch Satisfaction, to devy the fame by Diftrefs and Sale of the Goods and Chattels of the Perfon or Perfons fo refufing.

it further enacted, That upon Complaint of any Mifbehaviour of Punishing any Waterman, Apprentice, or Affiftant, in affaulting, infulting, or Watermen and ufing abufive or infulting Language to any Perfon or Perfons whom- Apprentices for Misbehaviour, foever, it shall and may be lawful to and for any fuch Juftice of the Peace for the faid County of Southampton or Borough of Portsmouth, within his refpective or concurrent Jurifdiction, to fummon fuch Waterman, Apprentice, or Affiltant before him to answer the faid Complaint, and upon Proof thereof upon Oath (which Oath the faid Juttice is hereby empowered to adminifter), or by his own Confeffion, or on the View of a Juftice of the Peace, fuch Waterman, Apprentice, or Affiitant, fhall forfeit the Sum of Twenty Shillings, to be levied and recovered, paid, and applied in Manner herein-after mentioned; and if fufficient Diftrefs cannot be had, he fhall be committed to the House of Correction for the County, Borough, or Place where the Complaint fhall be heard, for One Calendar Month, or every Waterman convicted of any fuch Offence fhali forfeit and lofe his Licence, and fhall not be again licenfed for the Space of One whole Year next enfuing; and fuch Water.rar, Apprentice, or Affiftant fo offending fhail and may, by Authority of this A&t, unless fuch Perfon being a Waterman fhall, upon Demand, produce and fhew to the Party aggrieved his Licence, fo that fuch Party may ascertain his Name and Place of Abode, or being an Apprentice or Affittant fhall at the Time of the Offence committed be actually on board the Boat of his Mefter, having the Name and Place of Abode of fuch Maiter painted thereon, be apprehended by any Perfon or Perfons who fhall fee fuch Offence committed, and fhall be immediately conveyed or delivered to a Conftable, or other Peace Officer, in order to be conveyed before fome Justice of the Peace to be dealt with according to Law.

XXII. And be it further enacted, That it fhall not be lawful for Boat not to be any tuch Apprentice, until he fhail have attained the full Age of cutrufted folely Eighteen Years, and have been apprenticed for the Space of Two Years, to take upon himfeif the fole Care and Management of any Boat; and in cafe any fuch Apprentice fhall offend herein, or any licenfed Waterman thail permit any Boat to be under the Care or Management of any Perfon or Perfons other than himself, or fome other licensed Waterman, or of fome Parfon who fhall be of the Age of Eighteen Years and fhall have ferved at leaft Two Years of his Apprenticeship, the Mafter of the faid Apprentice or fuch licensed Perfon fo offending as aforefaid, fhall forfeit and pay for every fuch Offence the Sum of Five Pounds, to be levied, recovered, pid, and applied in Manner herein-after mentioned; and if fufficient Diftrefs carnot be had, he shall be committed to the Houle of Correction 7 where

XXIV. And be it further enacted, That from and after the paffing of this Act, it shall not be lawful for any fuch Waterman or Apprentice, fo having the Charge of his Master's Boat as aforesaid, to receive, take into, or carry in his Wherry or Boat at one and the fame Time, any more than Ten Perfons in fair Weather, or than Six when fuch Flag fhall be or remain hoifted as aforefaid; and in cafe any fuch Waterman or Apprentice shall take or receive into or carry in his faid Wherry or Boat any greater Number of Persons than are respectively allowed to be carried as aforefaid, every such Waterman or Apprentice fo offending, and being thereof convicted by the Oath of One or more credible Witness or Witneffes, or by Confeffion of the Party or Parties, before any One or more of His Majesty's Juftices of the Peace for the faid County of Southampton or Borough of Portsmouth respectively, or on View of any fuch Juftice or Jultices, fhall for every fuch Offence forfeit the Sum of Five Pounds, to be levi d, recovered, pai1, ard applied in Manner herein after mentioned; and if fufficient Diftress cannot be had, he fhall be committed to the House of Correction of the County, Borough, or Piace where the Complaint fhall be heard, for Two Calendar Months; and it fhall and may be lawful for the faid Commiffioners, or any Five or more of them, to revoke the Licence granted to fuch Waterman,, and he fhall not again be licenfed.

XXV. And be it further enacted, That the faid licenfed Watermen fhall keep their Boats in good Repair, Order, and Condition, and well and fufficiently provided with Mafts, Sails, Oars, Rudder, and all other proper Gear and Tackle, and that whenever any fuch Watermen fhall be hired to go to any Place, Ship, or Veffel without the faid Harbour of Portsmouth, they fhall provide themselves with and have in their respective Boats Two Sets of Sails, one adapted for fair and the other for foul Weather, and that on fuch Occafions every fuch Waterman fhall have at leaft One Affillant; and that it fhall and may be lawful to and for any Two or more of the faid Commiffioners, or any Perfon or Perfons to be fpecially appointed by the Commiffioners under this Act, or any Five or more of them, at fome Meeting to be holden pursuant to the Provifions of this Act, and who fhall be paid fuch Sum and Sums of Money for their Service as the faid Commiffioners, or any Five or more of them, fhall from Time to Time direct, from Time to Time to infpe& the said Boats, and for any Two or more of fuch Commiffioners, or fuch Perion fo to be appointed, to order fuch of the faid Boats as shall and may be found deficient in any Refpect to be laid by, and fuch Boat fhall not be used again till the Defect fhall have been repaired, and the faid Boats fhall have been infpe&ted and approved of by the faid Commiffioners, or any Two or more of them, or by fuch Perfon or Perfons fo to be specially appointed as aforefaid; and in cafe any fuch Waterman fhall ufe any Boat not in good Repair and Condition, and well and fufficiently provided with Mafts, Sails, Oars, Rudder, and other proper Gears and Tackle, or without its Number, and the Name and Place of Abode of fuch Waterman painted in legible Figures and Letters in

fome confpicuous Part on the Infide thereof, or, on being hired to go
to any Place or Ship without the faid Harbour of Portsmouth, fhall
not provide himself with and have on board the said Beat Two Sets of
Sails as aforefaid and One Affitant, or fhall prefume to ufe any Boat
which fhall have been declared infufficient as aforefaid, until fuch
Boat fhall have afterwards been infpected and approved of by the faid
Commiffioners, or any Two or more of them, or by fuch Perfon or
Perfons fo to be appointed as aforefaid; or if any Perfon who fhall be
licenfed only to work within the faid Harbour fhall use his Boat for
Hire on the Outfide thereof, every fuch Waterman fo offending fhall
for every fuch Offence forfeit the Sum of Forty Shillings, to be levied
and recovered, paid, and applied in Manner herein-after mentioned.
"Seven Commiffioners may make Orders at any of their Meetings

XXVIII. ' And Whereas the Hard or Landing Place from the faid Harbour of Portsmouth on the Gofport Side thereof is liable to be much injured by Ships, Veffels, Lighters, Barges, Boats of Burthen, or other Boats lying thereon, which by due Care in the Perfons having the Command of fuch Ships, Veffels, Lighters, Barges, Boats of Burthen, and other Boats, may be avoided;'

Be it therefore further enacted by the Authority aforefaid, That Penalty on from and after the paffing of this Act, if any Malter, or other Perfon Veffels lying on having the Command of any fuch Ship, Veffel, Lighter, Barge, Gofport Hard. Boat of Burthen, or other Boat, fhall place or permit, or fuffer any fuch Ship, Veffel, Lighter, Barge, Boat of Burthen, or other Boat, to lie over or upon the faid Hard or Landing Pace on the Gofport Side of the faid Harbour of Portsmouth every fuch Master, or other Perfon having the Command of any fuch Ship, Veffel, Lighter, Barge, Boat of Burthen, or other Boat, fo placed, permitted, or fuffered to lie over or upon the faid Hard, thall for every fuch Offence forfeit and pay the Sum of Five Pounds, to be levied, recovered, paid, and applied in Manner herein-after mentioned.

XXIX. And be it further enacted, That all Penalties and For- Recovery of feitures impofed by this Act, or by any fuch Bye Law, Order, Rule, Penalties. and Regulation made in purfuance thereof (the Manner of Recovery whereof is not otherwife particulary mentioned), fhall and may, if not otherwise sooner paid, be levied and recovered by Diftrefs and Sale of the Offender's Goods and Chattels, by Warrant under the Hand and Seal or Hands and Seals of any One or more Juftice or Justices of the Peace in or for the County of Southampton, or in or for the County, City, Borough, Town, Divifion, or Place where in fuch Offender or Offenders fhall be or refide, or where fuch Goods and Chattels shall be, which Warrant fuch Juftice or Juftices is and are hereby empowered and required to grant, fuch Offender or Offenders having been first convicted of any Offence or Offences done or committed contrary to the true Intent and Meaning of this Act, before any One or more Justice or Juftices of the Peace for the faid County of Southampton or Borough of Portsmouth, according to their respective Jurif. dictions under this A&, upon the Oath of One or more credible Witnefs or Witneffes, which Oath the faid Jultice and Juftices is and are hereby empowered to adminifter, or on the Confeffion of the Offender or Offenders; and the faid Penalties and Forfeitures when recovered, rendering

rendering the Overplus (if any be), after deducting the Expence of fuch Diftrefs and Sale, upon Demand, to the Party or Parties whose Goods and Chattels fhall be fo diftrained, fhall be paid to the faid Commiffioners, or anv Five or more of them, and thall be applied (if not otherwife directed to be applied by this A&t) for and towards the Purposes of this A&t; and in cafe fufficient Diftrefs cannot be found, and fuch Penalties and Forfeitures fhall not be forthwith paid, it fhall and may be lawful for fuch Juftice or Juftices, and he and they are hereby authorized and required, by Warrant under his or their Hand and Seal or Hands and Seals, to commit fuch Offender or Offenders to the Common Gaol or House of Correction for the County, City, Borough, Town, or Place where fuch Offender or Offenders fhall be or refide, for any Time not exceeding Two Calendar Months where the Penalty fhall not amount to Five Pounds, but in all Cafes where the Penalty fhall amount to or exceed that Sum, and where no other Punishment on Non-payment thereof shall be hereinbefore directed to be inflicted, the faid Offender or Offenders fhall be committed as aforefaid, for any Time not exceeding Six Calendar Months, unless fuch Penalties and Forfeitures refpectively fhail be fooner paid.

XXX. Provided always, and be it further enacted, That no Person or Perlons fhall be fubject or liable to the Payment of any of the Penalties or Forfeitures inflicted by virtue of this A&t, unless Information fhall be given of fuch Offence or Offences within Three Calendar Months next after the Offence fhall have been committed.

XXXI. Aud, for the better enforcing due Obedience to this Act, and afcertaining the Mode of Recovery of the refpe&tive Penalties,' be it further enacted, That the Justices of the Peace of the faid County of Southampton, as to Offences committed in the faid County out of the Borough of Portsmouth aforefaid, and the Juftices of the Peace of the faid Borough of Portsmouth, as to Offences committed within the faid Borough of Portsmouth, and every of them, shall have full Power and Authority by virtue of this Act, upon Complaint made to them or any of them by any Perfon or Perfons, to examine, hear, and determine by the Oath of One or more Witness or Witneffes (which Oath each and every of them are hereby authorized to administer), or by the Confeffion of the Offender, all Complaints or Offences to be done or committed within their faid refpe&tive Jurifdictions, contrary to the true Intent and Meaning of this Act: Provided nevertheless, that where any Offence against this A&t fhall be committed upon the Water within the Harbour of Portsmouth, the Juftices of the Peace for the County of Southampton, and thefe for the Borough of Portsmouth, fhall have a concurrent Jurifdict on as to fuch Offerces, and the Parties making Complaint thereof may make fuch Complaint to the one or the other as they fhall think proper.

XXXII. And be it further enacted, That in all Cafes where any Conviction fhall be had for any Offence or Offences committed againft this At, or any Matter in purfuance of this Act, the Form of Conviction fhall be in the Words or to the Effect following; that is to fay,
