XIV. And be it further enacted, That the Churchwardens and Preferibing Overfeers of the Poor of all and every Parish, Town, Liberty, Pre- another Mode cina, Village, Hamlet, or Place within the faid County, or fome of making or one of them, fhall, whenever it shall be fo determined to be neceffary fuch Returns. to revile, correct, and re-ascertain the whole Rental of the faid County as aforefaid, make a Return to the Committee fo to be appointed for fuch Revifion as aforefaid, at fuch Time and Place as the faid Committee, or any Three or more of them fhall appoint, of the total Amount of the Rental or Value of the Eftates within fuch refpective Parishes, Towns, Liberties, Precincts, Villages, Hamlets, or Places, at the Time of making the laft preceding Rate for the Relief of the Poor, together with the Names of the several Perfons and Parties charged with fuch Rate, and the Sum and Sums of Money rated or charged on fuch feveral Perfons or Parties respectively, and fhall alfo ftate and point out in Writing the Mode adopted in making fuch Rate upon fuch Return, and fhail verify every fuch Return upon Qath, in Mauner as by the faid Act is directed, and every fuch Return fhall be figned with the Name or Names of the Church-warden or Churchwardens, Overfeer or Overfeers making fuch Rate.

XV. And be it further enacted, That in cafe any Churchwarden Penalty on or Overfeer of the Poor of any of the feveral Parishes, Towns, Churchwardens Liberties, Precincts, Villages, Hamlets, or Places within the faid County, fhall neglect or make Default in making any fuch Returns in Manner aforefaid, then and in every fuch Cafe each and every fuch Churchwarden and Overfcer of the Poor so neglecting or making Default (without fufficient Excufe, to be allowed by the faid Committee fo to be appointed, at their Meeting fo to be holden at Sittingbourne aforefaid) fhall forfeit and pay fuch Sum and Sums of Money, not exceeding Fifty Pounds, as fhall or may be ordered or adjudged by the faid Committee, at their Meeting fo to be holden at Sittingbourne aforefaid, by way of Penalty for fuch Neglect or Default; and in cafe any fuch Penalty thall not be forthwith paid, it fhall and may be lawful to and for the faid Committee at fuch Meeting affembled, and they are hereby directed to iffue their Warrant to the High Conftable of the Divifion where fuch Parish, Town, Liberty, Precinct, Village, Hamlet, or Place Thall be fituated, directing him to levy fuch Penalty upon the refpective Goods and Chattels of each and every Churchwarden and Overseer of the Poor of the Parish, Town, Liberty, Precinct, Village, Hamlet, or Place fo neglecting or making Default, in like Manner and with fuch Powers and Authorities as the faid High Conftable is, by a Statute made in the Twelfth Year of te Reign of His late Majefty King George the Second, intituled, An Ad for the more eafy affeffing, collecting, and levying the County Rates, vetted with for levying on the Churchwardens and Overfeers of the Poor the Sum affeffed for the County Rate.

XVI. And be it further enacted, That every Churchwarden or Acts of the Churchwardens, Overfeer or Overseers of the Poor of any Parish, Committee of Town, Liberty, Precina, Village, Hamlet, or Place in the faid Juftices fhall County, Perfon or Perfons, fhall have and be entitled to the fame be confidered to Power and Right of appealing to the next General Quarter Seffions, the General or fome Adjournment thereof, in the fame Manner, to all Intents and Quarter Seilions.

Purposes, as if the faid Matter or Thing had been ordered and directed by a General Quarter Seffions, or any Adjournment thereof, under and by virtue of the before recited A&t of the Forty-seventh Year of His prefent Majesty.

XVII. And be it further enacted, That the Clerk of the Peace for the faid County, or his Deputy, fhail and he is hereby required, Yearly and every Year, to deliver in to the Justices of the Peace affembled at the Eafter Quarter Seffions to be holden for the faid County, and also to the Treasurer or Treasurers appointed and to be appointed for each Divifion of the faid County, a Statement in Writing of the Sum or Amount of the whole Rental of the faid County, as the same shall have been returned, under and by virtue of the herein before recited Act of the Forty-feventh Year of His prefent Majelty, and of this Act, and alfo of the component Parts of fuch Rental, as the fame shall have been exifting at the Michaelmas General Quarter Seffions of the Peace next preceding, diftinguishing the Amount for each Divifion of the faid County; which Statement fhall be figned by and verified upon the Oath of the Clerk of the Peace or his Deputy.

XVIII. And be it further enacted, That all and every Disburse. ments, Sum and Sums of Money, Charges and Expences whattoever, of the whole of the faid County of Kent, which attach upon or to which a County Rate is by Law liable fhail be arranged, adjutted, and fettled by the Committee of Juftices fo appointed as aforefaid, at their Meeting to be holden at Sittingbourne, in Manner aforefaid, in proportion to the relative Rentals of each Divifion of the faid County, as the fame fhall be exifting at the Michaelmas Quarter Seffions of the Peace next preceding fuch Meeting as atorefaid; and the Juftices fo affembled hall make fuch Order upon the Treasurer of cach Divifion of the faid County refpectively, to pay to or receive from each other fuch Sum or Suas of Money as by the faid Juftices fhall be adjudged to be due from or to be paid to either refpectively upon fettling the Annual General Account at fuch Meeting up to and including the Ealler General Quarter Seffions of the Peace next preceding fuch Meeting fo to be holden at Sittingbourne as aforefaid.

XIX. And be it further enacted, That the Committee of Juftices, fo to be aflembled at Sittingbourne as aforefaid, fhall and they are hereby required from fuch grofs Rental and from fuch relative Rentals fo to be delivered in by the faid Clerk of the Peace or his Deputy as aforefaid, to divide the faid Annual Expences between the Two Divifions of the faid County, proportionally to fuch grofs Rental and fuch relative Rentals: Provided always, that no Denominator of a lower Value than a Twentieth fhall ever be used for the Purpose of afcertaining the faid Proportions.

eltablishing a Market in the faid Town.

By Cap cxv. Trutees are appointed for building the Chapel. XXII. And be it further enacted That the faid Chapel and every Chapel to he Minister officiating therein for the Time being, as alfo the Perfon or fubject to the Perfons who fhall act as Chapelwarden or Chapel wardens thereof, fhail Ecclefiaftical be fubject in all Refpects to the ordinary Ecclefiaftical Jurifdition by Law eftablished, Law eftablished; and it fall and may be lawful to and for the Lord and to be Bishop of Chichester for the Time being, and he is hereby authorized confecrated. and empowered to confecrate the faid Chapel, to be for ever thereafter a Chapel of Eafe to the Parish Church of Broadwater aforefaid, and Diving Service fhall be from Time to Time for ever after performed therein according to the Rites and Ceremonies of the Church of England as by Law etablished, by a perpetual Curate to be no minated and appointed in Manner herein after direct d; and the faid Chapel and the perpetual Curate thereof fhall or ever after be fubject to the ordinary Jurifdiction and Visitation of the Lord Bishop of Chichefer for the Time being.

XXIII. And be it further enact d, That after the faid Chapel fhall have been confecrated in Mann r aforefaid, the Rector of the faid Parish of Broadwater for the Time being is hereby empowered and required to nominate, under his Hand and Seal, to the Lord faid Chapel. Bishop of Chichester tor the Time being a fit Perfon being in Prielt's Orders (not being himfelt the Rector of Broadwater aforefaid), who fhall have taken a Degree in one of the Three Universities of Oxford, Cambridge, or Dublin, to be licensed to the perpetual Curacy of the faid Chapel; and upon Occafion of every future Vacancy the faid Rector of the faid Parish of Broadwater for the Time being fhall, in like Manner, nominate fome fit Perfon qualified as aforefaid, to be licenfed as aforefaid; and upon Failure of fuch Nomination the Right of Nomination for that Term fhall lapfe to the Lord Bishop of Chichefter for the Time being, and to the Metropolitan and to the Crown fucceffively, accor 'ing to the Course of Law in Cafes of prefentative Benefices; and the Right of Nomination to the faid Chapel may be fued for and recovered, and the Incumbency thereof thall seafe and be determined, in like Manner as if the Curacy of the faid Chapel was a prefentative Vicarage and Benefice.

XXIV. And be it further enacted, That no Marriage fhall at any Time be folemnized in the faid Chapel, nor shall any Corpfe be buried in the faid Chapel or the Vault thereof, but that the Curate of the faid Chapel for the Time being may and fhall, from Time to Time, baptize all fuch Childreu as fhail be brought to the faid Chapel for that Purpofe during the ufual Times of performing Divine Service therein; and in order to facilitate Searches for Regiftries in the said Parish of Broadwater. Entries of all fuch Children, fo baptized at the faid Chapel, fhall be regularly made in a Regifler to be provided for that Purpose by the Chapelwarden; and the faid Curate fhall, on the Twenty fifth Day of March, the Twenty-fourth Day of June, the Twenty-ninth Day of September, and the Twenty-fifth Day of December in every Year, fend to the Rector of the faid Parish of Broadwater an accurate Copy, figned by him, of ali Chrifteninge in the faid Chapel done by him the Quarter immediately preceding, and the faid Rector or his Curate fhall caufe the fame to be tranfcribed into a proper Book, to be provided for that Purpose, and to be kept with the Register of the Chriftenings of the faid Parifh; and the said Curate may and fhall afo church al Women who may come to the faid Chapel for that Parpole.

An A& for building a Church on Gateshead Fell, in the Parish of

"One Acre in Gateshead Fell allotted for the building a Church
"thereon vetted in the Rector, and Trustees appointed for that Pur-
"pose, with Refervation of Mines to the Lord of the Manor. § 1—17.

XVII. And be it further enacted, That it fhall be lawful for the faid Trustees, and they are hereby authorized and required to caufe a new Church and Chancel, with a P.ace proper for the adminiftering the Sacrament of the Lord's Supper, and alfo a Tower or Steeple to be built upon the faid Piece or Parcel of Ground intended to be vefted in them by this Act, or upon fo much there of as may be proper, according to fuch Pian or Model, Elevation and Section, of such Dimerfion and Materials, and in fuch Manner, as they, the fail Trustees, fhall agree upon and direct at fome pub ic Meeting, to be particularly called for that Purpofe, and in which Plan of the Church and Chancel to be buit in purluance of this Act, the Chancel fhall be diftinguished in fuch Manner as the faid Trufees, with the Confent and Approbation of the Bishop of Durham. for the Time being, fhall direct, and in which Plan no Alteration fhall afterwards be made without the Confent of Ten of the faid Truites at leaft; and in cafe fuch Alteration fhall in any Manner comprife or r late to the Chancel, or any Part thereof, then with the Corient of the faid Bifhop in addition to the Ten Truitees; and the faid Trufters fhall alto in like Manner, fet out and appoint the Remainder of the laid Piece or Parcel of Ground as and for a Cemetry or Church yard; and the faid Trustees fhall caufe fuch Pews, Seats, Gallerics, and Conveniences to be made for the Accommodation of the Inhabitants of the faid District, called Gateshead Fell, and a Bell or Belis and fuch Ornaments to be erected and fet up, and fuch other Matters and Things to be done, as the faid Trustees, with the Confent and Ap

probation of the faid Bishop, fhall direct, in order that the faid Curch and Chancel, when completed, finished, and furnished, may be confecrated and fet apart for the Celebration of Divine Service, the pubIfhing of Banns of Marriage, the Solemnization of Marriage, the Adminiftration of the Sacrament of the Lord's Supper, and the Baptifm of Infants, and ali other religious Acts, according to the Rites and Ceremonies of the Church of England; and the faid Building, Works, Matters, and Things, fhall be done by Contract, or otherwife, fubject to the Infpection and Controul of the Surveyor or Surveyors on the Part of the faid Trustees, as the faid Trustees fhall from Time to Time think proper and mot expedient to fulfil the Intention and effect the Purposes of this A&.

XXI. And be it further enacted, That the said new Church and When new Chancel, fhall be completed and finished, and confecrated, and be Church to be fit for the Celebration of Divine Service, within Two Years at furtheft, completed. a ter laying the Foundation thereof; and that from and immediately after the laid Church and Chancel fhall be finished and confecrated, the fame, and the Church Yard belonging thereto, and all and fingular the Meffuages, Lands, Tenements, and Hereditaments whatfoever, within and Parcel of the faid District or Tract of Wafte Land called Gateshead Fell, fhall be from thenceforth for ever thereafter fevered and divided from the faid Parish of Gateshead, and be exempted and discharged from all Dependence thereon, and from all Power, Right, and Authority of the Rector and Parfon of the Parish Church of Gateshead aforefaid, for the Time being; and the faid Rectory and Church hereby authorized to be built fhall be for ever thereafter a diftinct and separate Rectory and Parish Church for the Inhabitants of the faid District or Tract of Land, called Gateshead Fell, under the Name and Title of the Rectory and Parish of "Gateshead Fell;" and together with the Meffuages, Lands, Tenements, Houfes, Piaces, and Hereditaments within the faid Fell, shall be for ever thereafter a diflinch Parish of itself, and called by the Name of the Parish of Gateshead Fell; and the Inhabitants of the faid Parish of Gateshead Fell fhall be for ever thereafter difcharged and exempted of and from the Cure of Souls, Power, and Authority of the Rector and Parfon of the Parish Church of Gateshead aforefaid, and the Rector and Parfon of the fame Parish Church of Gateshead fhall be from thenceforth for ever exonerated and discharged from the Cure of Souls of the Inhabitants of the fard Parish of Gateshead Fell.

XXII. And be it further enacted, That the faid new Church and Chancel, with the Church Yard or Cemetry thereof, (fubject to the Refervation hereinbefore contained, to or in Favour of the Lord of the faid Manor of Gateshead for the Time being, and his Leffee and Leffees, and his, her, and their Executors, Adminiftrators, and Affigns), fhill from and immediately after the Confecration thereof, and from and thenceforth for ever thereafter, be velted in the Rector of the fame Church, and his Secceffors, Rectors thereof, for the Time being, the Statutes of Mortmain, or any other Laws or Statutes to the contrary notwithstanding; and that Divine Service according to the Ulage of the Church of England, Banns of Marriage, the Solemnization of Marriage, the Adminiftration of the Sacrament of the Lord's Supper and Baptifm, Burials, and all other Rites and Ceremonies of the Church of England thall and may be performed, Rr 2
