An A& to explain and amend an A&t paffed in the Thirty-eighth Year of His prefent Majefty, for incloting Lands in the Manor and Parish of Portbury, in the County of Somerfet. [20th May 1809.] XVII. And be it further enacted, That if any Perfon or Perfons fhall wilfully and maliciously cut, break down, demolish, or destroy any Bank, Dam, Flood-gate, Sluice, or other Works already made, or which fhall at any Time hereafter be made or erected, fupported, maintained, or ufed, in pursuance of the faid recited Act or of this Act, within the faid Common, for protecting the faid Lands called Portbury Wharf from the Sea, or for draining the fame, every Perfon fo offending, and being convicted, fhall be guilty of Felony, and the Court before whom fuch Perfon or Perfous fhall be tried and convicted fhall have Power and Authority to caufe fuch Perfon or Per fous to be tranfported for Seven Years, or in Mitigation of fuch Punishment may award fuch Sentence as the Law directs in Cafes of Petty Larceny."

An A& for repealing fuch Part of an A&t paffed in the Forty-third 43 G. 3.e.wi. Year of His prefent Majefty, as impofes a certain Proportion of 47 G. 3.A.2. the County Rate for the County of Kent upon the Eaftern Divifion c.xxxiv. of the faid County, and certain Proportions upon the Western Divifion of the faid County; and alfo, so much of an Act paffed in the Forty feventh Year of His prefent Majefty, for empowering the Juttices of the Peace for the County of Kent to make a fair and equal County Rate for the faid County, as directs the Churchwardens and Overfeers therein mentioned, to make certain Returns of the Rental or Value of Eftates within their Parishes at the Periods and in the Manner therein mentioned, and impofes a certain Penalty upon fuch Churchwardens and Overfeers for making Default therein, and for amending the Powers and Provifions of the faid Acts. IV. And be it further enacted, That the Juftices who fhall be Juftices at the affembled at the Eofler Quarter Seffions of the Peace to be holden for Eaker Quarter the faid County in each and every Year fhall and they are hereby directed and required to appoint a Committee of Twelve Juftices (that is to fay), Six Juftices acting in the Enftern Division, and Six Juftices

A.D. 1809 Accounts of the acting in the Western Divifion of the faid County, of which Committee of Twelve Juftices the Chairman for the Time being of each Divifion of the faid County fhall always be one, and fhall meet at Sit-" tingbourne aforefaid, on the Friday next preceding the Saint Thomas's or Midfummer General Quarter Seffions in every Year, for the Purpose of examining, paffing, adjulting, and allowing the feveral Accounts of the respective Treasurers of the faid Two Divisions of the faid County; and that fuch Meeting fhall always commence and originally be hoiden at Sittingbourne aforefaid, but the fame may from Time to Time be adjourned as Occafion may require to Sittingbourne aforefaid, and the Juttices to appointed and prefent at fuch Meeting, or any Adjournment thereof, fhall have full Power and Authority, and they are hereby directed to inquire into, and examine, pafs, and allow the fad Accounts of the faid Treasurers; and the faid Accourts fhall be examined, paffed. and allowed folely and exclufively at the faid Meeting, or fome Adjournmeat thereof.

V. Provided always, and be it further enacted, That no fuch Meeting fhall be effectual or competent to tranfact the feveral Matters and Things herein before directed to be done and tranfacted at fuch Meeting as aforefaid, unless Three at the leaft of the Justices acting in each Divifion of the faid County, appointed as aforefaid, fhall be then prefent, but that fuch Meeting fhall neceffarily be adjourned until Three Juflices of each Divifion of the faid County fo appointed as aforefaid, thall be fo prefent as aforefaid; and in cafe no fuch Juftice or Juftices fhall attend at the faid Meeting, then the Clerk of the Peace or his Deputy fhail adjourn the fame, of which Adjournment the faid Clerk of the Peace or his Deputy fhall forthwith give Notice to the feveral Members of the faid Committee.

"43 G. 3. c. lvii. § 5. fo far as it requires that County Rates under 12 G. 2. c. 29. fhall be made for the whole County, repealed. § 6. VII. And be it further enacted, That from and after the paffiug of this A&t it fhall and may be lawful for the Juftices affen.bled at the Quarter Seffions holden for the Western Divifion of the faid County, and for the Juftices affembled at the Quarter Seffions holden for the Eaglern Divition of the faid County, to make fuch Rate or Assessment for raifing fuch Sum and Sums of Money within each such Divifion respectively, as fhall be fufficient to answer the Ends and Purposes mentioned and contained in the before recited A&t, paffed in the Twelfth Year of the Reign of His late Majefty King George the Second, as Occafion may demand, or as the Exigencies of each such Divifion may require, and alfo for the Ends and Purposes of this A&; and that fuch refpective Rates and Aff:ffments fhall be as legal and effectual to all Intents and Purposes whatsoever, as if one general Rate had been made for the whole of the faid County; and that all and every the Sum and Sums of Money in and by fuch Rates or Affeffments rated or affelled upon the feveral Towns, Parifhes, Precincts, Vills, Hamlets, and Places fituate within the Western Division of the faid County, fhail be paid to the Treafurer of the faid Wellern Divifion and all and every the Sum and Sumns of Money in and by fuch Rates or Affeffments rated or aff:ffed upon the feveral Towns, Parishes, Precincts, Vills, Hamlets, and P.aces fituate within the Eastern Divilion of the faid County, fhall be paid to the Treasurer of the faid Eastern Div.fion.

VIII. And be it further enacted, That the Treafurer and Treasurers Treafurers fhall appointed and to be appointed for each Divifion of the faid County, account for fhall and he and they is and are hereby required, not more than Ten, Balances in nor less than Seven Days at least, previous to every Eafter Quarter Hand, &c.

Seffions of the Peace to be holden for the faid County, to tranfmit or cause to be tranfmitted to the Clerk of the Peace for the faid County, or to his Deputy, an Account in Writing under the refpective Hands of the Treasurer for each Divifion of the faid County, of the Balance then remaining in the Hands of each fuch Treasurer refpe&ively; and alfo an Account of the Sum of the grofs Expenditure of each fuch re fpe&tive Treasurer fince the Eafler Quarter Seffions preceding to the Time of making up and delivering fuch Account; and alfo an Efti mate of the further probable Expence, to be incurred up to the faid Eafter Quarter Seffions inclufive, in order that the Clerk of the Peace or his Deputy may and he is hereby required to lay the fame before the Juftices to be affembled at the Lafler Quarter Seffions of the Peace to be holden for the faid County, for their Information.

IX. And be it further enacted, That every fuch Rate or Affeffment Rates shall be fo to be mad and affeffed as aforefaid shall be made and affeffed upon made on the the relative Rentals of each Divifion of the faid County, as the fame relative Rentals fhall have been returned and afcertained under and by virtue of the of each Divifion, Directions and Provifions of the before recited Act, paffed in the See 47 6.3. Forty-feventh Year of the Reign of His prefent Majefty, and as Auch Rentals may be exifting at the Michaelmas Quarter Seffions of the Peace to be holden for the faid County of Kent, next and im mediately preceding the Meeting of the Committee of Twelve Juftices appointed to be holden at Sittingbourne as aforefaid.

And be it further enacted, That whenever the Juftices, affembled at any General Quarter Seffions of the Peace to be holden for the faid County, whether the fame fhall be originally holden in the Eofern or Western Divifion of the faid County, fhall determine that it is necef- County. fary to revife, correct, and re-ascertain the Rental of the whole County, they fhali immediately fignify fuch their Determination to the Jattices to be affembled in Seffions in the other Divifion of the faid County, in order that fuch Juftices may and they are hereby required to appoint a Committee of Three Juftices from each Divifion of the faid County, for the Purposes hereafter-mentioned, of which Committee any Five of fuch Juftices fhall be competent to act, and fuch Committee fhall meet as loon after fuch Appointment as shall be mutually agreed upon between them, in order to revife, correct, and reafcertain the Rental of the whole County, and the relative Rentals of each Divifion thereof diftin&tly, upon the fame and as juft and equitable Frinciples as they can, by virtue of and under the Powers, Provitions, and Directions of the before recited Act, paffed in the Forty-feventh Year of the Reign of His prefent Majefty, and alfo of this Act, and fuch Revition, Correction. and Afcertainment fo to be made as aforefaid, fhall be final and conclufive to all Intents and Purpofes, and binding upon the feveral Parties to be affected thereby, antil another Revifion. Correction, and Afcertainment, fhall take place and be made in Manner as aforefaid, laving nevertheless to the

feveral Parties who may confider themselves aggrieved thereby, fuch Powers of Appeal, and in fuch Manner as is contained in the said before recited A&t of the Forty-feventh Year of the Reign of His prefent Majefty, and alfo of this A&t: Provided always, that no fuch Revifion, Correction, or Afcertainment, fhall again take place until after the Expiration of Three Years from the Time of making fuch laft Revifion, Correction, or Ascertainment.

XII. And be it further enacted, That the Place of Meeting of the faid Committee fo to be appointed for the Purposes laft aforesaid, fhall always be, for the Eastern Divifion, at the Seffions House for the faid Eaflern Divifion, and for the Weflern Division, at Maidstone in the faid County, and the Juftices then prefent fhall have full Power to adjourn the fame from Time to Time to fuch Place as they may judge more convenient.

XIII. And in order to enable the said Juftices of the Peace to form a proper Judgment of any Rate or Rates to be made in pur. fuance of this Act, and to grant proper Relief;' Be it further enacted, That the faid Juftices of the Peace, or any Three or more of them, or the faid Clerk of the Peace for the faid County, acting under their Authority, shall and may and they and he are and is hereby authorized and empowered, from Time to Time during the Execution of this Act, to caufe any of the Books of Affeffment of the Property or Income Tax, fo far as the fame relate or refer to or in any wife concern the Statement of Property to be fet forth and ftated in the Schedule (A.) contained in an Act, paffed in the Forty-fixth Year of the Reign of His prefent Majefty, intituled, An Ad for granting to His Majefly during the prefent War, and until the Sixth Day of April next after the Ratification of any Definitive Treaty of Peace, further additional Rates and Duties in Great Britain, on Profits arifing from Property, Profeffions, Trades, and Offices; and for repealing an A&, passed in the Forty-fifth Year of His prefent Majefly, for granting a Contribution on the Profits arifing from Property. Profeffions, Trades, and Offices, and to confolidate and render more effectual the Provifions for collecting the faid Duties; and the Rental or Valuation by which fuch Affeffments are made, mentioned, and defcribed, within any Parish or Place within the faid County, to be brought before them or him, and to take Copies of fuch Books, or any Part or Parts thereof, as they, he, or any of them shall think fit, fuch Compenfation being made to the Parties producing the fame refpectively as the faid Juftices, or any Three or more of them, fhall think reasonable; and if any Perfon or Perfons in whofe Cuftody or Power any of the faid Books fhall be fhall negle& or refufe to attend the faid Juftices, or the said Clerk of the Peace, with fuch Book or Books, or to permit them, him, or any of them, to take Copies thereof as aforefaid, then and in every fuch Cafe every Perfon who fhall fo refuse or negle, shall for every tuch Offence forfeit and pay the Sum of Ten Pounds, to be recovered by Diftrefs and Sale of the Goods and Chattels of the Offender or Offenders, Person or Perfons, so making Default, together with the Charges of fuch Diftrefs and Sale, by Warrant under the Hand and Seal of any One Juftice of the Peace for the faid County, rendering the Overplus to the Party or Parties refpectively, on whofe Goods and Chattels fuch Diftrefs and Sale fhall be fo made as aforefaid, and the fame Penalties or Forfeitures, when recovered and
