Arrears of former Warrants, and attend the Term

Grand Juries upon Notice, &c.

fore enacted, by the Authority aforefaid, That it fhall and may be lawful for the Grand Juries of the faid City of Dublin at each Eafter and Michaelmas Term to prefent any Sum of Money not exceeding the Sum of One hundred and fifty Pounds for the Treasurer, and any Sum not exceeding the Sum of Seventy-five Pounds for the Secretary, which Sums fhall be in lieu of the Sums heretofore presented under the Authority of the faid recited Act made in the Thirty-third Year of the Reign of His prefent Majefty for the Treasurer and Se

cretary.

IX. And Whereas it would tend to facilitate the Recovery from the Collectors and their Securities of the Publick Money received by fuch Collectors, and unaccounted for by them, if the Recognizances which are entered into by them and lodged in the Town Clerk's Office of the faid City, were returned into His Majesty's • Court of King's Bench, by a more fummary Mode than that at pre'fent ufed;' Be it therefore enacted, by the Authority aforefaid, That whenever it may be found neceffary to fue upon any fuch RecogniZance, it fhall and may be lawful to and for the Town Clerk of the faid City, and he is hereby required, upon Notice given to him for that Purpose by the Secretary of the Term Grand Jury for the Time being, forthwith to lodge fuch Recognizance or Recognizances in the Office of the Prothonotor in His Majefty's Court of King's Bench, who is hereby directed to receive and keep the fame amongst the Records of the faid Court, and it fhall not be neceffary to iffue any Certiorari or other Writ for the Purpose of removing fuch Recognizances, and that immediately upon fuch Removal the faid Secretary of the Grand Jury fhall proceed to fue thereon, as if the fame had been duly retained by virtue of any Certiorari or other Writ whatsoever.

X. And Whereas a great Difficulty has arifen in providing for the Publick Creditors, by reason of the respective Churchwardens refusing to re-applot the infolvent uncollected Arrears of former Warrants;' Be it therefore enacted, by the Authority aforesaid, Charchwardens That it fhail and may be lawful for the feveral Churchwardens in the fhall re-applot respective Parishes in the County of the faid City of Dublin, and they are hereby required to re-applot fuch infolvent uncollected Arrears of former Warrants, and alfo to attend the refpective Term Grand Juries upon receiving Twenty-four Hours' Notice in Writing, to be delivered to him or them, or left at his or their laft or ufual Place or Places of Abode, so to do, in order to be examined by fuch refpective Grand Juries, touching the applotting of the Publick Money, and that in default of their not fo re-applotting or attending the faid refpective Grand Juries when fo required, upon Affidavit thereof it fhall and may be lawful for the Court of King's Bench, upon Application of the faid refpective Grand Juries, to fine every fuch Churchwarden fo offending in any Sum not exceeding Fifty Pounds, fuch Fine to be recovered by Warrant of Diftrefe, figned by any Judge of the faid Court of King's Bench, and by Sale of the Goods and Chattels of fuch Churchwarden or Churchwardens, and fuch Fine, when recovered, fhall go to, and be applied by the Governors of the Hofpital and Free School of King Charles the Second, in Oxmantown Green, commonly called the Blue Coat Hofpital.

XI. And be it further enacted, by the Authority aforefaid, That the feveral Collectors prefented and appointed by the refpective

Grand Juries, to collect the Publick Money of the County of the them weekly faid City of Dublin, fhall on Saturday in each and every Week between to Treasurer. the Hours of Ten in the Forenoon, and Two in the Afternoon, pay to the Treasurer of the Publick Money fuch Sum as each and every of them fhall have collected during the faid Week, taking a Receipt in Writing for the fame, which the Treafurer of the Publick Money is hereby required to give to each fuch Colle&tor, for fuch Sums as he fhall fo pay in; and that on or before the Monday next following, the Treasurer of the Publick Money fhall pay into the Bank of Ireland, to the Credit of the County of the faid City of Dublin, all fuch Sums as he fhall have received from the feveral Collectors during the preceding Week, taking a Receipt in Writing for the fame, which the proper Officer of the faid Bank is hereby required to give; and each and every fuch Collector fhall on each Saturday make Oath before the Lord Mayor, or any Juftice of the Peace of the faid City of Dublin, (which Oath they are hereby authorised to adminifter.) that the Monies fo paid by him to the Treasurer of the Publick Money, were the full Amount of the Monies received by him during that Week, and in cafe any Collector fhall omit or refufe to comply herewith, and to pay in the Money as directed by this Act, then and in every fuch Cafe he or his Securities fhall for every fuch Offence forfeit and pay the Sum of Fifty Pounds, to be recovered in a fummary Way on Complaint to the Court of King's Bench, and levied by Warrant of Diftrefs and Sale of the Goods and Chattels of fuch Collector as aforefaid, and go to and be applied to the Ufe of the Blue-Coat Hofpital, as herein-before mentioned, and every fuch Collector fo offending fhall alfo be removed from his faid Office of Collector.

XII. And be it further enacted by the Authority aforefaid, That Treasurer on the the faid Treasurer of the Publick Money fhall on the first fitting Day firit Day of of each Term, make Oath before one of the Judges of the Court of Term fhall make King's Bench, that he did on or before the Monday pay into the Bank of Ireland the feveral Sums which he received each Week from the faid feveral Collectors as directed by this A&t.

XIII. And Whereas it would tend much to the Regularity of the Publick Acounts if the Drafts on the Bank of Ireland should 'be made payable to Order, inftead of being made payable to Bearer, in Manner directed by an A&t made in the Forty-feventh Year of the Reign of His prefent Majefty, intituled, An Ad for improving and rendering more commodious fuch Part of the County and County of the City of Dublin as is fituate on the South Side of the River Anna Liffey, and Weft of His Majefty's Cafle of Dublin, and for the Appointment of an Infpector of the Prefentments and other Accounts of the County of the City of Dublin;' Be it therefore enacted by the Authority aforefaid, That the Form of the Drafts as directed by the faid recited Form of Drafts A&t of the Thirty-third Year of the Reign of His prefent Majefty, under recited A& and alfo by the faid recited At made in the Forty-feventh Year of 33 G. 3. c. 56. the Reign of His prefent Majefty, fhall be altered, and inftead thereof and under Act the Infpector of Publick Accounts fhall, on the lalt Day of each c. lxxiv. altered, Term, as directed by the faid recited Act of the Forty-feventh Year and made payable. of the Reign of His prefent Majefty, produce to the Grand Jury to Order. engraven Drafts in the Form following, payable to the Perfons who fwore to the Expenditure of the Money, and whofe Accounts were

XIV. And Whereas the Sum which the Grand Jury of the County of the City of of Dublin is now enabled to prefent for Medi⚫cine and Neceffaries for the different Prifons in the faid City, is found to be totally inadequate to provide for fame;' Be it therefore enacted, by the Authority aforefaid, That the Grand Jury of the County of the City of Dublin fhall and may prefent fuch Sum or Sums of Money for Medicine and Necefferies as fhall be ordered by the Phyfician and Surgeon attending fuch Prifone, and which the Apothecary to the faid Prifons fhall make appear by his Affidavit, in which Affidavit the faid Apothecary fhall fwear that he had faithfully and honeftly expended, and that fuch Medicines and Neceffaries were of the beft Quality, and were the ufual Charges at which Medicines and Neceffaries of the fame Quality were charged within the said City, and that the fame were ordered by the Phyfician attending fuch Prifon before they were fupplied: Provided nevertheless that the Sums prefented for fuch Medicines and Neceffaries fhall not in any Year exceed the Sum of Five hundred Pounds.

XV. And for the better Protection of the Publick againft Impofition in the Charges made by the faid Apothecary for fuch Medicines;' Be it further enacted, by the Authority aforesaid, That the feveral Grand Juries for the County of the faid City of Dublin may, when they think fit, or the Court of King's Bench, if the fame fhall appear to them proper, order fuch Account to be laid before the Governor and Directors of Apothecaries' Hall, to be taxed by the faid Governor and Directors, which they are hereby authorized and required to do; and that the faid Grand Jury fhall have Power to prefent for the Expence incurred by fuch Examination.

XVI. And be it further enacted, by the Authority aforefaid, That the faid Apothecary fhall bring forward at each presenting Term Two feparate and diftinct Prefentments, one for Medicine and the other for Neceffaries, ftating the different Articles comprized under the latter Head; and it fall and may be lawful for the faid Grand Jury at each prefenting Term after the paffing of this Act, to prefent the Sum of Ten Pounds to be paid to the faid Apothecary, as a Compenfation for his Trouble in providing the faid Neceffaries for the faid Prifon, and advancing his own Money for that Purpose.

XVII. And Whereas the Coroners of the County of the faid City of Dublin are often obliged to hold Inquefts in Gaols and Prifons, and on the Banks of the River, and the Fees thereon are found to be a heavy Tax on the Parishes where fuch Gaols and Prifons are, and where the faid River runs ;' Be it therefore enacted, by the Authority aforefaid, That from and after the paffing of this Act it fhall and may be lawful for the Grand Jury of the County of the faid

faid City at the Court of King's Bench, to prefent fuch Sums of Money as they fhall think neceffary for all Inquefts held in the faid City, not exceeding the Sum of Thirteen Shillings and Four-pence Sterling, for each, to be raised on the City at large, and pay the fame to the Coroner or Coroners of the County of the faid City of Dublin, for each and every Inquifition duly taken by fuch Coroner or Coronera upon View of the Body lying within the County of the faid City, as a Recompence for his or their Labour, Pains, and Charges in taking fuch Inquifition; and all fuch Sum or Sums of Money so presented to and received by fuch Coroner or Coroners fhall be taken and ac cepted by him and them in lieu of all Fees or Sums of Money which he or they fhall have been accuftomed to receive or demand as aforefaid.

XVIII. And be it further enacted, by the Authority aforefaid, Notice of Goods That if any Collector, Deputy Collector, Conftable, or other Perfon taken in Distress empowered to collect the Publick Money under the faid recited Act by Collector shall be posted up. made in the Thirty-third Year of the Reign of His prefent Majefty, and this Act, or either of them, fhall take any Diftrefs upon the Premifes of any Perfon refufing to pay his or her Proportion of the Publick Cefs, fuch Collector, Deputy Collector, Conftable, or Perfon empowered to collect, taking fuch Diftrefs, fhall poft a Notice in Writing by him figned, on the ufual Place of Notices being pofted in the Parish where fuch Diftrefs was taken, fetting forth, that upon the Seventh Day following he will fell fuch Diftrefs by publick Cant at that Place; and it fhall be lawful for fuch Perfon who took fuch Diftrefs there to fell it to the beft Bidder, and after deducting the Amount of the Cefs, and One Shilling and One Penny in the Pound for his Trouble in making fuch Diftrefs, and One Shilling and One Penny per Night for the Charges of keeping fuch Diftress, in case a Horfe, or any other Beaft fhall be diftrained, he fhall return the Overplus (if any) to the Perfon from whom fuch Diftrefs was taken, and in cafe any Perfon or Perfons fhall, at any Time hereafter, bring or caufe to be brought any Replevin or Replevins, or any other Action at Law, whereby to prevent or obstruct the levying of all or any Part of the Publick Money under the faid recited A&t made in the Thirtythird Year of the Reign of His prefent Majefty, and of this Act or either of them, then, and in every fuch Cafe, the Collector or Collectors, or his or their Sureties, Constable or Conftables, who fhall distrain for the fame, fhall be enabled to avow, acknowledge, juftify, and defend fuch Taking, by pleading, avowing, or making Connufance generally, that he took the Goods and Chattels in the Plaintiff's Declaration mentioned, by virtue of fuch Act or of this Act, as the Cafe may be, for the Cefs for which fuch Diftrefs fhall be made due and payable, and in Arrear, out of the Premifes whereon fuch Distress shall be made, which Cefs was then and ftill remains due, without further fetting forth any Proceedings had under fuch A&t or this Act, or fetting forth fpecially the Warrant or Authority of fuch Collector, or his Surety, or of fuch Conftable or other Perfon fo acting under fuch Act or this Act; and if the Plaintiff or Plaintiffs in fuch Replevin, or the Perfon or Perfona bringing or caufing to be brought fuch Replevin fhall be non-fuited, or a Verdict fhall be found, or Judgment on Demurrer fhall pass against him, her, or them, that then and in that Cafe he, she, or they, fhall pay Treble Cofts.

Cap. xxii. An Act for explaining and amending an A&t paffed in the Thirtyfirft Year of His prefent Majesty, for the better Maintenance and Support of the Poor of the Parish of Sunderland near the Sea, in the County Palatine of Durham, and for increafing the Rates therein directed to be impofed. [28th April 1809.]

An A&t for making and maintaining a Railway or Tram Road from
the River Severn at the Quay in the City of Gloucefler, to or near to
a certain Gate in or near the Town of Cheltenham in the County of
Gloucefter, called The Knapp Toll Gate, with a collateral Branch to
the Top of Leckhampton Hill, in the Parish of Leckhampton, in the
faid County.
[28th April 1809.]

"The Gloucester and Cheltenham Railway Company incorporated. § 1.

LXXVI. And be it further enacted, That if any Perfon or Perfons fhall wilfully, maliciously, and to the Prejudice of the said Undertaking, break, throw down, damage, deftroy, fteal, or take away any Part of the faid Railway or Tram road or Collateral Branch, or other Works to be erected and made by virtue of this Act, or do any other wilful Hurt or Mischief to obftruct, hinder, or prevent the carrying on, completing, fupporting and maintaining the fame, every Perfon fo offending and being thereof lawfully convicted, fhall be fubject and liable to the like Pains and Penalties as in Cafes of Felony; and the Court by and before whom fuch Perfon fhall be tried and convicted, fhall have Power and Authority to cause fuch Perfon to be punished in like Manner as Felons are directed to be purifhed by the Laws or Statutes of this Realm, or in Mitigation of such Punishment, fuch Courts may, if they think fit, award fuch Sentence as the Law directs in Cafes of Petit Larceny, or otherwife every Perfon fo offending, and being thereof lawfully convicted on the Oath of One credible Witnefs, before Two or more of His Majefty's Juices of the Peace for the County of Gloucefter, fhall forfeit any Sum not less than Double the Value of the Damage proved on Oath to be done, at the Discretion of fuch Juftices, fuch Penalty, together with reasonable Coits, to be levied by Diftrefs and Sale of the Goods and Chattels of such Offenders, rendering the Overplus (if any) to fuch Offender, or fuch Offender fhall and may be committed to the Common Gaol for the said County of Gloucefter, for any Time not exceeding Six Calendar Months, at the Discretion of fuch Juftice or Juftices before whom fuch Offender fhall be convicted; provided that nothing herein contained shall extend
