X. XII. And whereas the Parliament of Ireland never enacted any • Provifions fimilar to thofe contained in the faid recited Act of the Fifth and Sixth Years of King Edward the Sixth: And whereas it hath always been cuftomary in the Appointment of the Mafters ⚫ and Six Clerks, and Firft and Second Examiners of the Court of Chancery in Ireland, to allow the having and receiving of Money, or • other valuable Confideration for those Appointments; and although it may be fit and proper that the faid Custom fhould be abolished, yet it is reafonable that the feveral and refpective Perfons who now hold the faid Offices fhould be permitted to difpofe of the fame in • like Manner as hath been heretofore done;' Be it therefore enacted, That it fhali and may be lawful for the faid Malters and Six Clerks, and First and Second Examiner or any of them, (fave and except George Ellis Efquire, one of the Mafters of the taid Court,) fo to pro

ceed touching the Difpofition and Appointment of their faid Offices refpectively, in fuch and the like Manner, to all Intents and Purposes, as hath been heretofore accustomed; but that from and after the Death, Refignation, or Removal of each of them, and the actual Appointment of any Perfon in the Stead of the Perfons fo dying, refigning, or being removed, the Powers and Provifions of the faid recited A&t and of this Act fhall be applicable and shall be applied to the faid refpe&tive Offices in the faid Court of Chancery in Ireland.

XIII. Provided always, and be it enacted, That every Períon Mildemeanors in who fhall commit, in Scotland, any Offence against this A&t, which by the Provifions of the fame is conftituted a Mifdemeanor, fhall be liable to be punished by Fine and Imprifonment, or by the one or the other of fuch Punishments as the Judge or Judges before whom fuch Offender fhall be tried and convicted may direct.

XIV. And be it further enacted, That all Offences committed against the Provifions of the faid recited A&t and this Act, by any Governor, Lieutenant Governors, or Perfon braving the chief Command, Civil or Military, in any of His Majelly's Dominions, Colonies, or Plantations, or his or their Secretary or Secretaries, may and shall be profecuted and enquired of, and heard and determined in His Majefty's Court of King's Bench at Wefiminfter, in like Manner as any Crime, Offence, or Mifdemeanor committed by any Perfon holding a publick Employment abroad, may be profecuted and enquired of under the Provifions of an Act paffed in the Forty-fecond Year of the Reign of His prefent Majefty, intituled, An Ad for the trying and punishing in Great Britain Perfons holding publick Employments, for Offences committed abroad; and for extending the Provifions of an A& paffed in the Twenty-first Year of the Reign of King James, made for the Eafe of Juftices and others in pleading in Suits brought against them, to all Perfons either in or out of this Kingdom,, authorized to commit to fafe Cuftody.

XV. Provided always, and be it further enacted, That nothing in the faid recited A&t or this A&t contained fhall extend or be conftrued to extend to Gibraltar, Malta, or any Piace or Places in the Mediterranean, until Three Months; or to any of His Majesty's Dominions, Colonies, or Plantations in America or the West Indies, until Four Months; or to the Cape of Good Hope, the Ifland of Saint Helena, or any Part of Africa, until Six Months; or to any of His Majefty's Dominions in the Eaft Indies or beyond the Cape of Good Hope, until Twelve Months, after the paffing of this Act.

HEREAS an Act was paffed in the Thirty-ninth Year of His prefent Majefty's Reign, intituled, An Ad for the Augmentation of the Salaries of the Judges of the Courts in Weltminder Hall, and alfo of the Lords of Seffion, Lords Commiffioners of Juficiary, and Barons of Exchequer in Scotland, and for enabling

His Majefly to grant Annuities to Perfons in certain Offices in the faid Courts of Weltminster-Hall, on their Refignation of their respective Offices: And Whereas it is expedient that a further Augmentation 'fhould be made in the Salaries and Profits of the Chief Baron of the • Court of Exchequer, the Puifne Judges in the Court of King's Bench, the Puifne Judges of the Court of Common Pleas, and the Barons of the Coif in the Court of Exchequer at Weflminfler, and alfo in the Salaries and Profits of the Chief Juftice of Chefler, the Second Juftice of Chefler, and the Juftices of Great Seffions for the Counties in Wales; we your Majetty's molt dutiful and loyal Subjects, the Commons of the United Kingdom of Great Britain and • Ireland in Parliament affembled, do most humbly befeech Your Majefty that it may be enacted;' and be it enacted by the King's mot Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That fo much of the faid recited Act as relates to the Amounts of the Sums to be iffued in Augmentation of their refpective Salaries to the Chief Baron of the Court of Exchequer, to the Puifne Juttices in the Courts of King's Bench and Common Pleas, and to the Barons of the Coif in the Court of Exchequer, fhall be, and the fame is hereby repealed.

II. Money as have been directed by any former A&t or Acts of Parliament, Judge and Baron to be paid out of the fame, but with Preference to all other Payments 4000l. which fhall or may be hereafter charged upon or payable out of the faid Fund,) to the feveral Perfons hereinafter mentioned, as an Augmentation of their refective Salaries fo much Money as will make up their respective Salaries and pecuniary Profits belonging to their faid refpective, Offices to the annual Sums hereinafter mentioned, to the Chief Baron of the Court of Exchequer, Five thoufand Pounds, and to each of the Puifae Juftices of the Courts of King's Bench and Common Pleas, and to each of the Barons of the Coif in the Court of Exchequer, Four thoufand Pounds.

III. IV. And Whereas by the faid recited A&t it is directed that an

A.D. 1809. Offices for the preceding Half Year: And Whereas by Writ of • Privy Seal granted in the Second Year of His prefent Majefty's Reign, reciting that a Reward of Forty Pounds per Annum at the Rate of Ten Pounds in every Term had long fince been affigned to the Second Judge of the Court of King's Bench, in respect of his Labour and Trouble in giving the Charge to the Grand Jury, ' and pronouncing Judgement in the faid Court again ft Malefactors, it was directed, that regular Payment should be made of the aforefaid termly Allowance of Ten Pounds to the faid Second Judge of the faid Court for the Time being, in refpect of his Pains and Service above-mentioned: And whereas Doubts have beer entertained whether the faid Allowance of Forty Pounds was intended to be included in the Half-yearly Account of Salary, Fees, and pecuniary Profits, to be delivered in to the Commiffioners of the Treafury by the faid Second Judge of the faid Court of King's Bench under the faid recited A&;' Be it therefore enacted and declared, That the faid termly Allowance of Forty Pounds is not nor was intended to be included in the faid Half-yearly Account to be delivered as afore faid, by the faid Second Judge of the faid Court of King's Bench, nor in the Efimate of Salary, Fees, and pecuniary Profits, upon which the Amount of the Sums to be issued from Time to Time to the faid Second Judge under the said recited A&t and this Act was or is to be computed.

V. And be it further enacted, That from and after the paffing of this A&t, there fhall be alfo iffued, paid, and pavable out of and charged and chargeable upon the faid Confolidated Fund, after paving and referving fufficient to pay all fuch Sum and Sums of Money as have been directed by any former A&t or Acts of Parliament to be paid out of the fame, but with Preference to all other Payments the Counties of which fhall or may be hereafter charged upon or payable out of the Wales. faid Fund, to the feveral Perfons herein-after mentioned, in Augmentation of their refpective Salaries and Profits, and over and above any Sums of Money to which they may be entitled under any A& now in force, the feveral annual Sums herein after mentioned; that is to fay, to the Chief Jaitice of Chefier, and to the Second Jultice of Cheller, and to each of the Juftices of the Great Seffi ns for the Counties of Wales, the Sum of Four Hundred Pounds.

VI. And be it further enacted, That the faid feveral Sums of Money to be iffued in purfuance of this A&t, fhall from Time to Time from thenceforth, be payable and paid Half-yearly, free and clear from all Taxes and Deductions whatfoever, (except the Duty charged by an A&t paffed in the Forty-fixth Year of the Reign of His pretent Mejetty, intituled, An Ad for granting to His Majefly during the prefent War, and until the Sixth Day of April next after the Ratification of a Definitive Treaty of Peace. further additional Rates and Duties in Great Britain, on the Rates and Duties on Profits arifing from Property, Profeffions, Trades, and Offices; and for repealing an Ad paffed in the Forty fifth Year of His prefent Majefty, for repealing certain Parts of an A made in the Forty third Year of His prefent Majefty, for grant ng a Contribution on the Profits arifing from Property. Trades, and Offices, and to confolidate and render more effectual the Provifions for collecting the faid Duties,) on the Tenth Day of Qabber and the Fifth Day of April in each Year, by even and equal Portions: the First Payment thereupon to be made on the Tenth Day of Odober

One thousand eight hundred and nine, and the faid feveral Sums of Money fhall be paid in the fame Manner, and under and subject to the like Rules and Regulations, (as far as the fame are applicable) as are prescribed in the faid recited A&t for the Payment of the feveral Sums of Money therein directed to be paid.

And be it further enacted, That the faid recited A&t, and all Powers of recited Claufes, Provifions, Rules, Regulations, Matters, and Things therein Act extended to contained (fo far as the fame are applicable and are not hereby altered) fhall be in force, and be applied to carry into Effect the Purposes of this A&.
