Money, Fee, or Reward; and that all and every fuch Bargains, Sales, Promifes, Bonds, Agreements, Covenants, and Affurances as before specified fhould be void to and against him and them by whom any fuch Bargain, Sale, Bond, Promife, Covenant, or Af · furance fhould be had or made: And Whereas it was in the faid A&t provided, that the faid A&t, or any Thing therein contained, fhould not in anvwife extend to any Office or Offices, whereof any • Perfon or Perfons was or fhou be feifed of any Eftate of Inheritance, nor to any Office of Parkerfhip, or of the keeping of any Park, Houfe, Manor, Garden, Chafe, or Foreft, or to any of them: • And Whereas it was by the faid A& further provided, that if any Perfon or Perfons did thereafter offend in any Thing contrary to the Tenor and Effect of the faid A&t, yet that notwithstanding all Judgments given, and all other A&t and A&s executed or done by any fuch Perfon or Perfons foffending by Authority or Colour of the Office or Deputation which ought to be forfeited or not ⚫ occupied or not enjoyed by the Perfon fo offending, after the faid Offence fo by fuch Perfon committed or done, and before fuch Perfon fo offending for the fame Offence fhould be removed from the Exercife, Adminiftration, and Occupation of the faid Office or Deputation, fhould be and remain good and fufficient in Law, to ali Intents, Conftructions, and Purpofes, in fuch like Manuer and Form as the fame would or ought to have remained and been if this A

had never been had or made; And Whereas it was by the faid A further provided, that the faid A&, or any Thing therein contained, fhould not in any wife extend, or be prejudicial or hurtful to any of the Chief Juftices of the King's Courts, commonly called the King's Bench or Common Place, or to any of the Juftices of Affize, that then were or thereafter fhould be, but that they and every of them might do in every Bhalf touching or concerning any Office or Offices to be given or granted by them or any of them, as they or any of them might have done before the making of the faid Act: Be it therefore declared and enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal. and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after Provisions of the paffing of this Act, the faid A& and all the Provifions therein faid A&t, contained fhall extend and be conftrued to extend to Scotland and 5 & 6 Ed. 6. of His Majefty's Dominions, Colonies, or Plantations which now beleng or may hereafter belong to His Majefty, and alfo to all Offices, Commiffions, Places and Employments belonging to or under the Ap pointment or Controul of the United Company of Merchants of England trading to the East Indies, in as fuil and ample a Manner as if the Provifions of the faid A&t were repeated as to all fuch Offices, Commiffions, Places, and Employments, and made Part of this Act; and the faid A&t and this A&t, and ail the Clauses and Provifions therein refpectively contained, fhall be conftrued as one A&t, as if the fame had been herein repeated and re-enacted.

II. Provided always, and be it further enacted, That where the Right, Estate, or Intereft of any Perfon or Perfons shall be forfeited under any of the Provifions of the fail A&t or this Act, the Right of fuch Appointment fhall immediately veft in and belong to His Mejetty, his Heirs and Succeffors.

III. And be it further declared and enacted, That from and after the paffing of this Act, if any Perfon or Perfons fhall fell or bargain for the Sale of, or receive, have, or take any Money, Fee, Gratuity, Loan of Money, Reward, or Profit, directly or indirely, or any Promife, Agreement, Covenant, Contract, Bond or Affurance, or fhall by any Way, Device or Means contract or agree to receive or have any Money, Fee, Gratuity, Loan of Money, Reward or Profit, directly or indirectly, and alfo if any Perfon or Perfons fhail purchase or bargain for the Purchafe of, or give or pay any Money, Fee, Gratuity, Loan of Money, Reward or Profit, or make or enter into any Promife, Agreement, Covenant, Contract, Bond or Affuance to give or pay any Money, Fee, Gratuity, Loan of Money, Reward or Profit, or fhall by any Way, Means or Device, contract or agree to give or pay any Money, Fee, Gratuity, Loan of Money, Reward or Profit, directly or indirectly, for any Office, Commiffion, Place or Employment fpecified or defcribed in the faid recited Act or this Act, or within the true Intent or Meaning of the said Act, or this Act, or for any Deputation thereto, or for any Part, Parcel, or Participation of the Profits thereof, or for any Appointment or Nomination thereto or Relignation thereof, or for the Confent or Confents or Voice or Voices of any Perfon or Perfons to any fuch Appointment, Nomination or Refignation, then and in every fuch Cafe, every fuch Perfon, and alfo every Perfon who fhall wilfully and know. ingly aid, abet or affift fuch Perfon therein, fhall be deemed and adjudged guilty of a Misdemeanor.

IV. And be it further enacted, That from and after the paffing of this Act, if any Perfon or Perfons fhall receive, have, or take any Money, Fee, Reward, or Profit, directly or indirectly, or take any Promife, Agreement, Covenant, Contract, Bond, or Affurance, or by any Way, Means, or Device, contract or agree to receive or have any Money, Fee, Gratuity, Loan of Money, Reward or Profit, directly or indirectly, for any Intereft, Solicitation, Petition, Requeft, Recommendation, or Negociation whatever, made or to be made, or pretended to be made, or under any Pretence of making or caufing or procuring to be made any Intereft, Solicitation, Petition, Requeft, Recommendation or Negociation, in or about or in any wife touching, concerning, or relating to any Nomination, Appointment, or Deputation to or Refignation of any fuch Office, Commiffion, Place Employment as aforefaid, or under any Pretence for ufing or having

ufed any Intereft, Solicitation, Petition, Requeft, Recommendation or Negociation, in or about any fuch Nomination, Appointment, Deputation or Refignation, or for the obtaining or having obtained the Confent or Confents or Voice or Voices of any Perfon or Perfons as aforesaid to such Nomination, Appointment, Deputation or Refignation; and also if any Perfon or Perfous fhall give or pay or caufe or procure to be given or paid any Money, Fee, Gratuity, Loan of Money, Reward or Profit, or make or caufe or procure to be made any Promife, Agreement, Covenant, Contract, Bond or Affurance, or by any Way, Means, or Device, contract or agree or give or pay or caule or procure to be given or paid any Money, Fee, Gratuity, Loan of Money, Reward, or Profit for any Solicitation, Petition, Requeft, Recommendation or Negociation whatever, made or to be made, that shall in any wife touch, concern, or relate to any Nomination, Appointment, or Deputation to or Refignation of any fuch Office, Commiffion, Place, or Employment as aforefaid, or for the obtaining or having obtained, directly or indirectly, the Confent or Confents, or Voice or Voices of any Perfon or Perfons as aforefaid to any fuch Nomination, Appointment, Deputation, or Refignation; and alfo if any Perfon or Perfons fhall, for or in expectation of Gain, Fee, Gratuity, Loan of Money, Reward, or Profit, folicit, recommend, or negociate in any Manner for any Perfon or Perfons in any Matter that hall in any wife touch, concern, or relate to any fuch Nomination, Appointment, Deputation or Refignation aforefaid, or for the obtaining, directly or indirectly, the Confent or Confents or Voice or Voices of any Perfon or Perfons to any fuch Nomination, Appointment, or Deputation or Refignation aforefaid, then and every fuch Cafe every fuch Person, and alfo every Perfon who fhall wilfully and knowingly aid, abet, or affist fuch Perfon therein, fhall be deemed and adjudged guilty of a Mifdemeanor.

And Whereas on the Pretence of negociating or foliciting the Sale, Transfer, or Appointment of any Öffice or Offices which under the Exception of this Act or otherwise it may be lawful to fell, Offices for negociating the fame, and Advertisements may be published, by Means and under the Colour of which illegal Tranfactions intended to be prohibited by this Act may be carried on;' Be it therefore further enacted, That from and after the paffing of this Act, if any Perfon or Perfons fhall open or keep any House, Room, Office, or Place for the foliciting, tranfacting or negociating tranfacting in any Manner whatever any Bufinefs relating to Vacancies in, or the Bufinefs relating Sale or Purchase of, or Appointment, Nomination, or Deputation to Sale of to, or Refignation, Transfer, or Exchange of any Offices, Com- Offices, guilty miffions, Places, or Employments whatever in or under any Publick of a MifdeDepartment, then and in every fuch Cafe every fuch Perfon, and allo every Perfon who fhall wilfully and knowingly aid, abet, or affist therein, fhall be deemed and adjudged guilty of a Misdemeanor.

VII. Provided always, and be it further enacted. That nothing in this Act contained fhall extend or be conftrued to extend to any Parchafes, Sales, or Exchanges of any Commiffions or Appointments in the honourable Band of Gentlemen Pentioners, or in His Majesty's Ycoman Guard, or in the Marfhalfea, and the Court of the King of the Palace of the King at Wefiminfer, or to extend to any Pur hafee, Sales, or Exchanges of any Commiffions in His Majesty's Forces for fuch Prices as fhall be regulated and fixed by any Regu ation made or to be made by His Majefty in that Belalf, or to any Act or Thing done in relation thereto, by any Agents, provided that fuch Agen's fhall be Agents of Regiments authorized by the Commander in Chief of His Majcity's Forces, or by the Colonels or Commandants of Regiments or Corps, and fhall act therein under fuch Regulations. only as are or fhall from Time to Time be established by His Maj-fty, and fhall not caufe or procure, or knowingly permit or fuffer to be printed or advertised. any Advertisement or Advertisements, Propofal or Propofals for any Purchafe or Sale or Exchange of any Commithion, or any Negociation relating thereto, and fhall not receive or take any Money, Fee, Gratuity, or Reward, or any Promife. Provided alfo, and be it further enacted, That every Officer giving more than in His Majefty's Forces, who fhall take, accept, or receive, or pay, regulated Prices, or agree to pay, any larger Sum of Money, directly or indirectly, or paying Agents than what is allowed by any Regulations made by His Majefty in for negociating, relation to the Purchafe, Sale, or Exchange of Commiffions in His Commiffions, Majefty's Forces, or who fhall pay, or caule to be paid, any Sum of and be cafhiered; Money, to any Agent or Broker, or other Perfon, for negociating the Purchafe or Sale or Exchange of any fuch Commiffion, hall, on being convicted thereof by a General Court Martial, forfeit his Commiffion, and be cafhiered; and as an Encouragement for the Detection of fuch Practices, fuch Commiffion fo forfeited fhall be fold, and Half the regulated Valve (not exceeding Five hundred Pounds) fhall be paid to the Informer, and the other Half, or the Remainder, if more than Five hundred Pounds, fhall go and be applied as His Majefty thall order and direct, by any Regulations from Time to Time made in that B-half: Provided alfo, that every Perfon who shall fell his Commiffion in His Majelty's Forces, and not continue to hold any Commiffion in His Majetty's Forces, and fhall, upon or in relation to fuch Sale, take, accept, or receive, directly or indirectly, any Money, Fee, Gratuity. Loan of Money, Reward, or Profit, or any Promife, Agreement, Covenant, Contract, Bond, or Affurance, or hall by any Device or Means contract or
