Ships; and alío any Bounty Money given or granted by His Majefty
in refpect of the Service of any fuch Perfons as aforetaid, for Prizes
or Captures not proceeded againft to Condemnation in the Courts
of Admiralty and Vice Admiralty: This Licence to continue in force
for the Space of Three Years from the Date hereof, determinable
nevertheless for fuch Caufe or Caufes as in and by the faid Act of
the Forty-ninth Year of the Reign of His faid Majefty is in that

CA P. CXXIV.

An Act for altering, amending, and explaining certain Acts
relative to the Removal of the Poor, and for making Re-
gulations in certain Cafes touching the Examination of
Paupers as to their Settlement; and for extending to all
Parishes certain Rules and Orders in Workhouses, under an
Act of the Twenty-fecond Year of His prefent Majesty,
intituled, An A&t for the better Relief and Employment of the
Poor.

WHE

THEREAS by an Act paffed in the Thirty-fifth Year of the Reign of His prefent Majefty, intituled, An Act to prevent 35 G. 3. c. 101, the Removal of Poor Perfons until they shall become actually chargeable, §2. it is amongst other Things enacted, That in cafe any Poor Perton

'fhall be brought before any Juftice or Juftices of the Peace for the Purpofe of being removed from the Place where he or she is inhabiting or fojourning, by virtue of any Order of Removal, or of being paffed by virtue of any Vagrant Pafs, and it fhall appear to the faid Juftice or Juftices that fuch Poor Perfon is unable to travel by reafon of Sickness or other Infirmity, or that it would be dangerous for him or her fo to do, the Juftice or Juftices making fuch Order of Removal or granting fuch Vagrant Pafs, are r quired and authorized to fufpend the Execution of the fame until they are fatisfied that it may fafely be executed without Danger to any Perfon who is the Subject thereof, and that the Charges proved upon Oath to have been incurred by fuch Sufpenfion of any Qrder of Removal, may by the faid Juftices be directed to be paid by the Churchwardens and Overfeers of the Parish or Place to which fuch Poor Perfon is ordered to be removed, in cafe any Removal fhall • take

take place, or in cafe of the Death of fuch Poor Person before the Execution of fuch Order: And by the fame A&t it is further enacted, That in case of an Apneal against any Order for the Pay⚫ment of fuch Charges, if the Court of Quarter Seffions fhall be of Opinion that the Sum fo awarded be more than of right ought to have been directed to be paid, fuch Court may and is thereby dire&ed < to strike out the Sum contained in the faid Order, and infert the Sum which in the Judgment of fuch Court ought to be paid; and in every fuch Cafe the Court of Quarter Sefions thall direct that the faid Order fo amended fhall be carried into Execution by the faid Juftices by whom the Order was originally made, or either of them, " or in cafe of the Death of either of them, by fuck other Juftice or Juftices as the Court shall dir &: And Whereas it is expedient that the Power of putting an End to the Sufpenfions of any fuch Order of Removal or País, and of executing the feveral or other Authorities aforesaid, should not be confined to the Order of the Juftice or Juftices making fuch Order or Pafs; May it therefore please Your Majefty that it may be enacted;' and be it enacted by the King's mott Excellent, Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act, in all Cafes wherever the Execution of any Order of Removal or of any Vagrant Pafs fhall be hereafter fufpended by virtue of the faid recited A&t, it shall be lawful for any other Juftice or Juftices of the Peace of the County or other Jurifdiction within which fuch Removal or Pafs fhall be made, to direct and order that the fame fhall be executed, and to direct the Charges to be incurred as aforefaid to be paid, and to carry into Ex.cation any fuch amended Orders as aforefaid, as fully and effectually to all Intents and Purposes as the said refpective Powers and Authorities can or may be executed by the faid Juftices who fhall make any fuch Order of Removal, or by the Justice who fhall grant any fuch Pass as aforefaid. II And be it further ene&ed, That when the Execution of any fuch Order of Removal fhall be fufpended, the Time of appealing againft fuch Order fhall be computed according to the Rules which govern other like Cafes from the Time of ferving fuch Order, and not from the Time of making fuch Removal under and by virtue of the fame.

III. And, in order to avoid any Pretence for forcibly feparating Hufband and Wife, or other Perfons nearly connect.d with or re•lated to each other, and who are living together as one Family at the Time of any Order of Removal made or Vagrant Pals granted, during the dangerous Sicknefs or other Intiruity of any one or more of fuch Family, on whofe Account the Execution of fuch Order of Removal or Vagrant Pals is fufpended, Be it further en ted and declared, That where any Order of Removal or Vagrant Pals moval fufpended fhall be fufpended by virtue of this or of the faid recited Act, on account of the dangerous Sicknifs or other Infirmity of any Perfon or Perfons thereby d·rec·d to be removed or paffed, the Execution of fuch Order of Removal of Vagrant Pais fhall alto be fufpended for the fame Period with r fpect to every other Pation named there, who was actually of the fame Household or Family of fuch fick or infirm Perfon or P.rlons at the Time of fuch Order of Removal made 9r Vagrant Pats granted.

And be it further enacted, That whenever it fhall happen that any Pauper is by Age, Illness, or Infirmity unable to be brought up to the Petty Sous to be examined as to his or her Settlement, it fhall be lawful for any One Magiftrate acting for the Diftrict where fuch Pauper that be, to take the Examination of the faid Pauper, and to report the fame to any other Magistrate or Magistrates acting for the laid Dirt and for the faid Magiftrates upon fuch Report to adjudge the Settlement of the faid Pauper, and make and fufpend the Order of Removai, as fully and eff. ctually to all Intents and Purposes as if the faid Pauper had appeared before Two Magiftrates.

And Whereas by an Act paffed in the Twenty-fecond Year of the Reign of His prefent Majetty, intituled, An Act for the better Relief and Employment of the Poor; certain Rules, Orders, Bye Laws, and Regulations are appointed to be obferved and enforced in every Por Houfe eftablished under the Authority of the faid Act: And Whereas it is expedient that fuch Rules, Orders, in Bye Laws, and Regulations fhould be extended to Poor Houfes and Workhoufes cft blifhed in other Parishes; it is hereby ena &ed, That any Two or more of His Majelly's Justices of the Peace, may at any Petty Seffions dire& fuch Rules, Orders, Bye Laws, and Regulations, or any of them, to be observed and exccuted in any Parifhes within their respective Divifions or Diftri&t., as fully as in thofe incorporated by the faid A&t.

An Act to amend an Act made in the Thirty-third Year of His
prefent Majesty, for the Encouragement and Relief of
Friendly Societies.

HEREAS great Advantage has been derived as well to the
Publick as to Individuals, by the Establishment of Friendly
Societies, under the Authority of an A& of the Thirty-third Year

of the Reign of His prefent Majefty, intituled, An Att for the En- 33 G. 3. & 54, •couragement and Relief of Friendly Societies: And Whereas it is expedient to make further Provifion for the Attainment of the good Purposes intended thereby;' Be it therefore enacted, by the King's moft Excelent Majesty, by and with the Advice and Content of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That if any Two Juftices on Perfon having been admitted a Member of any Society established Complaint may under the Authority of the faid A&, fhall offend againft any of the enforce the Rules, Orders, or Regulations of fuch Society, it fhall be lawful Obfervance of for any Two Jeft ces of the Peace refiding within the County, and levy any any Rules; Riding Divifion, Sire, Stewartry, City, Liberty, or Place within Arrears by which fuch Society fhall be held, upon Complaint made on Oath Diftrefs and by any Member of fuch Society, to iffue their Summons to fuch Per Sale. fon against whom fuch Complaint fhall be made, and upon his or her Appearance, or, in default thereof upon due Proof upon Oath of the Service of fuch Summons, fuch Juftices fhall proceed to hear and determine the faid Complaint according to the Rules, Orders, and Regulations of the faid Society confirmed as directed by the faid A&, and fhall make fuch Order therein as to them fhall feem juft; and in cafe the faid Justice shall adjudge any Sum of Money to be paid by fuch Perfon against whom iuch Complaint fhall be made, and fuch

A.D.1809. Person shall not on Notice of fuch Order forthwith pay the Sum of Money fo adjudged to the Perfon or Perfons, and in the Manner directed by this Act, it shall be lawful for fuch Juftices, and they are hereby required by Warrant under their Hands and Seals, to cause the fame to be levied by Diftrefs and Sale of the Goods of fuch Perfon on whom fuch Order shall have been made, together with such Cofts as fhall be awarded by the faid Juftices, and alfo the Cofts and Charges attending fuch Diftrefs and Sale, returning the Overplus (if any) to the Owner.

II. And Whereas it was provided by the faid A&t of the Thirtythird Year of the Reign of His prefent Majefty, that no Society to be established for the Purposes therein recited fhould be deemed and taken to be within the Meaning of the fame Act, unless the Rules of the Society fhould be filed at the Quarter Seffions of the Peace, before the End of the Year One thousand seven hundred 35 G. 8. c. 111. and ninety-four, which Time was enlarged by an Act of the Thirty

fifth Year of His prefent Majefty's Reign to Michaelmas One thousand seven hundred and ninety-fix: And Whereas it is expedient that all Societies which were established under the Authority of the first recited Act for the laudable Purposes thereby intended, previously to the fame having been paffed, fhould be allowed to file their Rules, notwithstanding their having omitted to do fo within the Times limited;' Be it therefore enacted, That all fuch Societies, the Rules, Orders, and Regulations of which fhall have been exhibited, to the Juftices of the Peace fince Michaelmas One thousand seven hundred and ninety-fix, or which fhall at any Time hereafter be explying with this hibited in the Manner directed by the faid recited Act of the Thirtythird Year of His prefent Majefty, and which shall have been or shall be dealt with, examined, approved of and confirmed by the Juftices in the Manner therein directed, and have been or shall be depofited with the Clerk of the Peace and filed as directed alfo by the faid A&, fhall be deemed and taken to be within the Intent and Meaning of the faid Act, as amply and for all Purposes as if their Rules had been eftablished within the Periods limited in either of the recited Acts.

III. And be it further enacted, That if Complaint fhall be made to Two fuch Juftices of the Peace by any Member of fuch Societies, of Relief having been refufed to him by any fuch Society, to which he fhall be lawfully entitled according to the Rules of the Society to which he fhall belong, it fhall be lawful for the faid Two Juftices of the Peace refiding within the County, Riding, Divifion, Shire, Stewartry, City, Liberty, or Place, within which fuch Society fhall be held, and fuch Juftices are hereby required, upon Complaint made by or on the Behalf of the Perfon aggrieved thereby, to fummon the Perfon, being an Officer of the Society against whom fuch Complaint fall be made, and upon his or her Appearance, or in default thereof, upon due Proof upon Oath of the Service of fuch Summons, fuch Juftices fhall proceed to hear and determine the faid Complaint, and award fuch Sum of Money to be forthwith paid to the faid Complainant as fhall appear to fuch Juices to be due on fuch Award as aforesaid, together with fuch a Sum for Cofts, not exceeding the Sum of Ten Shillinge, as to fuch Juftices fhall feem meet; and if the faid Sums fo to be awarded, together with fuch Cofts, fhall not be forthwith and in the Prefence of fuch Juftice or Juftices paid to fuch Complainant, or to fome Perfon or Perfons there attending on the

Behalf of fuch Complainant, then fuch Juftices fhall by Warrant under their Hands and Seals, caufe fuch Sum and Cofts as aforefaid to be levied by Diftrefs, or by Diftrefs and Sale of the Monies, Goods, Chattels, Securities, and Effects belonging to the faid Society, together with all further Cofts and Charges attending fuch Diftrefs, or fuch Diftrefs and Sale, returning the Overplus (if any) to the faid Society, or to one of the Treasurers or Trustees thereof, and in default of fuch Diftrefs being found, then to be levied by Diftrefs and Sale of the proper Goods of the Officer or Officers of the faid Society fo neglecting or refusing as aforefaid, together with fuch further Colts and Charges as aforefaid, returning the Overplus (if any) to the Owner, and fo from Time to Time as often as Complaint fhall be made of the Non-payment of any Sum or Sums directed by fuch Order to be paid as aforefaid, fuch fuftices fhall by like Warrant cause fuch Arrears from Time to Time be levied in the Manner before directed: Provided always, that whatever Sums fhall be paid by any fuch Officer or Officers, or levied on his or their proper Goods in pursuance of the Order of any Jultice as aforefaid, fhall be repaid, with all Damages accruing to him or them, by and out of the Monies belonging to fuch Society, or out of the firft Monies which fhall thereafter be received by fuch Society.

IV. And be it further enacted, That all Orders made by Juftices of the Peace by virtue of the faid Act or this A&t, upon the Complaint of any Perfon having been admitted a Member of any Society eftablished under the faid Act, who fhall be aggrieved by any A&t, Matter, or Thing done or omitted to be done by any fuch Society, fhall be made upon the Prefidents, Wardens, Stewards, Treafurers, Truftees, or other principal Officers of the Society to which fuch Complaint fhall relate, or any One or more of them, or any of them, at the Difcretion of the faid Juftices, in the proper Name or Names of fuch Officer or Officers; and every fuch Order may be ferved upon the Officer or Officers fo named therein, either by delivering a Copy of the faid Order to fuch Officer or Officers, or one of them, or leaving the fame at his laft or ufual Place of Abode; and fuch Service fhall be binding on fuch Officer or Officers, and on the Society to which fuch Officer or Officers fhail belong, to do and perform, or cause to be done or performed, all and every the Matters and Things contained in and directed by fuch Order to be done according to the true Intent and Meaning thereof.

V. And be it further enacted, That every Order, Adjudication, or Award of any Juftice or Juftices under this A&t, fhall be final and conclufive to all Intents and Purposes, and fhall not be removed or removable into any Court of Law, or reftrained or restrainable by the Injunction of any Court of Equity.
