Comptroller, Searcher, or other Officer herein mentioned in that Behalf, a printed or written Notification, to be fubfcribed and tranfmitted by him to the Treafurer or Deputy Treasurer of Chelsea Hofpital, of the Time of Payment of the Shares of the fames Prizes, and

Particulars relating thereto, and alfo together therewith a written Notification of the Amount of an individual Share in each Clafs, in like Manner as fuch Notifications are hereby directed to be tranfmitted to the Treasurer of Greenwich Hofpital, and under the fame Penalties for neglecting to deliver or tranfmit the fame Notifications to the Treasurer or Deputy Treasurer of Chelsea Hospital as aforefaid; and that all fuch Notifications to be tranfmitted to and registered at that Hofpital as aforefaid fhall, on fuch Proof as in the faid recited Act is mentioned, be Evidence in Manner therein expreffed in that Behalf.

XX. Provided always, and be it further enacted, That if any Commiffioned Officer of the Army fhall direct, by any Order in Writing, that his diftributive Share or Balance of any Prize or Prizes shall not be paid over to the Treasurer or Deputy Treasurer of Chelsea Hofpital, the fame fhall remain in the Hands of the Agent, fubject to all fuch further Orders as fuch Officer may give refpecting the fame. XXI. And be it further enacted, That no Deduction fhall be No Deduction allowed, on any Account, in the Payments of unclaimed or forfeited allowed on unShares and Balances paid over to the Treasurer or Deputy Treasurer claimed Shares of Chelsea Hofpital, for any Sums not appearing upon the Prize Lift Voucher. of Diftribution to have been thereon paid and acknowledged, unless fatisfactory Vouchers from the Parties, or their lawful Attornies, fhall be produced for the fame.

XXII. And be it further enacted, That all Shares of Prize Shares of NonMoney due and to become due to Non-commiffioned Officers and commiffioned Soldiers of the Army, in cafes of fuch conjun& Expeditions as afore. Officers and faid, fhall be paid by the Agent, or by the Treasurer or Deputy Army, in cafes Treasurer of Chelsea Hofpital, or his Chief Clerk (as the Cafe may of conjunct require), to the Perfons entitled thereto, or Perfons authorized by an Expeditions, Order in the Form fet forth in the Schedule to this Act annexed, fhall be paid marked (C.) to receive the fame; which Order shall specify the Piace, under Orders in Fortress, or Ships, out of which the Prize Money fhall have arifen, Schedules (C.) together with the Name of the Regiment or Corps to which fuch and (D.) Non-commiffioned Officer or Soldier shall have belonged at the Time of the Capture; and the Perfon making fuch Order shall also procure and produce a Certificate in the Form or to the Effe&t fet forth in the faid Schedule marked (C.), which Certificate fhall be figned by the. Commanding Officer, Adjutant, and Paymafter of the Regiment in which fuch Perfon fhall be ferving, provided the Signatures of fuch Officers can be obtained; and in cafe the Signatures of all or any of fuch refpective Officers cannot be obtained, by reafon of the Regiment or Part of the Regiment being on Detachment, or other unavoidable Caufe, then and in fuch Cafe fuch Certificate fhall be figned by fuch of the faid Officers as may be prefent where the Non-commiffioned Officer or Soldier is then ferving, aud any other Commissioned Officers of the Regiment or Corps then prefent, fo that there fhall not be lefs than the Signatures of Three Commiffioned Officers to fuch Certificate; or in cafe fuch Non-commiffioned Office or Soldier shall be detached from his Regiment, or be in any Hospital or Sick Quarters, fo that he cannot procure fuch Certificate of his Officers as

A.D. 1809. above-mentioned, the fame fhall be ftated particularly on the Order, and the Certificate fhall be figned by the Three fenior Officers belonging to fuch Detachment, or by the Surgeon or principal Medical Officer belonging to fuch Hofpital or Sick Quarters (as the Cafe may require), and by Two other principal Military or Civil Officers belonging to fuch Hofpital, or refiding at fuch Quarters; or in cafe fuch Non-commiffioned Officer or Soldier fhall have been difcharged from the Service, then he fhall procure and produce a Certificate in the Form or to the Effect fet forth in the Schedule hereto annexed marked (D.), and which shall be figned by the Minifter and One of the Churchwardens, or (if in Scotland) by the Minifter and One of the Elders of the Parish or Place in which such discharged Non-commiffioned Officer or Soldier may then refide; or if fuch Non commiffioned Officer or Solaier shall be dead, then the Perfon entitled to receive his Share of fuch Prize or Bounty Money fhall procure and produce a Certificate in the Form or to the Effect fet forth in the Schedule hereto annexed marked (E.), which Certificate fhall be figned by the Minifter and One of the Churchwardens, or (if in Scotland) by the Minifter and One of the Elders of the Parish or Place in which fuch Perfon fhall then refide: Provided always, that every fuch Order as above defcribed fhall be revokeable by the Perfen making the fame : Provided alfo, that no fuch Order shall be valid to authorize the Receipt of any Prize Money or Bounty Money which fhall be in courfe of Payment or Diftribution to any fuch Non-commiffioned Officer or Soldier as aforefaid, if the Party making fuch Order fhall be then refiding or dwelling within the Distance of Five Miles from the Place where fuch Prize Money or Bounty Money fhall be payable; and if any Agent or Agents for Prizes fhall pay or cause to be paid any Share of Prize Money or Bounty Money to any Perfon or Perfons upon any Order made within the Distance aforefaid from the Place where fuch Prize Money or Bounty Money fhall be payable, fuch Prize Money or Bounty Money being in courfe of Diftribution at the Time of making fuch Order, fuch Payment fhall be void to all Intents and Purposes; and the Agent or Agents making the fame shall forfeit the like Penalty as herein-before mentioned with refpect to Payments made to the Orders of Petty Officers and Seamen, Non-commiffioned Officers of Marines, and Marines, under the like Circumstances, and fhall be recovered, with fuil Colts of Suit, and applied refpectively in fuch Manner as herein-after mentioned.

XXIII. And be it further enacted, That for the Stamp Duty on every of fuch Orders, there fhall not be more than the Sum of One Shilling paid for each Perfon fubfcribing the fame.

XXIV. And be it further enacted, That from and after the paffing of this Act, all Receipts given or taken for Prize Money, or Balances paid or received by the Treafurer or Deputy Treafurer of Chelsea Hofpital, fhall be exempt from and not liable to any Duty of Stamps what foever; any Law or Statute to the contrary thereof notwithftanding.

XXV. And be it further enacted, That it fhall be lawful for the Treafurer of Chelsea Hofpital, in fuch Cafes as aforefaid, to appoint a Deputy or Deputies for receiving Applications and Claims for Army Prize Monies, as the Treasurer of Greenwich Hofpital is by the faid recited Act authorized respecting the Navy Prze Monies; and that the Modes and Regulations directed by the fame Act, for refunding

Shares of Prize Money paid into Greenwich Hofpital, and for facili- Shares, &c. paid tating the Payment of Prize Money to Seamen, and preventing into Greenwich Frauds attending the fame, fhall be purfued and adopted for refunding be adopted as to Hofpital, fhali Shares of Prize Money paid into Chelsea Hofpital, and for facilitating Chelles Hospital. the Payment of Prize Money to Officers and Soldiers of the Army, and preventing Frauds attending the fame, or as nearly as may be and Circumftances will permit, and under the fame Penalty for receiving any Fee or Reward for remitting or paying any fuch Money from Chelsea Hofpital; and alfo that the Provitions and Directions herein contained respecting any Grants made or to be made by His Majetty, his Heirs or Succeffors, and the full Benefit thereof, fhall extend and apply to and in favour of Chelsea Hofpital as well as Greenwich Hofpital in Cafes of fuch conjunct Expeditions as aforefaid.

XXVI. And be it further enacted, That the Deputy Treasurer of Deputy Chelfea Hofpital fhall and may have and exercife the fame or the like Treasurer of Liberty or Privilege of receiving and fending Letters or Packets upon Chelsea Hofpital any Bufinefs or Affairs reiative to fuch Prize Matters as aforefaid, may receive and free from the Duty of Potage, in the fame or the like Manner, and free of Poftage, with the fame or the like Regulations, and under the fame Penalty for &c. every Abuse of fuch Liberty or Privileg, as is hereby or in any former Act enacted or mentioned refpecting the Treasurer of Greenwich Hofpital in that Behalf.

XXVII. And be it further enacted, That all Expences incurred or Remuneration to be incurred in executing this A&t, and alfo the faid recited Act, to Othcers of and the Sums paid in remunerating the Cficers or Perfons employed Chelfea Hofpital on behalf of Chelfea Hofpital, for their Care, Pains and Trouble in fhall be paid out performing the Regulations and Directions thereof, fhall, fo far as the Shares, &c. fame relates to thofe Officers or Perfons, be fubject to the Diferetion of the Commiffioners for managing the Affairs of the fame Hofpital, and fhall be paid out of the Intereft of unclaimed Shares, or Shares of deferted Men, invested in Government Securities, or, if neceffary, out of the principal Monies in the Hands of the Treasurer or Deputy Treasurer of the faid latt-mentioned Hofpital, on account of fuch Shares refpectively; the Accounts of the faid Expences and Remunerations being annually returned to Parliament: Provided nevertheless, that no Perfon employed by the faid Commiffioners of Chelsea Hofpital, in executing the Regulations of this A&t or the faid recited A&t, fhill act as an Agent for Prizes, or be concerned, directly or indireAly, in the Bufinefs thereof, under the Penalty of Five hundred Pounds.

XXVIII. And be it further enacted, That from and after the paff- Perfonating ing of this Act, if any Perfon fhall willingly and knowingly perfonate Officers or or faifely affume the Name or. Character of any Officer, Soldier, or Soldiers in the other Perfon in the Army, entitled or fuppofed to be entitled to any Army, or their Executors, &c. Prize Money or Bounty Money, or Share of Prize Money or Bounty or forging any Money, for Service done on any fuch conjun& Expedition as afore- Will or lower, faid, or of the Executor or Adminiftrator, Wife, Relation, or Creditor or taking a falfe of any fuch Officer, Sidier or other Perfon, in order to receive any Oath to obtain Prize Money or Bounty Money, or Share of Prize Money or Bounty Probate of Will Money, due or fuppofed to be due or payable for or on account of any fuch Services as aforefaid; or fhall forge or counterfeit, or procure to be forged or counterfeited any Letter of Attorney, Bill, Ticket, Order, Certificate, Affignment, last Will, or any other Power or Authority whatloever, in order to receive any Prize Money or

A.D. 1809. Bounty Money, or Share of Prize Money or Bounty Money, which fhall be due or fuppofed to be due for any fuch Services as aforefaid; or fhall willingly and knowingly take a falfe Oath, or procure any other Perfon to take a false Oath, to obtain the Probate of any Will or Wills, or to obtain Letters of Adminiftration in order to receive any Prize Money or Bounty Money, or Share of Prize Money or Bounty Money, which fhall be due or fuppofed to be due to any fuch Officer, Soldier, or other Perfon as aforefaid, who fhail have really ferved, or shall be supposed to have ferved on any fuch corjun& Ex, pedition as aforefaid, or fhall utter or publifh as true, any falfe, forged or counterfeited Letter of Attorney, Bill, Ticket, Order, Certificate, Affignment, laft Will, or any other Power or Authority whatsoever, in order to receive any Prize Money or Bounty Money, or Share of Prize Money or Bounty Money, due or fuppofed to be due to any Officer, Soldier, or other Perion who shall have really ferved, or who fhall be fuppofed to have ferved as aforefaid, with Intent to defraud His Majefty, his Heirs or Succeffors, or the Commiffioners or Treafurer or Deputy Treasurer of Cheifea Hofpital, or any Army Prize Agent, or any Perfon or Corporation whomsoever, knowing the fame to be falfe, forged or counterfeited, every fuch Perfon fo offending, and being thereof lawfully convicted, fhall be deemed guilty of Felony, and fhall fuffer Death as a Felon without Benefit of Clergy.

"Agents for diftributing Royal or Parliamentary Grants heretofore "made fhall account to Greenwich and Chelsea Hofpitals for all "forfeited and unclaimed Shares of fuch Grants, within Four Months "after the paffing of this A&t, &c. § 29.

XXX. And be it further enacted, That whenever any Grant shall or Parliamentary hereafter be made by His Majesty, his Heirs or Succeffors, or by Parliament, to the Captors of any Prize, Booty, or other Property, or for any V.&tory, and the faid Grant, of whatever Nature it may be, fhal not come under the Dcription of Prize Money arifing from Captures legally condemned in any Court of Admiralty or Vice Admiralty, but be confidered as a Bounty gratuitously given, and of which the unclaimed Shares would for that Reafon not be paid into Greenwich Hofpital, and might not be accounted for in any Manner, the Agent or Agents, or Perfons who fhall diftribute the faid Grants, fhal advertise the faid Diftributions, and tranfmit Notice of the Amount of the Shares therein to the Treasurer of the faid Royal Hofpical at Greenwich, and to the Treasurer or Paymaster of His Majelty's Navy, as in Cafes of ordinary Diftributions of Prize Money, and fhall alfo at the Expiration of Four Months next after the Day on which Diftributions fhall have been notified, deliver, or tranfmit to the Officer for Prizes in the Navy Pay Office a correct Copy of the Ditribution Lifts of fuch Grants, with an Account of the Payment of the feveral Shares to the Captors or to others on their Behalf, and pay over all Shares and Balances then remaining in his or their Hands unpaid and undistributed, to the Treasurer of Greenwich Hofpital, or fuch Perfon or Perfons as he fhall depute or appoint as aforetaid to receive the fame, and render and verify his and their Accounts in the Manner by the faid Act of the Forty-fifth Year of His prefent Majefty directed, under the like Penalties for Neglect of Duty as are by the faid Act impofed for neglecting to make, render,

XXXI. And be it further enacted, That all the Provisions, Rules, Provifions of Regulations, Forfeitures, and Penalties, mentioned in the faid recited Act of the Forty-fifth Year of His prefent Majefty, and this Act, refpecting Prizes taken from the Enemy, fhall be extended to the Diftribution of the Amount of all Seizures for Offences committed against the Revenue Laws, when made by any Ship or Veffel of War in the Service of His Majefty, his Heirs or Succeffors, as if the fame were re-enacted in this A&t.

XXXII. And be it further enacted. That if any Perfon or Perfons Penalties on fhall falfely make Oath to any of the Matters herein-before required Perjury and to be verified on Oath, or fuborn any other Perfon fo to do, fuch Subornation of Perjury. P.rfon or Perfons fhall fuffer the like Pains and Penalties as are incurred by Perfons comu itting wilful and corrupt Perjury, and the faid Offences, though committed out of this Realm, may be alledged to be committed and may be laid, inquired of, tried, and determined in any County of England, in the fame Manner, to all Intents and Purposes, as if the fame had been actually done or committed within the Body of fuch County..

XXXIII. And be it further enacted, That all Penalties and For Recovery of feitures impofed by this Act, wherefoever the fame fhall arife or be- Fenalties. come forfeited, may be recovered by Action of Debt, Bill, Plaint, or Information, in any of His Majefty's Courts of Record in Great Britain, or on Motion and Attachment thereon in His Majefty's High Court of Admiralty; and all Penalties and Forfeitures impofed by this A&t which fhall arife or become forfeited in any Part of His Majefty's Dominions abroad, may be recovered in any Court of Record of His Majesty in the Colony, Territory, or Place where the fame shall arise or have become forfeited, or in any of His Majefty's Vice Admiralty Courts having Jurifdiction there.

XXXIV. And be it further enacted, That in all Cafes in which Application of any Agent or Perfon is by this Act made fubject to the Forfeiture of Penalties. any Sum of Money equal to any Money remaining in his Hands, or to the Amount of any Balances or Shares, fuch Sum or Sums of Money shall, on Recovery thereof, go and be applied to the Ufe of the Perfon or Perfons who fhall have been aggrieved by the Mifconduct of such Agent or Perfon; and all pecuniary Penalties and Forfeitures by this Act impofed, other than as aforefaid, and other than fuch as are not hereby otherwife difpofed of, fhall go and be applied to the Ufe of the Commiffioners and Governors of the Royal Hospital for Seamen at Greenwich in all Cafes relating to the Naval Service, and to the Ufe of the Commiffioners for managing the Affairs of the Royal Hofpital at Chelfea in all Cafes relating to the Service of the Army, and shall be fued for in the Name of the Commiffioners and Governors of the faid Royal Hospital at Greenwich, or in the Names of the Commiffioners of the faid Royal Hospital at Chelsea, as the Cafe may require.

XXXV.And Whereas it has frequently happened that Frauds have been practifed upon Petty Officers and Seamen in the Navy, and on Non-commiffioned Officers of Marines, and Marines, by • Perfons of bad Character, who have been authorized by them to receive Wages, Pay, Prize Money and Bounty Money, to which
