shall not be claimed within a Year and a Day after fuch Report fhall fold under have been tranfmitted to the faid Corporation of the Trinity Houfe of Stat. 12 Anne, Deptford Strond, as before mentioned, the fame fhall be fold, and a Certificate of fuch Sale fhall be delivered to the Purchafer thereof under the Directions of the High Court of Admiralty, and the Monies arising from the Sale thereof be applied in the Manner directed in and by an A&t paffed in the Twelfth Year of the Reign of Her late Majefty Queen Anne. intituled, An Act for preferving all fuch Ships and Goods thereof which shall happen to be found on Shore or franded on the Coals of this Kingdom, or any other of Her Majfly's Dominions, and if the fame fhall have been feized by the Deputy Vice Deputy Vice Admiral or his Agent as aforefaid, then the Deputy Vice Admiral or Adiniral faizing, Agent fo feizing and the Perfon who fhall have given fuch Inform- and Informer ation as fhall have led to the Seizure (if any fuch Information fhall have fhall be equally been given) fhall be equally entitled to the Salvage which shall be allowed by the High Court of Admiralty to the Salvors in the Cafe of unclaimed Property. VIII. And be it further enacted, That if the Salvors of any fuch Two Juftices Articles, or any Gods fo found, weighed, fwept for, or taken Pof. empowered to feffion of as aforefaid, and fo lodged and reported as aforefaid, and the Owner or Owners thereof, or his, her, or their Agent or Age: ts, respecting cannot agree refpecting the Amount of Salvage to be paid for or in Salvage of fuch refpect of the fame, or the Value thereof, as the Cafe may be, then Articles. the Matter in Difference fhail be determined by any Two Justices of the Peace refiding near to the Place where fuch Articles or Goods fhall be depofited; and fuch Juttices fhall begin to proceed in their Enquiry as to fuch Matters in Difpute, within Forty-eight Hours after fuch Difference fhall be referred to them for their Determination thereof; and if they cannot agree refpecting the fame, then it fhall Such Juftices be lawful for them to nominate any Third Perfon converfant in Mari- may nominate a time Affairs, at their Option, who fhall afcertain the Amount of the third Perfon as Umpire. IX. And be it further enacted, That it fhall also be lawful for the Two Juftices faid Juftices to decide in the like Manner, and within the fame Time may determine as is herein-before directed, with regard to Salvage on all Claims on Remuneand Demands whatfoever which fhall or may after the First Day of vices to Ships Auguft Ove thousand eight hundred and nine, be made by Pilots, in Distress. Boatmen, and other Perfons, for Services of any Defcription (except (except Pilotage} Pilotage) to be reudered by them to any Ship or Veffel, as well for &c. carrying off from the Shore to fuch Ship or Veffel any Anchors, Cables, or other Stores, from any Port or Ports of the Coast of England and Wales and Berwick-upon-Tweed, or for the faving and preterving any Goods or Merchandize which may have been wrecked, ftranded, or caft away from any Ship or Veffel, or for being inftrumental in faving the Life or Lives of any Perfon or Perfons on board the fad Ship or Veffel, the Mafter, Owner, or Owners of fuch Ship or Veffel, or his, her, or their Agent or Agents being prefent with fuch Juftices; and that the faid Juftice or fuch other Perfon fo appointed as aforefaid, fhall have full Power and Authority to hear

Sec Schedule (A.)

and determine on all Cafes whatever of Services rendered by Pilots, Boatmen, and others to Ships or Veffels (except Pilotage) whether fuch Ships or Veffels fhall at the Time be in Dittrefs or not, and that they fhall have the like Power of examining the Parties or their Witneffes upon Oath as laft herein-before directed; and the Decifion of fuch Juftic s, or of the Perion fo to be by them appointed as aforefaid, fhall be final and conclufive on all Parties, fave and except in fuch Cafes in which an Appeal fhall be interpofed by either Party to the High Court of Admiralty, fuch Appeal to be interpofed within Thirty Days after the Award of the Juftices or fuch Perfon fo appointed as aforefaid.

X. And be it further enacted, That in cafe the Perfon or Perfons fo claiming to be entitled to Salvage, or the Party or Parties who is or are to pay the fame, or their Agents, fhall be diffatisfed with fuch Award and Decifion of the Jultices, or of the Perfon fo to be nominated by them as aforefaid, it fhall be lawful for either of them refpectively, within Forty-eight Hours after fuch Award is made, but not afterwards, to declare to the Juftices, or fuch other Perfon to be nominated by them as aforefaid, his, her, or their Defire of obtaining the Judgment of the High Court of Admiralty respecting the faid Salvage, and thereupon the Perfon or Perfons fo claiming to be entitled to Salvage fhall be compelled to proceed within Thirty Days from the Date of fuch Award, by taking out a Monition against the adverfe Party; but in fnch Cafe the faid Juftices are hereby required and empowered to deliver to the Owners and Proprietors or their Agents, any fuch Anchor or Cable, Goods, or other Articles refpecting which any Claim for Salvage fhall be made upon the Owners or Proprietors thereof, bis, her, or their Agent, given good and fufficient Bail in Double the Amount of the Value of the Articles in refpect of which fuch Salvage fhall be claimed, and which Baii fhall be taken by a Commiffioner for taking Examinations in Prize Caufes, if there fhall be one in the Port or Place where fuch Difference fhall arife, but if there fhall be no fuch Commiffioner there, then the faid Juftices to whom fuch Diference fhall have been referred, or either of them, or any other of His Majefty's Juftices of the Peace, are and is hereby authorized to take the fame; and the Commiffioner or Juftice who fhall take fuch Bail fhail certify the fame according to the Form contained in the Schedule hereunto annexed, and tranfmit the fame without Delay to the High Court of Admiralty, together with a true Certificate in Writing of the grofs Value of the Whole of the Articles respecting which Salvage fhall be claimed, and alfo a Copy of fuch Proceedings and Awards on unftamped Paper, certified under the Hand of fuch Commiffioner or Juftice taking the Bail as aforefaid, and the fare fhall be admitted by fuch Court of Admiralty as Evidence in the Caufe.

XI. And be it further enacted, That it fhall and may be lawful for the Perfons fo to be named by the faid Juftices as aforefaid, who fhall decide on the Amount of Salvage to be paid, or on the Value of the Articles, or on the Remuneration to be made to Perfons rendering Aftance to Ships or Vellels, or Perfons as aforefaid, to demand and receive of and from the Owner or Owners of the Articles faved, or of the Ships or Veffels in Behalf of which the Services may. have been rendered, or his, her, or their Agents or Agent, a Sum of Money not exceeding Two Pounds Two Shillings each, and fuch

XII. And be it further enacted, That if any Perfon or Perfons fhall, from and after the First Day of August One thoufand eight hundred and nine, wilfully cut away, calt adrift, remove, alter, deface, fink, or destroy, or shall do or commit any A&t with Intent and Defign to cut away, caft adrift, remove, alter, deface, fink, or deftroy, or in any other Way injure or conceal any Buoy, Buoy Rope, or Mark, belonging to any Ship or Veffel, or which may be attached to any Anchor or Cable belonging to any Ship or Veffel whatever, whether in Diftrefs or otherwife, fuch Perfon or Perfons fo offending fhall, on being convicted of fuch Offence, be deemed and adjudged to be guilty of Felony, and fhall be liable to be tranfported for any Term not exceeding Seven Years, or in Mitigation of fuch Punishment to be imprifoned for any Number of Years at the Difcretion of the Court in which the Conviction fhall be made.

XIII. And be it further enacted, That if any Petfon or Perfons Penalty on fhall knowingly and wilfully, and with Intent to defraud and injure purchafing the true Owner or Owners thereof, or any Perfon interested thercin as aforefaid, purchase or receive any Anchors, Cables, or Goods, or Merchandize, which may have been taken up, weighed, swept for, or taken Poffeffion of, whether the fame fhall have belonged to any Ship or Veffel in Diftrefs or otherwife, or whether the fame fhall have been preferved from any Wreck, if the Directions herein-before contained with regard to fuch Articles fhall not have been previously complied with, fuch Perfou or Perfons fhall on Conviction thereof be deemed guilty of receiving ftolen Goods, knowing the fame to be stolen, as it the fame had been ftolen on Shore, and fuffer the like Punishment as for a Mifdemeanor at the Common Law, or be liable to be tranfported for Seven Years, at the Discretion of the Court, before which he, fhe, or they fhall be tried.

XIV. And be it further enacted, That in cafe the Mafter, Mate, or Crew of any Ship or Veifel bound to Parts beyond the Seas, fhall find and take on board of fuch Ship or Veffel, any Anchor, Cable, or any Goods or Merchandize, or shall receive any Anchor, Cable, or any Goods or Merchandize on board of fuch Ship or Veffel, from any other Perfon or Perfons who may have found the fame, knowing other Articles, the fame to have been fo found, the Mafter, Mate, or other Perfon fhall report the having the Command of fuch Ship or Veffel, fhall make a true Entry fame to the in the Log Book of fuch Ship of the Defcription of the Articles Trinity-Houfe, fo found or taken on board as aforefaid, ftating the Marks (if any) Arrival in thereon, and the Bearings and Diftances, and other minute Defcription, England fhall and the Time when and where the fame were found and taken on depofit them, board; and alfo fhall at the firft poffible Opportunity tranfmit a Report in Writing containing a true Copy of fuch Entry in the Log Book of the faid Ship or Veffel, to the faid Corporation of the Trinity Houfe of Deptford Strond, and on the Return of fuch Veffel to any Port in England or Wales, or Berwick-upon-Tweed, he fhall deliver the fame Articles into the Poffeffion of a Deputy Vice Admiral, or his Agent in or neareft to fuch Port, with the like Report

as is herein-before directed; and fuch Deputy Vice Admiral, or Agent, is hereby required to tranfmit fuch Report to the faid Corporation of the Trinity Houfe at Deptford Strond, to be placed by the fad Corporation for Infpection in like Manner as aforefaid; and if the fame fhall not be claimed by the Owner or Owners thereof, or his, her, or their Agent, within a Year and a Day after fuch Report fhall be tranfmitted, the fame fhall be fold and difpofed of according to Law with regard to unclaimed Property; and in default thereof, or if the Mafter of fuch Ship or Veffel fall fell or difpofe of fuch Anchor, Cable, Goods, or Merchandize to any Perfon or Perfons whomsoever, or fhall not upon his first Return to any Port within England and Wales or Berwick-upon-Tweed, report and deliver the fame according to the Provifions of this Act, he shall for every fuch Offence, on being thereof lawfully convicted before any Juftice of the Peace or Magiftrate on the Oath of One credible Witnefs, or on the Confeffion of the Party offending, forfeit and pay any Sum not exceeding Two hundred Pounds, nor lefe than Fifty Pounds, One Half of which Penalty fhall be paid to the Informer, and the other Half to the Prefident and Governors for the Relief and Support of fuch maimed and difabled Seamen, and of the Widows and Children of fuch as fhall be killed, fiain, or drowned in the Merchants Service, under an Act of Parliament made in the Twenticth Year of the Reign of His late Majelly, King George the Second, intituled, An A& for the Relief and Support of maimed and difabled Seamen, and the Widows and Children of fuch as fhall be killed, flain, or drowned, in the Merchants Service, and fhall alfo forfeit and pay Double the Value of such Articles, to the Owners or Owner thereof.

XV. And be it further enacted, That it fhall and may be lawful for the Deputy Vice Admiral or his Agent, who fhall make the Report required by this At to the faid Corporation of the Trinity Houfe of Deptford Strond as aforefaid, to receive of and from the Owner or Owners of the Articles in respect of which the Report fhail be made, or if the fame are not claimed, then out of the Produce of the Sale thereof, the Sum of One Pound One Shilling for each Re port; and that it fhall alfo be lawful for the Secretary or other proper Officer of the faid Corporation of the Trinity Houfe of Deptford Strond, to receive in like Manner as laft mentioned, the Sum of One Pound One Shilling for each Report fo to be received by the faid Corporation, and to be made publick by them as aforefaid, which laft-mentioned Sum fhall be paid to the faid Deputy ViceAdmiral or his Agent, before the Delivery of the Goods and accounted for by him to the Trinity Houfe.

XVI. And whereas Pilots, Hovellers, Boatmen, and other Perfons • in fmall Veffels have for many Years conveyed Anchors and Cables which may have been weighed, fwept for, or taken poffeffion of by them, as aforefaid, or which they may have purchased of other Perfons, knowing them to have been weighed, fwept for, or taken pof offeffion of without being reported as aforefaid, to Foreign Countries, and there fold and difpofed of to the manifeft Injury and Lofs of the Owners thereof; for remedying whereof,' Be it further enacted, That every Pilot, Hoveller, Boatman, or the Mafter of any fuch Veffel, who thali convey after the faid Eirft Day of August One thoufand eight hundred and nine, any fuch Anchor or Cable to any

Foreign Port, Harbour, Creek, or Bay, and there fell and difpofe of the fame, fhall be deemed and adjudged guilty of Felony, and shall be tranfported for any Term not exceeding Seven Years. XVII. And be it further enacted, That all Perfous who fhall trade or deal in buying and felling Anchors, Cables, Sails, or old Junk, old Iron, or Marine Stores of any Kind or Defcription, fhail have their Names with the Words "Dealer in Marine Stores," painted diftinctly in Letters of not less than Six Inches in Length upon the Front of all their Storehoufes, Warehoutes, and other Depofits for fuch Goods; and in default of their fo doing, they fhall, on Conviction before any Juftice or Justices of the Peace, or Magiftrate or Magiftrates of any Jurifdiction where fuch Storehoufe, Warehouse, and Depôt fhall be, upon the Oath of One credible Witnefs, or on Con. Magiftrate, to feffion of the Party offending, forfeit and pay a Sum not exceeding be granted on Twenty Pounda, nor lefs than Ten Pounds, One Half of which Penalty Affidavit, &c. fhall be paid to the Informer, and the other Half to the Poor of the Parish or Township where fuch Offence fhall be committed; and that it fhall not be lawful for fuch Dealers or Traders to cut up any Cable, or any Part of a Cable, exceeding Five Fathoms in Length, or uncant, untwine, or unlay the fame into Junk or Paper-ftuff, on any Pretence whatfoever, without firt obtaining a Permit from fome Justice of the Peace or Magiftrate refiding near to the Refidence of tuch Dealer, which Permit fhall not be granted unleís an Affidavit fhall have been made that the Cable fo intended to be cut up had been bona fide purchased, and without Fraud, by the Party fo intending to cut up the fame, and without any Knowledge or Sufpicion on his or her Part that the fame had been or were difhoneftly come by; and in which Affidavit fhail alfo be fpecified the particular Quality and Defcription of fuch Cable, and the Name or Names of the Seller or Sellers thereof, which Affidavit fhall be recited and fet forth at length in the Permit thereupon granted, on pain of forfeiting for the First Offence any Sum not exceeding Twenty Pounds nor less than Ten Penalty 101. Pounds, and for every Second or further Offence any Sum not exceeding Fifty Pounds nor less than Twenty Pounds, to be recovered before any Justice of the Peace, and One Half thereof to go to the Informer, and the other Half to the Poor of the Parish in which fuch Offence fhall have been committed.

XVIII. And be it further enacted, That for the more effectual Prevention of fuch Frauds, all Dealers in fuch Marine Stores as afore. faid fhall keep a Book or Bocks fairly written, in which Entries fhail be from Time to Time regularly made of all fuch old Marine Stores as fhall be by them from Time to Time bought, containing a true Account and Defcription of the Times when the fame were fo refpectively bought by them, and of the Names and Places of Abode of the refpective Sellers thereof: And before any Perfon who fhall Shall advertise obtain fuch Permit for the cutting up of any fuch Cable (as herein before cutting before required to be obtained) fhail proceed to cut up the fame by up of Cordage. virtue thereof, there fhall be published by the Space of One Week at leaft before the cutting up the fame, One or more Advertisement or Advertisements in fome publick Newspaper, printed nearest to the Storehouse, Warchouie, or Depot where the Articles fhall be depofited, notifying that fuch Party had obtained fuch Permit for the Purpose of cutting up fuch Cable, and of fuch Kind and Quality as therein defcribed, and alfo fpecifying the Place where fuch Articles
