LIX. And be it further enacted, That when the Militia of any Collector of County fhall be ordered out into actual Service, the Collector of Excife thall pay His Majesty's Excife of fuch County or Place fhall, and he is hereby to Crder of the required forthwith to pay to the Order of the Colonel of the Regi- Regiment ment or Battalion of Militia fo ordered out, the Sum of One Guinea for the Ufe of every private Militia Man belonging to his Regiment or Battalion; and the faid Colle&tor fhall alfo pay to the Order of fuch Colonel the Sum of One Guinea for every Recruit, as early as may be after fuch Recruit fhall have joined his Company while out in aua! Service as aforet:d (all which Monev fo paid by fuch Collectors fhall be allowed them in their Accounts); and al Money fo received, or fo much thereof as fuch Colonel fhall think proper, fhall be laid out in the Manner he hall think moft advantageous for the refpective Militia Men; and before any Militia Man fhall receive his Discharge, an Account fhall be rendered to fuch Militia Man how the faid Sum of One Guinea hath been applied and difpofed of, and the Remainder of the faid Money, if any, fhall be paid to fuch Militia Man.

LX. And be it further enacted, That when the faid Militia, or Difembodying any Part thereof, having been drawn out into actual Service as afore- Militia. faid, fhall be again duly difembodied, and the Officer and Private Men thereof difmiffed to return to their feveral Places of Abode, the Officers, Non-commiffioned Officers, Drummers and Private Men, fhall be fubject to the fame Orders, Directions, and Engagements only, as they were fubje& to under the Provifions of this Act, before they were fo drawn out into actual Service, except as herein-after mentioned.

LXI. And be it further enacted, That every Perfon having ferved Militia Men in the Militia, when drawn out into actual Service, being a married having ferved Man, may fet up and exercife any Trade in any Town or Place in my exercise Ireland, without any Let, Suit or Moleftation, of or from any Perfon or Perfons whatsoever, for or by reafon of exercifing or uting fach Trade, as freely and with the fame Provifion, and under the fame Regulations, as any Inhabitants of fuch Places might or could do. LXII. Provided always, and be it enacted, That any Officer or Leave of Absence Non-commiffioned Officer of the Militia, or private Militia Man, having Voice or Vote at any Election to be held in Ireland for any Member or Members to ferve in Parliament fhall, if he or they fhall require, have Leave for a reasonable Time, to be expreffed in fuch Leave, to go to, and return from fuch Eletion; and no fuch Officer, Noncommiffioned Officer, or Private fhall be liable to any Penalty or Punishment for or on account of his Abfence during the Time expreffed in fuch Leave.

LXIII. other Perfon recruiting for Men to enlift and ferve in His Majefty's other Forces, that he is (at the Time of his offering to enlift) a Militia Man then actually enrolled and engaged to ferve (which the faid Officer, Serjeant, or other Perfon is hereby required to afk every Man offering to eulift in His Majefty's other Forces) or fhall offer himself to be enlifted and ferve in any other Regiment or Battalion of Militia, any Militia Man fo offending fhall, on Conviction thereof upon the Oath of One Witness before any One Juftice of the Peace, be committed to the Common Gaol or Houfe of Correction, there to remain without Bail or Mainprize for and during any Time not exceeding Six Calendar Months, over and above any Penalty or Punishment to which fuch Perfon fo offending is or fhall be otherwife liable; and every Perfon fo offending fhall, from the Day on which his Engagement to ferve in the Militia fhall end, and no fooner, belong as a Soldier to fuch Corps of His Majefty's other Forces into which he fhall have fo enlifted, to ferve therein from fuch Day for the full Period of Service for which he fhall have originally engaged, and which Service fhall commence upon the Day on which he may be difcharged from the Militia, and not before and if any Officer, Ser. jeant, or other Perfon fhall enlift any Man belonging to the Militia, to ferve in His Majefty's Forces, knowing him to belong to the Militia, or without asking him if he belongs to the Militia (except under the fpecial Provifions of any fuch A&t in force as aforefaid) every fuch Officer, Serjeant, or other Perfon, fhall for every such Offence forfeit and pay the Sum of Twenty Pounds; and if any Perfon actually ferving in any of His M-jetty's other Forces fhall offer himself to serve, and be enrolled as a Substitute in the Militia, every Perfon fo offending fhall forfeit and pay to the Perfon informing of fuch Offence, the Sum of Ten Pounds, or be committed to the Common Gaol or Houfe of Correction for any Time not exceeding Three Months.

LXIV. And be it enacted. That neither the Whole nor any Part of the Militia of Ireland, fhall on any Account be carried or ordered to go cut of Ireland, unless by and with the Defire and Confent of each and every Officer, Non commiffioned Officer, Drummer, and Defire, as under Private, who fhall be fo carried or go, and then only within the United Kingdom: Provided always. that nothing in this A&t contained fhall repeal, or be extended or conftrued to repeal an Act made in the Forty-fourth Year of His Majesty's Reign. intituled, An Aa for empowering His Majefly for a Time and to an Extent therein limited, to accept the Services of fuch Parts of His Militia Forces in Ireland, as may voluntarily offer themfelves to be employed in Great Britain, or any Act for continuing the fame, in force immediately before the paffing of this Act.

LXV. And be it enacted, That for the more effectually carrying into Execution the Purposes of this A&t, it fhall be lawful for the appoint Deputy Governors of the feveral Counties and Counties of Cities in Ireland, or the Majority of Governors where there fhall be more than One appointed for any County or County of a City, from Time to Time to appoint fo many and fuch Perfons duly qualified as herein-after mentioned, and living within their refpe&tive Counties, as he or they fhall think fit, to be Deputy Governors for every County or County of a City in Ireland, having a Regiment or Battalion of Militia; the Names of fuch Perfons having been first prefented to, and not dif

LXVI. Provided always, That if the Governor or the Majority of If Governors the Governors of any County fhall decline, refuse, or omit to appoint neglect, Lord and return the Names of Perfons to be Deputy Governors of any County or County of a City, that then and in fuch Cafe it fhall be appoint. lawful for the Lord Lieutenant or other Chief Governor or Governors, of Ireland, for the Time being, to appoint fuch Perfons (duly quali fied as hercin-after mentioned) as he or they fhall think fit, to be De puty Governors for every fuch County or County of a City whereof the Governor or Governors, or the Majority of them, fhall have declined, refufed, or omitted to appoint Deputy Governors as aforefaid. LXVII. And be it enacted, That there fhall be Twenty Deputy Twenty Deputy Governors at the leaft within every County, if fo many can be found Governors in qualified as herein after directed, but if fuch Number of proper and each County, &c. difcreet Perfons fo qualified cannot be found within any fuch County, then as many fuch Perfons qualified as can be found within fuch County fhall be appointed to be Deputy Governors for the Purposes of this Act; and no Commiffion of any Deputy Governor fhall be vacated by reafon of the Vacation, Expiration, or Discontinuance of the Commiflion or Authority of the Perfon or Perfons by whom any fuch Deputy Governor has been or may be appointed.

LXVIII. And be it further enacted, That it shall and may be Removal of lawful for His Majefty, his Heirs and Succeffors, or for the Lord Deputy Lieutenant or other Chief Governor or Governors of Ireland for the Governors. Time being, from Time to Time as he or they fhall think fit, to fignify his or their Pleasure to the Governor or Governors of any County or County of a City, to difplace all or any Deputy Governor or Deputy Governors thereof, and upon fuch Signification of his or their Pleasure, fuch Deputy Governor or Deputy Governors fhall be difplaced accordingly.

LXIX. And be it further enacted, That all Perfons being ap- Qualifications pointed Deputy Governors in purfuance of this A&t, except within of Deputy Counties of Cities, fhall be qualified as follows; that is to fay, Governors. every Perfon fo to be appointed a Deputy Governor, fhall be feiled or poffeffed, either in Law or Equity, for his own Ufe and Benefit, in Poffeffion of a Real or Freehold Estate, for his own Life, or for the Life of his Wife, the having a Real or Freehold Eftate for her Life, or for fome greater Term, or fhall be poffeffed of a Term of Years, whereof Fourteen Years thall be unexpired, in Manors, Meffuages, Lands, Tenements, or Hereditaments in Ireland, of the yearly Value of Two hundred Pounds, or fhall be Heir Apparent of fome Perfon who fall in like Manner be feifed or poffeffed of a like Etate as atorefa'd, of the yearly Value of Four hundred Pounds: Provided always, that the Qualification of every D puty Governor fhall be fituated within the County whereof he fhall be appointed Deputy Governor.

LXX. And be it further enacted, That with refpe&t to the Chief Magiftrates Counties of the Cities of Dublin, Cork, and Limerick, and the County of Dublin, Cork, of the Town of Drogheda, the Chief Magiftrate of each of the faid or Limerick, and Cities and Town refpectively for the Time being, and the Colonels of Drogheda, fhall the Militia of the faid Counties of Citics, and of the County of Louth, be Governors. thall be Governors of the faid Cities and Town, and of the Precincts and Liberties there f refpectively, for the Purposes of this Act, and

A.D.1809. fhall respectively have all the Powers and Authorities hereby given to Governors of Counties, and all Powers and Provifions made by this A&t with refpect to Counties at large, and the Militia thereof, and the regiftering herein directed of the Qualifications of the Deputy Governors, fhall take place and be in force with refpect to the faid Cities, and the Militia thereof, and the regiftering of fuch Qualifi. cations; and the refpective Value of fuch Qualifications fhall be as follows, that is to fay; every Deputy Governor fhall be feised or poffeffed, either in Law or Equity, for his own Ufe and Benefit, in Poffeffion of a Real or Freehold Eflate for his own Life or for the Life of his Wife, fhe having a Real or Freehold Eftate for her Life, or for fome greater Term, or fhall be poffeffed of a Term of Years whereof Fourteen fhall be unexpired, of the yearly Value of One hundred and fifty Pounds at the leaft, or fhall be poffeffed of a Perfonal Eftate alone, or feifed and poffeffed of a Real and Personal Estate together, of the Value of Three thoufand Pounds.

And be it further enacted, That no Perfon fhall hereafter be appointed to be a Deputy Governor of any County or City, until he fhail have delivered in to the Clerk of the Peace of the County cr to Clerks of the City for which he fhall be appointed, or, in the Absence of the Clerk of the Peace, to his Deputy, a fpecific Defcription in Writing, figned by himfelf, of his Qualification, ftating the County or Counties, Parish or Parishes, in which the Estate or Eftates which form his Qualification is or are fituate, with the Denominations of the Land; and the Clerk of the Peace or his Deputy fhall tranfmit to the Cuftos Rotulorum, or Senior Governor of the County, or Chief Magiftrate of the City, a Copy of fuch Defcription.

LXXII. And be it further enacted, That the Clerk of the Peace of every fuch County or City fhall and is hereby required, from Time to Time, to enter the Qualifications tranfmitted to him according to the Directions of this Act, upon a Roll to be provided and kept for that Purpose; and the faid Clerk of the Peace or his Deputy fhail, in the Month of January in every Year, tranfmit to the Secretary of the Lord Lieutenant, or other Chief Governor or Governors for the Time being, a complete Account of the Qualifications fo left with him; and fuch Secretary receiving fuch Accounts, fhall caufe Copies thereof to be annually laid before both Houses of Parliament; Oaths of Deputy and every Deputy Governor fhall, at fome Quarter Seffions of the Peace, or in One of His Majesty's Courts of Record at Dublin, within Three Months from and after the Date of his Commiffion, take fuch Oaths or Oath, and make and fign fuch Declaration or Declarations as is or fhall be required to be taken, made, and figned, by any Officer of His Majefty's Forces in Ireland.

LXXIII. LXXV. And be it further enacted, That a Book fhall be kept by Clerks of the Clerk of every Subdivifion, in which Book all Proceedings to be Subdivifions had under this Act or any A&t relating to the faid Militia, at every Subdivifion Meeting, fhall be duly and fully entered; and in the faid Book the Names of the Governors and D puty Governors prefent at every fuch Subdivifion Meeting refpectively shall be fet down and specified, and at the Foot of every Day's Proceedings fuch Sub. divifion Clerk fhall fign h's Name, and every Subdivifion C'erk fhall from Time to Time, together with the amended Lifts of Names hereinafter mentioned, tranfmit to the Clerk of the Peace a Lift of the Names, Ages, and Refidence of all fuch Perfons as fhali at any and every fuch Meeting have been excufed from ferving in the faid Militia, together with the Caufe for which they were fo excufed; and fuch Subdivifion Cerk shall alfo once in the Year, at least Ten Days previous to the annual General Meeting in October, tranfmit to the Clerk of the General Meetings of the County, a Copy of the Proceedings of all the Subdivifional Meetings in the preceding Year, figned and attefted as a true Copy by fuch Clerk of fuch. LXXVI. And be it further enacted. That the Colle&tor of His Payment of fuch Majesty's Revenue for any County fhall pay to the Clerk of the Clerks for their General Meetings the Sun of Five Pounds Thirteen Shillings and Attendance. Nine-pence for each Meeting, and fhall alfo pay to the Clerks of the feveral Subdivifion Meetings the Sum of One Pound Two Shillings and Nine-pence for each Sub-divifion Meeting, on fuch Clerk refpectively producing to fuch Collector an Order from the Governor or Governors, Deputy Governor or Deputy Governors, prefent at fuch Meeting, or any Two of them; and fuch Payments fhall be allowed in 49 Geo.
