the Jurifdiction of the Court out of which fuch original or other Writ or Procefs fhall have iffued; and in cafe of any fuch Profecution, Suit, or Procefs as aforefaid, the fame fhall be proceeded in and carried on without any wilful Delay; and that all Statutes of Jeofails and Amendments of the Law whatever fhall and may be conftrued to extend to all Proceedings in any fuch Profecution, Action, or Suit.

[19th June 1809.] "Commiffioners appointed under 48 G. 3. c. 151. § 22. to inquire "into the Forms of Process in the Court of Seffion, &c. fhall not "be required to report the Whole of their Proceedings before "May 12, 1810.-But the Proceedings on any of the Objects of "Inquiry may be reported in the mean Time. Report on the "extracting Decreets fhall be made on or before January 1, 1810.

of Ireland.

raifing and training the Militia of Ireland should be repealed, and that new Provifions fhould be made for the fame;' Be it Acts relating therefore enacted, by the King's moft Excellent Majefty, by and with to the Irish the Advice and Confent of the Lords Spiritual and Temporal, and Militia, viz. Commons, in this prefent Parliament affembled, and by the Authority Irish Acts, of the fame, That from and after the Commencement of this A&t, the feveral Acts berein-after mentioned fhall be repealed; that is to fay, an Act made in the Parliament of Ireland in the Thirty-third Year of His prefent Majefty's Reign, intituled, An Ad for amending and 33 G. 3. c. 22, reducing into One Act of Parliament the Laws relating to the Militia of Ireland; and also an A& made in the Parliament of Ireland in the Thirty-fifth Year of His prefent Majefty's Reign, to explain and 35 G. 3. c. 8. amend the faid recited Act of the Thirty-third Year aforefaid; and

teers from the Militia under certain Reflrictions, and for amending the Law relative to the Militia of Ireland, fo far as the faid A&t is in force imm: · diately before the paffing of this Act; and alfo another A&t made in the Parliament of Ireland in the faid Fortieth Year, for amending the faid first recited Act of the Thirty-third Year aforefaid; and a fo an A&t made in the Parliament of the United Kingdom in the Forty-first Year of His prefent Majefty's Reign, intituled, An Að för increafing the Number of Field Officers of the feveral Regiments of Militia in Ireland; and alfo an Act made in the Forty-fecond Year of His prefent Majefty's Reign, intituled, An A& for authorizing and rendering valid the Difcharge of certain Militia Men in Ireland, and for giving Indemnity to the feveral Counties and Places in Ireland, which may incur any Expence in confequence of the Difcharge of certain Militia Men, except only fo much of the fad lalt-mentioned Act as relates to Militia Men difcharged before the paffing of this prefent A&t; and the faid feveral A&s are hereby repealed, except as afortfaid; and alfo except fo far as the faid recited Acts or any of them repeal any former Act or Acts of Parliament, or any Claufe, Matter, or Thing therein; and alfo fave and except as to any Proceeding for the Punishment of any Perfon or Perfons for or in refpect of any Offence or Offences which fhall before the Commencement of this Act have been committed against any of the faid Acts; and fave so far as may be otherwife provided by this A&t; and alfo fave and except that all and every Commiffions, Deputations, Appointments, and Enrolments of any Officer, Non-commiffioned Officer, Drummer, or Private, or of any Governor, Deputy Governor, or inferior Civil Officer, which fhall have been made under the faid Acts or any of them, before the Commencement of this Act, fhall ftand and remain in full Force and Effect; and all and every Officer, Non-cominiffioned Officer, Drummer, and Private, Governor, Deputy Governor, or other Civil Officer, duly appointed or enrolled under the faid Acts, or any of them, fali ftand, remain, and continue in the fame Plight, Capacity, and Situation refpectively, and fhall continue ferving in the faid Militia, in ali Refpecs as if this A&t had not paffed; and that all Matters and Things whatsoever which shall have been done under and by virtue of the faid recited Acts or any of them before the Commencement of this Act, fhall be of the fame Force, Validity, and Effect, in all Refpects, as if this A& had not paffed; any Thing herein contained to the contrary notwithtanding.

II. And be it further enacted, That the feveral Regiments or Battalions of Militia in Ireland fhall refpectively be as follows; that is to fay, there fhall be for the County of Cork Two Regiments, each of Eight Companies; for each of the Counties of the Citics of Cork and Dublin, One Regiment of Eight Companies; for each of the Counties of Tyrone, Galway, Londonderry, Tipperary, Donegal and Wexford, One Regiment of Ten Companies; for each of the Counties of Antrim, Meath, Waterford, County and County of City; Kerry, Monaghan, Armagh, King's County. Limerick, Kilkenny, County and County of City, and Rofcommon, One Regiment of Eight Companies; for the County of Mayo Two Battalions, each of Seven Companie; for each of the Counties of Clare, Queen's County, Wicklow, Wellmeath, Leitrim, Cavan, Sligo, Fermanagh, Dublin, Longford, Kildare, and Carlow, One Battalion of Six Com. pan es; for the County of the City of Limerick, One Battalion of

Six Companies; for the County of Louth (including the County of the Town of Drogheda) One Regiment of Nine Companies; and for the County of Down Two Battalions of Six Companies.

III. Provided always, and be it enacted, That it fhall and may Lord Lieutebe lawful for the Lord Lieutenant or other Chief Governor or Gover. nant and Council nors of Ireland for the Time being, by and with the Advice of His may augment Majefty's Privy Council in Ireland, from Time to Time, taking into Confideration the Number of Men fit and liable to serve in the faid Militia in any County or County of a City which by this Act is required to raise any Regiment or Battalion confifting of lefs than Ten Companies, and alfo taking into Confideration the Proportion which fuch Number of Men shall bear to the Numbers of fuch Men in other Counties or Counties of Cities, to order that any Regiment or Battalion confifting of lefs than Ten Companies, fhall be augmented by increafing the Number of Companies therein respectively; fo always that no Battalion confifting of Six Companies, nor any Regiment confifting of Eight Companies, fhall be augmented by more than Two Companies; and that no Battalion of Seven Companies, nor any Regiment of Nine Companies, fhall be augmented by more than One Company; and that every fuch Company fo to be added fhall contain and confift of the fame Number of Officers, Non-commiffioned Officers, Drummers, and Privates refpectively, as the other Battalion Companies of the fame Regiment or Battalion fhall from Time to Time confift of; and that the Men of fuch Companies fhall be raifed in like Manner as the Men of the other Companies of fuch Regiment or Battalion.

IV. And be it further enacted, That it fhall and may be lawful Appointment to and for the Lord Lieutenant or other Chief Governor or Gover- of Colonels nors of Ireland, from Time to Time, as Occafion fhall require, to appoint a Colonel for every fuch Regiment or Battalion of Militia in Ireland: Provided always, that no Perfon fhall be Colonel of Two Regiments or Battalions of Militia, or of a Regiment and Battalion their RefigProvided alfo, that it fhall be lawful for the Colonel of any Regiment nation, &c. or Battalion of the faid Militia, to tender his Refignation of his Commiffion of Colonel of any fuch Regiment or Battalion to the Lord Lieutenant or other Chief Governor or Governors of Ireland for the Time being, and it fhall be lawful for fuch Lord Lieu. tenant or other Chief Governor or Governors to accept any fuch Refignation, and alfo to appoint fuch fit and qualified Perfon or Perfons as he or they fhall from Time to Time think proper, to be Colonel or Colonels in the Stead and Place of any Colonel or Colonels fo refigning as afore said, and in the Stead and Place of any Colonel or Colonels who may happen to die or be removed, as the Cafe may be. V. And be it further enacted, That the other Officers of the Other Officers feveral Regiments and Battalions of Militia aforefaid, according to of Regiments the ordinary Eltablishments hereafter mentioned, fhall be as follows and Companies refpectively; that is to fay, One Lieutenant Colonel and One Major to each Regiment or Battalior, and One Captain, Oae Lieutenant, and One Enfign to each Battalion Company: Provided alfo,

and alfo One Company of Light Infantry, to each of which Companies, inftead of One Lieutenant and One Enfign, Two Lieutenants shall be appointed.

VI. And be it further enacted, That the ordinary Establishment of each Company in the faid Militia fhall be Sixty-five Privates, Four Serjeants, Five Corporals, and Two Drummers; and that in cach Regiment or Battalion there fhall be Two Staff Serjeants, that is to fay, a Serjeant Major, and a Quarter Mafter Serjeant; and alfo a Drum Major, and Two Fifers, over and above the faid Serjeants, Corporals, Drummers, and Privates directed for cach Company; and that to each Regiment or Battalion there fhall be One Adjutant, One Paymafter, One Quarter Mafter, One Surgeon, and One Affiftant Surgeon; and to each and every Regiment whofe Eftablishment fhall be One thousand Rank and File, or more, there fhall be Two Affiftant Surgeons.

VII. And be it further enacted, That in cafe the Colonel of any Regiment or Battalion of the faid Militia fhall be defirous of keeping up a greater Number of Drummers than Two per Company, to be employed as Fifers or Muficians for the Ufe of the faid Regiment or Battalion, and fhall be willing to defray the Expence of fuch additional Drummers, it shall and may be lawful for fuch Colonel to retain in fuch Regiment or Battalion any Number of the Drummers who fhall be employed as Fifers or Muficians therein, over and above the Number of Two Drummers per Company established by this Act, and at any Time hereafter to engage any additional Number of Drummers to act as Fifers or Muficians accordingly; and all fuch Drum. mers fo retained, or in future engaged to ferve in any fuch Cafes as Fifers or Muficians, fhal! be deemed Drummers of Militia to all Intents and Purposes whatfoever, and fhall be subject to the fame Orders, Regulations, Penalties, and Punishments, as other Drummers of Militia fhall by Law from Time to Time be fubject to, and shall continue to ferve as Drummers fo long as they fhall receive the fame Pay and Clothing as other Drummers have, or better Pay and Clothing in lieu thereof, and no longer.

VIII. And whereas by an A& paffed in the Forty-fourth Year of His Majefty's Reigr, intituled, An A&t for empowering His Majefly to direct the Augmentation of His Militia Forces in Ireland to an Extent therein limited, Power was given to the Lord Lieutenant of Ireland for the Time being, to illue his Orders to any Colonel of any Regiment or Battalion of the Militia of Ireland, to enrol and receive into the fame fuch Volunteers as fhould offer to ferve therein, provided that the whole Number fhould not exceed One hundred Rank and File per Company, with the ufual Proportion of Commiffioned and Non-commiffioned Officers: And whereas in pursuance of the faid Act, Orders have been fo iffued for the Augmentation of the following Regiments or Battalions to the full Numbers allowed by the faid AA; that is to fay, the Antrim, Armagh, Carlow, Cavan, Cork, South Down, North Down, Dublin County, Dublin City, Galway, Kerry, Kilkenny, King's County, Leitrim, Limerick County, Limerick City, Londonderry, Louth, Mayo North, Mayo South, Meath, Monaghan, Queen's County, Rofcommon, Sligo, Tipperary, Tyrone, Weflmeath, Wexford, and Wicklow, which Augmentation, by the Terms of the faid A&t, was to continue only

during the prefent War: Be it therefore enacted, That during the Continuance of the prefent War, the Etablishment of the faid Regiments fhall be Five Serjeants and One hundred Rank and File, including Five Corporals per Company; and that the Number of Officers fhall, during fuch Augmentation and no longer, be as follows, that is to fay; Two Lieutenant-Colonels, and Two Majors to each Regiment, and One Lieutenant Colonel and Two Majors to each Battalion fo augmented; and to every Company fo augmented, whether in a Regiment or Battalion, One Captain, Two Lieutenants, and One Enfign; and every Grenadier and Light Infantry Company, confifting of the like Number of One hundred Men each, fhall have One Captain and Three Lieutenants.

IX. And be it further enacted, That it fhall and may be lawful Lord Lieutenant to and for the Lord Lieutenant or other Chief Governor or Governors may augment of Ireland for the Time being, to iffue his Orders in like Manner for a fimilar Augmentation of any of the other Regiments or Battalions of the Militia of Ireland, which have not been fo augmented, and that from thenceforth during the prefent War the Establishment of fuch Regiment or Battalion fhall be fuch Number of Men per Company, not exceeding One Hundred Rank and File, as fhall be fpecified in the Warrant directing fuch Augmentation, with the Proportion of Commiffioned and Non-commiffioned Officers aforefaid; and all the Claufes, Matters and Things in the faid recited Act of the Forty-fourth Year of His prefent Majefty contained relative to fuch Augmentation, and to the advancing and raifing the Sams neceffary for effecting the fame, fhall ftand and remain in full Force and Effect; any Thing herein-before contained to the contrary in anywife notwithstanding.

X. And be it further enacted, That it fhall be lawful for every Colonels shall Colonel of the faid Militia, when appointed, from Time to Time to appoint Officers, appoint the Number aforefaid refpectively of Lieutenant-Colonels, fubject to the Majors, Adjutants, Paymasters, Surgeons, Quarter Matters and Dilapprobation Affiftant Surgeons, and all other Officers for his Regiment or Battalion, qualified as herein-after directed; and every Colonel fo appainting any fuch Officer fhall certify to the Lord Lieutenant or other Chief Governor or Governors of Ireland for the Time being, the Names and Ranks of all fuch Officers fo appointed; and in cafe the Lord Lieutenant or other Chief Governor or Governors of Ireland for the Time being, fhall, within Fourteen Days after fuch Certificate thall have been laid before him or them, fignify his or their Difapprobation of any of the Perfons fo appointed, it fhall not be lawful for the faid Colonels or any of them, to grant a Commiffion to any Perfon fo difapproved, but Commiffions fhall be granted to all fuch Perfons fo appointed, who fhall not be fo disapproved as aforefaid; and all Officers of the faid Militia fhall rank with the Officers of His Majesty's Forces as youngest of their Rank.

XI. And be it further enacted, That no Commiffion of any Officer in the Militia fhall be vacated by reafon of the Revocation, Expiration, Refignation, or other Difcontinuance of the Commiflion of the fuperior Officer by whom he was appointed.

XII. And be it further enacted, That the Commanding Officer for the Time being of each Regiment or Battalion of the Militia in Ireland, fhall have the chief Command of fuch Regiment or
