kept open from Sun-rife to Sun-fet on every Day of the Year, except the Days before excepted.

XXVI. And Whereas by an A&t made in the Forty-eighth Year of His prefent Majefty's Reign, intituled, An A to permit certain Goods imported into Ireland, to be warehoufed or fecured without the Duties due on the Importation thereof being first paid; it is enacted, That it fhall be lawful for the Importers, Proprietors, or Configners of the Good, Wares, and Merchandize enumerated in the Schedule marked (A.) annexed to the faid Act, to lodge and fecure the fame in Warehoufes without Payment at the Time of the first Entry of fuch Goods, Wares, and Merchandize of the Duties due on the Importation thereof, fubject to the Rules, Regulations, and Restrictions in the faid A& contained: And Whereas Sugar is one of the Articles enumerated in the faid Schedule marked (A.),' Be it declared and enacted, That nothing in the faid recited Act fhall extend, or be conftrued to extend, or was meant or intended to extend, to any Sugar, other than White or Clayed, or Brown or Mufcovado Sugar, of the Growth or Produce of the British Plantations in the West Indies, or of the Growth or Produce of the Eaft Indies; and that it fhall not be lawful to warehoufe any Sugar, other than fuch British Plantation Sugar, or Eaft India Sugar as aforefaid, under the Provifions of the faid recited Act; any Thing in the faid recited A&t to the contrary notwithstanding.

"All Penalties under this Act fhall be payable in British Currency; "recoverable under Customs and Excife Acts, 14 & 15 Car. 2. c. 8. ; "46 G. 3. c. 106, &c. § 27.

XXVIII. And Whereas by an A& made in the last Seffion of Parliament, intituled, An Act for abolishing Fees received by Officers in the Service of the Cuftoms in the feveral Ports of Ireland, and for regulating the Hours of Attendance and the Number of Holidays to be obferved by the faid Officers and certain Officers of Excife, certain Provifions were made for the abolishing of Fees received by all Officers of the Customs, and for the making Compenfation for the Lofs of fuch Fees; which faid last recited A&t extends to all Perfons, whether appointed by Patent or otherwise acting by themfelves or others in any Office or Employment relating to His Majesty's Cuftoms and Port Duties in Ireland; and it is expedient to make further Regulations for carrying the faid laft recited A&t into Execution;' Be it therefore enacted, That at any Time after the paffing of this A&t it fhall and may be lawful for the Lord Lieutenant, or other Chief Governor or Governors of Ireland for the Time being, to refer to the Commiffioners of Inquiry for the Time being (apointed or to be appointed under an Act made in the Forty-fourth Year of His prefent Majefty's Reign, for appointing Commiffioners to inquire into the Fees, Gratuities, Perquifites, and Emoluments received in feveral Publick Offices in Ireland), the Cafe of any Patentee or other Officer. Clerk, or other Perfon who shall have held or fhall hold any Office, whether by Patent or otherwife, anv way relating to His Majesty's Customs and Port Duties in Ireland, or who fhall have been or fhall be employed in the Service of the faid Customs at any Port in Ireland, who may have fuftained or may fuftain any Lofs by the abolishing of Fees, under or in confequence

of the Provisions of the faid recited A& made in the laft Seffion of Parliament, and who fhall claim or in the Judgment of the faid Lord Lieutenant, or other Chief Governor or Governors, or of the Commiffioners of Customs and Port Duties, fhall be entitled to claim or recover any Compenfation for fuch Lofs under or by virtue of the faid laft recited Act, and upon fuch Reference it fhall and may be lawful for the faid Commiffioners of Inquiry for the Time being to proceed, and fuch Commiffioners of Inquiry are hereby authorized, empowered, and required to proceed as foon as may be after fuch Reference, to inquire into and to inveftigate the Amount of Fees received by or on behalf of any fuch Patentee, or other Officer, Clerk, or other Perfon, or his Predeceffor, during fuch Period of Time as fhall be defcribed in fuch Reference, and to examine on Oath fuch Patentee, or other Officer, Clerk, or other Perfon, and his or their Deputy or Deputies, if any, and alfo any other Perfon or Perfons whatever refpecting the Amount of fuch Fees, and respecting the Duty required to be performed by fuch Patentee, or other Officer, Clerk, or other Perfon, and refpecting any other Matters Things whatever, which shall be referred to fuch Commiffioners of Inquiry by fuch Lord Lieutenant, or other Chief Governor or Governors relating to or concerning fuch Patentee, or other Officer, Clerk, or other Perfon, and the Office held by him, and the Com→ penfation which he fhall claim; and the faid Commiffioners of Inquiry fhall from Time to Time without Delay report to the Lord Lieutenant, or other Chief Governor or Governors of Ireland for the Time being, the Particulars of fuch Inveftigation, and the Opinion of the faid Commiffioners of Inquiry on every fuch Cafe fo referred to them in refpect to the Matters and Things referred to be inquired into and investigated, together with fuch Obfervations as fhall occur to them the faid Commiffioners with respect to the Claim of fuch Patentee, or other Officer, Clerk, or other Perion, or to the Office held by fuch Patentee, or other Officer, Clerk, or other Perfon refpectively; and it fhall be lawful for the Lord Lieutenant, or other Chief Governor or Governors of Ireland for the Time being, to make any Order refpecting fuch Patentee, or other Officer, Cierk, or other Person, and refpecting the Office or Employment held by him, and the Compenfation to be paid to him, as upon the Report of the faid Commiffioners of In- ́ quiry fhall by fuch Lord Lieutenant or other Chief Governor or Governors be thought requifite and neceffary; and it fhall be lawful for the faid Commiffioners of Cuftoms and Port Duties, to pay or caufe to be paid to every fuch Patentee or other Officer, Clerk, or other Perfon, by way of Compenfation for his Lofs of Feea, Perquifites, and Gratuities, under the faid recited Act of the laft Seffion of Parliament, any fuch Sum of Money, and to any fuch Amount annually, not exceeding the Amount which fhall be reported by the faid Commiffioners for that Purpose, as the Lord Lieutenant or other Chief Governor or Governors of Ireland for the Time being fhall direct, under his or their Sign Manual, counterfigned by Three or more of the Commiffioners for executing the Office of Lord High Treasurer of Ireland; any Thing in the faid laft recited Act or any other Act or Acts in force in Ireland to the contrary notwithstanding; and every fuch annual Payment by way of Compenfation, fhall commence from the Day whereon the Perfon for whom the fame fhall be directed, fhall have ceafed to take any Fee, Perquifite, Gratuity, or Reward; Gg3 and

and fhall continue during the Continuance of the Patent of any Patentee Officer, and during the Time which any Officer or Perfon not being a Patentee fhall continue to hold the Office or Employment in refpect of which fuch Payment by way of Compensation shall be directed as aforefaid.

CAP CXVII.

An Act for lowering the Duty of Excife on Coffee, of the
Growth of His Majefty's Dominions in Africa.

[19th June 1809.] THEREAS it is expedient to repeal the Duty of Excise by Law impofed on Coffee imported into Great Britain, so far as the fame relates to Coffee of the Growth or Produce of His Majefty's Dominions in Africa, imported directly from thence into Great Britain, and to impose another Duty in lieu thereof;' Be it therefore enacted by the King's moft Excellent Majesty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That from and after the First Day of Auguft One thousand eight hundred and nine, the Duty of Excife impofed by any Act or Acts of Parliament in force immediately before the paffing of this A&, on Coffee imported into Great Britain, so far as African Colonies, the fame relates to Coffee of the Growth or Produce of His Majefty's

imported into Great Britain, fhall be only 3d. per lb.

Dominions in Africa, and imported directly from thence into Great
Britain, fhall ceafe and determine, and be no longer paid or payable,
fave and except in all Cafes relating to the Recovery or paying any
Arrears thereof which fhall at any Time remain unpaid; and that,
from and after the said First Day of August, there fhall, in lieu and
inftead of the Duties upon Coffee hereby repealed, be raised, levied,
collected, and paid unto His Majefty, his Heirs and Succeffors, the
following Rate and Duty, that is to fay, For and upon every Pound
Weight Avoirdupois of Coffee of the Growth or Produce of His
Majefty's Dominions in Africa, and which fhall be imported directly
from thence into Great Britain, an Excife Duty of Three-pence.
"Duty fhall be levied as former Duties on Coffee, &c. and carried

in Parliament, but fuch Gifts or Promises are contrary to the ancient Ufage, Right, and Freedom of Elections, and contrary to the Laws and Conftitution of this Realm;' Be it declared and enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That if any Perfon or Perfons fhall, from and after the paffing of this A&t, either by himself, hertelf, or the melves, or by any other Perfon Perfons giving or Perfons for or on his, her, or their Behalf, give or cause to be or receiving given, directly or indirectly, or promife or agree to give any Sum Money, &c. on of Money, Gift, or Reward, to any Perfon or Perfons, upon any to procure or any Engagement, Engagement, Contract, or Agreement, that fuch Perfon or Perfons endeavour to to whom, to whofe Ufe, or on whofe Behalf fuch Gitt or Promife procure the fhall be made, fhall, by himself, herself, or themselves, or by any Election or other Perfon or Perfons whatsoever at his, her, or their Solicitation, Return of a Requeft or Command, procure or endeavour to procure the Return of any Perfon to ferve in Parliament for any County, Stewartry, City, Town, Borough, Cinque Port, or Place, every Perfon fo having given or promifed to give, if not returned himself to Parliament for fuch County, Stewartry, City, Town. Borough, Cinque Port, or Place, fhall for every fuch Gift or Promife forfeit the Sum of One thousand Pounds, to be recovered in fuch Manner as is herein-after provided, with refpect to the Sum of Five hundred Pounds; and every fuch Perfon fo returned and fo having given or fo having promiled to give, or knowing of and confenting to fuch Gifts or Promifes, upon any fuch Engagement, Contra, or Agreeement, fhall be and is hereby declared and enacted to be difabled and incapacitated to ferve in that Parliament for fuch County, Stewartry, City, Town, Borough, and 500l. Cinque Port, or Place, and that fuch Perfon fhall be deemed and taken, and is hereby declared and enacted to be deemed and taken to be no Member of Parliament, and enacted to be, to all Intents, Conftructions, and Purposes, as if he had never been returned or elected a Member in Parliament; and any Perfon or Perfons who fhill receive or accept of, by himself, herfelf, or themselves, or by any other Perfon or Perfons in truft for or to the Ufe or on the Behalf of him, her, or them, any fuch Sum of Money, Gift, or Reward, or any fuch Promife upon any fuch Engagement, Contract, or Agreement, fhall forfeit to His Majefty the Value and Amount of fuch Sum of Money, Gift, or Reward, over and above the Sum of Five hundred Pounds, which faid Sum of Five hundred Pounds he, the, or they fhill forfeit to any Perfon who fhall fue for the fame, to be recovered with fuch Cofts of Suit by Act on of Debt, Bill, Plaint, or Information, in any of His Majesty's Courts of Record at Westminster, if the Offence be committed in that Part of the United Kingdom called England and Wales, and in any of His Majetty's Courts of Record at Dublin, if the Offence be committed in Ireland, wherein refpectively no Effoign or Wager of Law, or more than One Imparlance fhall be allowed; and if the Offence be committed in Scotland, then to be recovered with full Cofts of Suit by fummary Action or Complaint

II. Provided always, and be it further enacted, That nothing in this Act contained fhall extend, or be conftrued to extend, to any Money paid or agreed to be paid to or by any Perfon, for any legal Expence bona fide incurred at or concerning any Election.

III. And be it further enacted, That if any Perfon or Perfons fhall, from and after the paffing of this Act, by him elf, herself, or themfelves, or by any other Perfon or Perions for or on his, her, or their Behalf, give or procure to be given, or promife to give or procure to be given, any Office, Piace, or Employment, to any Perfon or Perfons whatsoever, upon any exprefs Contract or Agreement that fuch Perfon or Perfens, to whom or to whofe Ufe or on whofe Behalf fuch Gift or Promile fhall be made, fhall by himself, herself, or themselves, or by any other Perfon or Perfons at his, her, or their Solicitation, Request, or Command, procure or endeavour to procure the Return of any Perfon to ferve in Parliament for any County, Stewartry, City, Town, Borough, Cinque Port, or Place, fuch Perfon fo returned, and fo having given or procured to be giver, or to having promiled to give or procure to be given, or knowing of and coufenting to fuch Gift or Promile upon any fuch expreis Contract or Agreement, fhall be and is hereby declared and enacted to be difabled and incapacitated to ferve in that Parliament for fuch County, Stewartry, City, Town, Borough, Cinque Port, or Place, and that fuch Perfon fhall be deemed and taken, and is hereby declared and enacted to be deemed and taken to be no Member of Parliament, and enacted to be to all Intents, Conftructions, and Purpofes as if he had never been returned or elected a Member in Parliament; and any Person who shall receive or accept cf, by himself, herself, or themselves, or by any other Perfon or Perfons in trust for or to the Ufe or on the Behalf of fuch Perfons, any fuch Office, Place, or Employment, upon fuch exprefs Contract or Agreement, fhall forfeit fuch Office, Piace, or Employment, and be incapacitated for holding the fame, and fhall forfeit the Sum of Five hundred Pounds, which faid Sum of Five hundred Pounds fhall be recovered as is herein before enacted; and any Perfon holding any Office under His Majefty, who fhall give fuch Office, Appointment, or Place, upon any fuch exprefs Contract or Agreement, that the Perfon to whom or for whole Ufe fuch Office, Appointment, or Place fhall have been given, fhall fo procure or endeavour to procure the Return of any Perion to ferve in Parliament, fhalt forfeit the Sum of One thousand Pounds, to be recovered in fuch Manner as is herein-before provided.

IV. And be it further enacted, That no Perfon fhall be made liable to any Forfeiture or Penalty by this A&t created or impofed, unless fome Profecution, Action, or Suit, for the Offence committed, fhall be actually and legally commenced against fuch Perfon within the Space of Two Years next after fuch Offence againft this A& fhall be committed, and unless fuch Perfon fhall be actually and legally arrefted, fummoned, or otherwife ferved with any original or other Writ or Procefs within the fame Space of Time, fo as fuch Arreft, Summons, or Service of any original or other Writ or Procefs fhall not be prevented by fuch Perfon abfconding or withdrawing out of 5 the
