ufually circulated in the County or Place wherein the faid Lands, Tenements, and Hereditaments are fituated; and in cafe any fuch absent Perfons or Commoners fhall for the Space of Fourteen Days after the laft Day of fuch Notice being fo affixed as aforefaid, and after the latt Publication thereof as aforefaid, refufe or neglect to treat or agree, or be by Abfence or otherwife prevented from treating or agreeing with the General Officer or other Perfon duly authorized in Manner directed by the faid recited Act of the Forty-fourth Year aforefaid, for a Compenfation for their refpective Rights and Interefts in fuch Lands, Tenements, and Hereditaments, then and in fuch Cafe His Majefty's Officers fhall be put into Poffeffion of fuch Lands, Tenements, and Hereditaments, if not then in Poffeffion, and a Jury fhall be fummoned, and fuch further Proceedings fhall be had for the Purpose of finding the Compenfation to be paid to fuch abfent Perfons or Commoners, for their refpective Rights and Interefts in fuch Lands, Tenements, or Hereditaments, with fuch Power of Appeal from any Verdict of any fuch Jury, as by the faid recited Act of the Fortyfourth Year aforefaid is directed.

II. And be it further enacted, That all Rules, Regulations, Claufes, Matters, and Things, contained in the faid recited Act of the Fortyfourth Year aforefaid (unless hereby altered) fhall be in force in relation to this Act, and fhall be conftrued herewith in all Refpects as if the fame were inferted her in and formed a Part thereof.

An Act for better regulating the Office of Agent General for
Volunteers and Local Militia.
[15th June 1809.]
THEREAS the Regulations by Law established in the Offices
of the Paymaster General of His Majetty's Forces, of the
Treasurer of His Majefty's Navy, and of the Treasurer of the
• Ordnance, for the iffuing and Payment of Publick Monies required for
• Army and Navy Services, have been found beneficial; and it is ex-
pedient that Regulations for the like Purposes fhould be established
by Law in the Office of the Agent General for Volunteers and
Local Militia ;' Be it therefore enacted by the King'a moft Excellent
Majefty, by and with the Advice and Corfent of the Lords Spiritual
and Temporal, and Commons, in this prefent Parliament affembled,
and by the Authority of the fame, That from and after the paffing
of this Act the faid Agent General for Volunteers and Local Militia
fhall be and is hereby authorized and empowered to apply to the
Treafury for Money for the different Services to which he may have
been or fhall be authorized to act as Agent General in the fame
Manner as the Monies required for fuch Services have hitherto been
applied for by the Paymafters General of His Majefty's Forces.

II. And be it further enacted, That the Agent General for Volunteers and Local Militia fhall from Time to Time fubmit to the Secretary at War Statements of all his Receipts and Payments, applicable to each feparate Head of Service, and that the Secretary at War for the Time being fhall caufe fuch Statements to be checked by the Books in his Department, and fhall approve of and authorize the Application for fuch further Sums for the faid Services as he may deem proper, by Letter addreffed to the faid Agent General, in which Letter the Secretary at War fhall fpecify for what particular Service

or Services the faid Money is wanted, and the faid Agent General for the Time being fhall, in all Memorials to be by him prefented to the Treasury for Money for fuch Services, pray that fuch Sum as is required may be iffued to the Governor and Company of the Bank of England, on his Account, and fhall tranfmit with cach Memorial a Copy of the Letter or Letters from the Secretary at War, and the Commiffioners of His Majesty's Treafury for the Time being, by their Letter from Time to Time fhall dirt & the Auditor of the Exchequer to iffue to the Governor and Company of the Bank of England, on account of the Agent General for Volunteers and Local Militia, naming fuch Agent General for the Time being, the Sum for which fucl. Letter fhall be drawn upon the unfatisfied Order at the Exchequer, in favour of the faid Agent G neral, for which the Receipt of the Cahier or Cashiers of the faid Governor and Company fhall be a fufficient Discharge; and all Sums for which fuch Letters of the Commiffioners of His Majefty's Treafury fhall be drawn, fhall be iffued from the Exchequer to the Governor and Company of the Bank of England, and not to the Agent Generai for Volunteers and Local Militia, and fhail be placed to the Accounts in the Books of the faid Governor and Company, for the particular Service to which the fame may be applicable, which Accounts fhall be entitled, "The Account of the Agent General for Volunteers," "The Account of the Agent General for Local Militia," and "The Account of the Agent General for the Militia and Defence Acts," inferting the Name of fuch Agent General for the Time being in each of them refpectively.

III. And be it further enacted, That no Fees whatever fhall be Only ufual Fees paid at the Exchequer or Treatury by reafon of the Tranfactions fhall be paid. aforefaid, beyond the Amount of what hath been ufually paid upon Imprefts and Accounts hitherto made, according to the former Cuftom of tranfacting Bufin-fs between the Exchequer, Pay Office, and Bank feverally.

IV. And be it further enacted, That it fhall be lawful for the Agent General for Volunteers and Local Militia for the Time being, by himself or his Depury, or the Perfon or Perfons in his Office, duly authorized by the faid Agent General, to accept all fuch Bills, Drafts, or Orders, which fhall be drawn upon him by any Officers of Volunteers or Local Mil tia, or other Perfons duly authorized by the Secretary at War, payable at the Bank of England; and every fuch Bill or Draft fhall fpecify the particular Head of Service to which the Sum therein mentioned is to be applied, and no Bill or Draft fo accepted, thall be deemed a fufficient Voucher to the faid Governor and Company, unless the Service for which it is drawn is specified thereon, and unless it fhall be actually paid by the faid Governor and Company, and the Monies fo to be iffued to the faid Governor and Company on account of the faid Agent General, fhall not be paid out of the Bank unlefs for the Publick Services, for which his feparate Accounts are opened, and in purfuance of Bills or Drafts drawn upon the faid Agent General and accepted as aforefaid, on which fhall be fpecified the Heads of Service to which the Sums therein mentioned are to be applied, and which Drafts or Bills fo drawn and accepted fhall be fufficient Authority to the Bank of England to pay fuch Money to the Perfon or Perfons mentioned iu fuch Drafts or Bills, 49 Geo. or to their Order or Orders according to the ufual Course in respect to Bills of Exchange.

V. Provided always, and be it further enacted, That it shall be lawful for the Secretary at War, from Time to Time to authorize and empower the faid Agent General to draw on the Bank of England for fuch Sums as the Secretary at War fhall deem proper, for the Payment of the Salaries and Allowances to the Perfons employed in his Office, and for fuch Sums as fhall be neceffary for Payments on his petty Accounts, and the faid Agent General is hereby directed to draw diftin&t and feparate Drafts for each of the faid Services, and to keep a feparate Account thereof.

VI. And be it further enacted, That the faid Agent General for the Time being fhall keep Accounts with the Bank of England of all Monies iffued or directed to be paid to him for Publick Services; and the faid Agent General, obferving the Rules and Regulations hereby prefcribed, fhall not be anfwerable for any Money which he fhall not actually receive, or which fhall not be actually drawn for by him, or paid upon the Bills accepted by him or his Deputy, or other Perfon or Perfons authorifed by him as aforefaid; and the faid Governor and Company of the Bank of England fhall be answerable for all the Monies which fhall be actually received by them for such Publick Services.

VII. And be it further enacted, That all Sums of Money received by the faid Agent General for Publick Services, fhall be immediately paid by him into the Bank of England, and placed to his Account there in Manner aforefaid; and fuch Money fhall be iffued, paid, aud applied in fuch and the like Manner, and under the fame Regulations and Restrictions as the Money to be iffued from the Exchequer for fuch Services is herein directed to be iffued, paid, and applied.

VIII. And, in order that the Commiffioners of His Majefty's Treafury may have frequent Knowledge of the Balance of Cash in the Hands of the Governor and Company of the Bank of England, on account of the Agent General for Volunteers and Local Militia, and thereby be enabled to judge of the Neceffity and Propriety of further Ifflues, and prevent the unneceffary Accumulation of Publick Money in the Hands of the faid Governor and Company,' Be it enacted, That in the First Memorial prefented every Month, or oftener, if required, to the Commiffioners of His Majesty's Treasury by the Agent General for Volunteers and Local Militia for the Time being, for a Supply of Money for Publick Services, fuch Agent General or his Deputy fhall infert in the Body of fuch Memorial the Sum total of the Balance of Publick Money on account of the Agent General, in the Hands of the Governor and Company, together with an Account of all the Claims and outstanding Drafts or Bills with which fuch Balance is chargeable, and to which it is to be applied.

IX. And be it further enacted, that upon the Death, Refignation, or Removal of any Agent General for Volunteers and Local Militia, the Balance of Cash for which he fhall at that Time have Credit on his Account or Accounts, as Agent General, with the Governor and Company of the Bank of England, fhall, as foon as a Succeffor shall be appointed, actually veft in fuch Succeffor, in truft for the Publick Services for which the fame were iffued, and fhall forthwith be transferred, carried over, and placed to the Account of such Succeffor,

to be applied to the faid Services in the Manner herein before directed, and the fucceeding Agent General fhall, and he is hereby directed and required to fubmit Statements to the Secretary at War, and from his Memorials and Requifitions to the Treafury, and to accept Bills as aforefaid for all unfatisfied Charges and Demands on account of Publick Services, although the fame fhall have accrued in the Time of any preceding Agent General.

X. And be it further enacted, That all fuch Accounts of the Agent General for the Time being fhall be tranfmitted, with proper Vouchers, to the Commiflioners for auditing the Publick Accounts, who, fhall and they are hereby directed and required, with the leaft poffible Delay, after the Receipt thereof, to examine or caufe to be examined the faid Accounts, and if found fatisfactory to prefent or caused to be prefented the fame to the proper Officer or Officers for Declaration, and when the fame are declared, a Quietus or Acquittance in the ufual Form fhall be made out to the Agent or Agents General, whofe Accounts fhall have been fo declared, his or their Heirs, Executors, or Adminiftrators.

Office of the

XI. And be it further enacted, That all Books of Accounts, Books of and all Vouchers whatever kept in the Offices of Agent General Accounts and for Volunteers and Local Militia fhail belong to the faid Office, Vouchers (hall and fhall not be at the Difpofal of the Agent General to take and belong to the difpofe of the fame as his private and proper Books of Account and Agent General, Vouchers; provided that nothing herein fhall extend to prevent any for the time Perfon who hath exercifed the Office of Agent General, or his or being. their Executors or Adminiftrators, by himfelf or themfelves, or by any Person or Perfons authorized by him or them, from taking Copies or Extracts thereof until an Acquittance in the Exchequer fhall be made out for fuch Agent General, his Heirs, Executors, and Adminiftrators, nor the Tranfmiffion of the Vouchers in due Time to the Commiffioners for auditing the Publick Accounts.

XII. And be it further enacted, That if any Perfon or Perfons fhall knowingly and wil'ully forget or counterfeit, or caufe or procure to be forged or counterfeited, or knowingly or wilfully act or affift in forging or counterfeiting the Name or Hand of the Agent General for the Time being, or his Deputy, or the Perfon or Perfons duly authorized as aforefaid, to any D att, Inftrument, or Writing whatfoever, for or in order to the receiving or obtaining any of the Money in the Hands or Cuftody of the Governor and Company of the Bank of England, on account of the Agent General for the Volunteers and Local Militia, and fhall forge or counterfeit, or caufe or procure to be forged or counterfeited, or knowingly and wilfully act or affift in the forging or counterfeiting any Draft, Intrument, or Whiting, in Form of a Draft, made by fuch Agent General or his Deputy, or the Perfon or Perfons authorized as aforefaid, or fhall utter or publish any fuch, knowing the fame to be forged or counterfeited, with an Inten tion to defraud any Perfon whomforver, every fuch Perfon or Perfons fo offending, being thereof lawfully convicted, fhall be, and is and are hereby declared and adjudged guilty of Felony, and thall fuffer Death as in Cafes of Felony, without Benefit of Clergy.

XIV. And be it further enacted, That it shall and may be lawful for the faid Paymaster General to caufe any Sum or Sums of Money arifing from Fines, Penalties, and Forfeitures under the faid recited A&t paffed in the laft Seffion of Parliament which fhall have been or fhall be received by him or paid to the Bank of England on his Account, to be transferred or paid over to the feparate Account opened at the Bank of England, in the Name of the Agent General for Volunteers and Local Militia, and by fo doing the faid Paymafter General shall be and is hereby fully difcharged for the Amount of the Sum which may have been or fhall be fo transferred or paid over by him as aforefaid: And from and after the paffing of this Act all Fines, Penalties, and Forfeitures arifing under the faid recited Acts which may have been or fhall be received by any Clerk of Sub divifion or other Meetings, fhall, within Twenty one Days after the Receipt thereof, be paid into the separate Account in the Bank of England, in the Name of the Agent General for Volunteers and Local Militia, in the fame Manner, and under the fame Rules and Regulations, and subject to the fame Provifions, Claufes, and Penalties fo far as is confiftent with the Provifions of this A&t as are contained or preferibed in the faid recited As with respect to the Payment of Fines, Penalties, and Forfeitures directed to be made to the Account of the Paymaster General; and all fuch Sums of Money fo transferred or paid into fuch Account of fuch Agent General fhall be applied in the fame Manner as if the fame had been iffued from the Exchequer to fuchAccount.

XV. And be it further enacted, That fo much of the faid recited Acts as direct that the Clerk of Subdivifion or other Meetings fhall draw upon the Faymafter General of His Majefty's Forces for the Amount of the Bounties payable under the faid recited A&s to Perfons transferring themfelves from Volunteer Corps or voluntarily enrolling themselves into the Local Militia fhall be and is hereby repealed.

XVI. And be it further enacted, That from and after the paffing of this A&t, all fuch Bills or Drafts on account of Bounties as aforefaid, fhall be drawn upon the Agent General for Volunteers and Local Militia, and fhall be by him accepted agreeably to fuch Regulations as from Time to Time be iffued by the Secretary at War for the Time being.

XVIII.
