III. And be it further enacted, That it fhall and may be lawful to and for the several Grand Juries throughout Ireland, at each Assizes, to prefent for the feveral Clerks of the Crown and Clerks of the Peace, or their Deputies, Sheriffs, or Under Sheriffs, Gaolers, and Criers, in lieu of the Fees of fuch Perfons as fhall be indicted, tried, acquitted and discharged, without Fees, at or between each Affizes, any Sum they fhail think reafonable and fair, in lieu of fuch Fees as they have been heretofore accustomed to demand and receive for the fame, not exceeding fuch Amount as fhall be ascertained, according to the Rates in this A&t allowed, by the Affidavit of fuch Clerk of the Crown, Clerk of the Peace, or other Officer herein-before mentioned, the fare to be fworn before the refpe&ive Judges of Affize; and which Pref ntments fo made by the faid Grand Juries, the feveral Judges of Affize fhall and may order to be fiated, note withstanding any Law or Ufage to the contrary.

IV. Provided always, and be it enacted, That in all and every Cafe where any Prifoner or Prifoners fhall be acquitted on account of or by reafon of any Informality, Error, or Defect in any Indictment whereon any Prifoner or Prifoners fhall be tried, no Fee whatever fhall be paid to or prefented by the Grand Jury for fuch Clerk of the Crown, Clerk of the Peace, or any of their Deputies who shall have prepared fuch informal or erroneous Indictment for or on account thereof, or of any Prifoner that fhall be discharged therefrom, provided that the Judge of Affize, Chairman, or Affiftant Barrister at Seffions, fhall certify that fuch Acquittal or Acquittals was or were occafioned by Informality, Want of Form, or other Defect in the Indictment on which fuch Prifoner or Prifoners was or were acquitted and difcharged.

'inftead of Baronies or Half Baronies only,' Be it therefore enacted, That fo much of the faid Act as directs that the feveral Counties of that Part of the United Kingdom called Ireland should be divided into Two Divifions, by a certain Number of Baronies or Half Baronies, shall be and the fame is hereby repealed; and that it shall and may be lawful, from and after the p ffing of this Act, to and for the Lord Lieutenant, or other Chief Governor or Governors, of that Part of the United Kingdom called Ireland, for the time being, by and with the Advice of the Privy Council, to divide fuch of the feveral Counties of Ireland, as they fhall think expedient, for the Advantage and greater Convenience of the Inhabitants thereof into Two Divifions, for the Purposes of the faid Act, and none other, to confift of a certain Number of Baronies, Halt Baronies, and Parishes, within the faid Counties refpectively, inftead of Baronies or Half Baronies only; and every fuch Divifion fo to be appointed, shall be diftinguished by the Names of fome one Barony or Half Barony of which it fhall be compofed.

An Act to appoint Commiffioners to inquire and examine, until the First Day of August One thoufand eight hundred and eleven, into the Nature and Extent of the feveral Bogs in Ireland, and the Practicability of draining and cultivating them, and the beft Means of effecting the fame.

WHERE, SetDrainage whereof is neceflary for their being

HEREAS there are large Tracts of undrained Bog in

brought into a State of Tillage: And whereas the adding their Contents to the Lands already under Cultivation would not only increase the Agriculture of Ireland, and contribute much to its Refources for the Suftenance of the British Empire and its profitable Export of Corn, but is highly expedient towards promoting a fecure Supply of Flax and Hemp within the United Kingdom, for the Ufe of the Navy, and Support of the Linen Manufacture, independent of Foreign Nations and of the Interruptions arifing from the Influence of political Events upon Foreign Trade: And whereas the Appointment of Commiffioners for the Purpofe of afcertaining the Extent of fuch Bogs, and the Practicability and • Expence of draining the fame, and for the other Purposes herein⚫ after mentioned, will materially affist in effecting their Cultivation ;' Be it therefore enacted by the King's moft Excellent Majefty, by. and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That any Perfons (not exceeding in the whole the Number of Nine Perfons) who fhall be nominated and appointed by the Lord Lieutenant or other Chief Governor or Governors of Ireland for the Time being, by Writing under the Hand or Hands of fuch Lord Lieutenant or other Chief Governor or Governors to be Commiffioners for the Execution of this Act, fhall be and they are hereby appointed to be Commiffioners for afcertaining Acres in Extent. the Extent of all fuch Bogs in Ireland as fhall by Repute or Etti mation exceed the Extent of Five hundred Acres; and for inquiring

and examining into the Practicability of draining each fuch Bog, and into the best Mode and probable Expence of effecting fuch Drainage; the Depth of Bog Soil, the Nature of the Strata immediately underneath; the Nature and Distance of the Manure beft fitted for their Improvement, and the Expence of making the neceffary Roads or Canals for conveying fuch Manure into and through the fame, from the nearest or moft convenient Publick High Roads or Canals, and for the carrying out the future Produce of the Bg Land, when cultivated, to the nearest or molt Publick Roads or Canals, together with the Opinion of the faid Commiffioners as to fuch Measures as they fhall deem neceffary or expedient for carrying into fpeedy Effect the Drainage, Cultivation, and Improvement of all fuch Bogs, and the future Increafe of Timber in Ireland, by vroviding for the Plantation and Prefervation of Trets in fuch Parts there f as fhall be beft fitted for the Purpose.

II. And be it further enact d, That in cafe of any Vacancy or Appointment of Vacancies by Death or Refignation of any One or more of the Com- new Commilmiffioners to be appointed by virtue of this A&t during the Continuance fioners, thereof, it shall and may be lawful to and for the Lord Lieutenant or other Chief Governor or Governors of Ireland for the Time being, to nominate and appoint fuch Perfon or Perfons as he or they may think proper to fupply fuch Vacancy or Vacancies; and every Perfon fo nominated and appointed shall be fubject to the fame Rules. Regulations, and Reftrictions, and fhall have the like Powers and Authorities for carrying this Act into Execution to all Intents and Purposes what foever, as the Perfons originally appointed to be Commiffioners under this Act.

III. And be it further enacted. That all and every Perfon and No Salary to Perfons who fhall & as a Commiffioner or Commiffioners under Commisioners. this Act, fhall fo act without any Salary, Recompence, or Reward whatever.

"Commiffioners fhall be fworn, § 4. Commiffioners empowered to "mert and make Inquiries; to examine Perfons on Oath; and "to appoint Engineers, Surveyors, &c. for the Execution of this "Act, 3. Commiffioners and their Surveyors, &c. empowered "to enter on Lands, to furvey and afcertain the Nature of the "Soil, &c. § 6. Commiffioners may fit in the Houfe of the Linen "Board, or Duban Society, § 7. Commiffioners fhail report their "Proceedings to Lord Lieutenant and Parliament, with Plans for the Cultivation of the Boge, &c. § 8. On Application of Pro"prictors of Bogs lefs than 500 Acres, Commiffioners may make. Inquiries as to the fame under this A&t, § 9. Treafury of Ireland "may iffue 500l. to defray the Expences of Surveyors, Engineers, "Clerks, and Officers, acting under the Commiffioners, § 10.

XI. And be it further enacted, That if any Perfon or Perfons fhall, Perfons giving falfe Evidence upon his, her, or their Examination before the faid Commiffioners, or any Three of them, wilfully and corruptly give falfe Evidence, every guilty of Perjury. fuch Perfon fo offending, and being thereof duly convicted, fhall be, and he, fhe, and they is and are hereby declared to be fubject and liable to fuch Pains and Penalties as by any Law now in force and eff & in Ireland, Perfons guilty of wilful and corrupt Perjury are fubject and liable to.

HEREAS by an A&t made in the laft Seffion of Parliament,

building and rebuilding of Churches, Chapels, and Glebe Houfes, and for the Purchafe of Glebe Lands, Glebe Houfes, and Impropriations 'in Ireland, it was among other Things enacted, That on Appli'cation made to the Trustees and Commiffioners of First Fruits in • Ireland, in Manner in the faid Act mentioned concerning the erecting of any new Church or Chapel or the re building of any Church or Chapel in any Parish or Place in Ireland, it should be lawful for • the faid Truflees and Commiffioners to advance to the Parties making fuch Application, out of the Monies and Funds intrufted to their • Care, the whole or any Part of the Sum or Sums of Money to be applied in the Erection or re-building of fuch Church or Chapel; and that if the faid Trustees and Commiffioners fhould be of Opinion that it was fitting that any Sum of Money ío advanced, or any Part thereof, should be advanced by way of Loan to and fhould be repaid by any Parish, it should be lawful for the faid Trustees and Commiffioners to require and take Security by Bond for the repaying of 'fuch Money fo advanced, in Manner and at the Times in the faid A&t mentioned; and that every Bond for Money advanced by the Lord High Treafurer or Commiffioners of the Treasury of Ireland, by virtue of the faid Aft fhould be made payable to His M.jetty. his Heirs and Succeffors; and if fuch Sum of Money fhould not be duly paid, the faid Bonds fhould be put in Suit under the Orders of the faid Lord High Treafurer, or Commiffioners of the Treafury, or any Three of them; And whereas the Inconvenience refulting to Individuals from the entering into the Bords and Securities required by the faid recited A&t may obftru&t the Attainment of the beneficial Effects of the faid A&;' Be it therefore enacted by the King's moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act, whenever any Sum or Sums of Money whatever fhall be advanced by the said Trustees and Commiffioners by way of Loan, and to be repaid by the Parish or Place in which any Church or Chapel fo to be erected or rebuilt fhail be erected or fituate, whether fuch Money fhall be advanced by the faid Truftees and Commiffioners out of any Money to be advanced to them by the faid Lord High Treasurer or Commiffioners of the Treafury, or out of any other Funds in the Hands, Power, Cuftody, Poffeffion or Difpofal of the faid Commiffioners and Trustees, it fhall not be neceffary for the faid Commiffioners and Trustees to require and take any fuch Security by Bond as in the faid Act is mentioned for the Repayment of any fuch Sum or Sums of Money fo advanced, or any Part or Proportion thereof, any Thing in the faid recited Act, or in any other Act or Acts in force in Ireland, to the contrary in any wife notwithftanding.

And be it further enacted, That from and after the paffing of Inftead of Sethis A&t, whenever the Minifter and Churchwardens, or any Two curity or Bond Proteftant Inhabitants of ary Parish or Place in Ireland, in which it for Money fhall be propofed and intended that any Church or Chapel fhall be erected or rebuilt, fhall have made Application in Manner directed by the faid recited Act, to the faid Trustees and Commiffioners for the advancing of any Money for fuch Purpofe, and the faid Trustees and Commiffioners hall have fignified their Intention of advancing any Sum or Sums of Moncy for fuch Purpose, and fhall be of Opinion that it is fitting and expedient that fuch Sum or Sums of Money; or any Part thereof, fhould be advanced by way of Loan to, and fhould be repaid by fuch Parish or Place, then and in fuch Cafe in the Place and Stead of any Bond or Security being taken by the faid Trustees for the Re-payment of fuch Sum of Money, or any Part thereof, it fhall and may be lawful for the Inhabitants of any fuch Parish or Place, affembled at a Veftry duly fummoned and called upon, Seven Days Notice at least, to make an Affeffment upon fuch Parish or Piace, of a Sum equal to the whole Sum fo to be advanced by Way of Loan, to be repaid by Inftalments in Seventeen fucceffive Years.

Affeffment.

III. And be it further enacted, That it fhall and may be lawful Mode of raifing for every such Veftry to affefs upon fuch Parish or Place the whole fuch annual Sum fo to be advanced by way of Loan, to be raised, levied, and Inftalments by paid in Manner and at the Times following, that is to fay, Six Pounds per Centum of the Sum fo advanced and to be repaid, fhall be fo raised and paid by fuch Parish on or before the First Day of July next after the Expiration of One Year from the Day on which fuch Sum fhall be fo advanced; Six Pounds per Centum more of fuch Sum on or before the First Day of July in every fucceeding Year, until Ninetyfix Pounds per Centum of the Sum fo advanced and to be repaid fhall be fo raised and paid by fuch Parish; and the remaining Four Pounds per Centum of fuch Sum on or before the First Day of July in the Year fucceeding that in which the laft Inftalment of Six Pounds per Centum fhall have been paid as before-mentioned; and that the Amount of the faid annual Inftalments, or Sum or Sums of Money, fhall be a Charge on fuch Parish or Place, and fhall, without further Authority, be from Time to Time applotted, levied, and raised without further Affeffment in fuch Parish or Place, in fuch Manner, and with all fuch Powers and Remedies for the applotting, railing, and levying of the fame in all Refpects as is or are provided for the applotting, raifing, and levying of any Sum or Sums of Money, Rate, Parish Affeffment, Cefs, or Tax, for repairing, building, or re-building of any Church or Chapel, or other neceffary Charges belonging to fuch Church or Chapel, under or by virtue of the said recited A&t of the laft Seffion, or of any other Act or Acts in Force in Ireland at the Time of the paffing of this Act; and that all Churchwardens and Vestries shall have the like Power to affefs all Parishes and Places, and to applot and levy fuch Affeffments, and be accountable for the fame, and to do all Matters and Things for the affefling futh Sums, or for applotting, raifing, and levying of fuch annual Inftalments or Sums fo to be payable as aforefaid in all Refpects whatsoever, as they now have refpectively touching or concerning any Rate or Rates, Sum or Sums of Money, Parish Cefs or Tax, for the repairing, building, or re-building of any Church or Chapel, or any other neceffary Charge belonging to
